Bununla birlikte her kanun yolu ayn\u0131 niteli\u011fe, ayn\u0131 amaca ve ayn\u0131 usul\u00ee \u00e7er\u00e7eveye sahip de\u011fildir. \u00d6zellikle ola\u011fan ve ola\u011fan\u00fcst\u00fc kanun yollar\u0131 aras\u0131ndaki ayr\u0131m, ceza muhakemesi sisteminin dengesi bak\u0131m\u0131ndan b\u00fcy\u00fck \u00f6nem ta\u015f\u0131r. Ola\u011fan kanun yollar\u0131 hen\u00fcz kesinle\u015fmemi\u015f kararlara y\u00f6nelirken, ola\u011fan\u00fcst\u00fc kanun yollar\u0131 \u00e7o\u011fu kez art\u0131k ola\u011fan denetim mekanizmalar\u0131n\u0131n sona erdi\u011fi bir a\u015famada devreye girmekte ve daha s\u0131n\u0131rl\u0131, daha teknik, daha istisnai bir denetim alan\u0131 yaratmaktad\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u00e7er\u00e7evede, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">5271 say\u0131l\u0131 Ceza Muhakemesi Kanunu<\/a>\u2019nun 308. maddesinde d\u00fczenlenen Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n itiraz yetkisi, T\u00fcrk ceza muhakemesi sisteminin en dikkat \u00e7ekici ola\u011fan\u00fcst\u00fc kanun yollar\u0131ndan biridir. Bu yol, ilk bak\u0131\u015fta yaln\u0131zca Yarg\u0131tay ceza daireleri kararlar\u0131na kar\u015f\u0131 Ba\u015fsavc\u0131l\u0131\u011fa tan\u0131nm\u0131\u015f kurumsal bir ba\u015fvuru yetkisi gibi g\u00f6r\u00fcnse de, ger\u00e7ekte \u00e7ok daha derin bir i\u015flev g\u00f6rmektedir. Zira bu kurum, yaln\u0131zca bireysel bir dosyada ortaya \u00e7\u0131kan hukuka ayk\u0131r\u0131l\u0131klar\u0131n giderilmesine de\u011fil, ayn\u0131 zamanda Yarg\u0131tay i\u00e7tihatlar\u0131n\u0131n tutarl\u0131l\u0131\u011f\u0131n\u0131n sa\u011flanmas\u0131na, ciddi adli hatalar\u0131n d\u00fczeltilmesine ve gerekti\u011finde ceza muhakemesi sistemindeki yorum sapmalar\u0131n\u0131n Ceza Genel Kurulu eliyle dengelenmesine hizmet etmektedir.<\/span><\/p>\n<p data-start=\"2078\" data-end=\"2759\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uygulamada ise <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308, \u00e7o\u011fu zaman yanl\u0131\u015f anla\u015f\u0131lan, temyiz ile kar\u0131\u015ft\u0131r\u0131lan, yarg\u0131laman\u0131n yenilenmesi veya kanun yarar\u0131na bozma gibi di\u011fer ola\u011fan\u00fcst\u00fc yollarla s\u0131n\u0131rlar\u0131 yeterince ayr\u0131\u015ft\u0131r\u0131lmayan bir kurum olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r. Oysa bu yolun ba\u015far\u0131yla kullan\u0131labilmesi i\u00e7in, yaln\u0131zca kanun metninin bilinmesi yetmez; ayn\u0131 zamanda hangi t\u00fcr hukuka ayk\u0131r\u0131l\u0131klar\u0131n bu yola elveri\u015fli oldu\u011fu, itiraz\u0131n hangi karara y\u00f6neltilmesi gerekti\u011fi, itiraz\u0131n s\u00fcresinin ve kapsam\u0131n\u0131n nas\u0131l de\u011ferlendirilece\u011fi, ceza dairesi ile Ceza Genel Kurulu aras\u0131ndaki i\u015f b\u00f6l\u00fcm\u00fcn\u00fcn ne oldu\u011fu ve en \u00f6nemlisi de bu yolun di\u011fer ola\u011fan\u00fcst\u00fc kanun yollar\u0131yla nas\u0131l ili\u015fkilendi\u011finin iyi anla\u015f\u0131lmas\u0131 gerekir.\u00a0<\/span><\/p>\n<p data-start=\"2761\" data-end=\"3547\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu makalenin amac\u0131, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019i yaln\u0131zca norm metni d\u00fczeyinde tan\u0131tmak de\u011fil; ayn\u0131 zamanda onu yarg\u0131sal uygulama ve i\u00e7tihat \u0131\u015f\u0131\u011f\u0131nda sistematik bi\u00e7imde incelemektir. \u00d6zellikle Yarg\u0131tay Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli, E. 2023\/5-35, K. 2023\/113 say\u0131l\u0131 karar\u0131, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n kapsam\u0131, s\u0131n\u0131rlar\u0131, y\u00f6neltilece\u011fi karar\u0131n belirlenmesi ve yarg\u0131laman\u0131n yenilenmesi ile ili\u015fkisi bak\u0131m\u0131ndan son derece \u00f6\u011fretici bir i\u00e7tihat ortaya koymu\u015ftur. Bu karar, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in teknik yap\u0131s\u0131n\u0131 anlamak bak\u0131m\u0131ndan sadece yard\u0131mc\u0131 bir \u00f6rnek de\u011fil, ayn\u0131 zamanda konuya y\u00f6n veren temel i\u00e7tihatlardan biri niteli\u011findedir. Bunun yan\u0131nda, Ceza Genel Kurulu ve Yarg\u0131tay daire kararlar\u0131nda yer alan \u00e7e\u015fitli ilkeler de Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yolunun uygulama alan\u0131n\u0131 ve s\u0131n\u0131rlar\u0131n\u0131 netle\u015ftirmektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu nedenlerle, a\u015fa\u011f\u0131da \u00f6nce <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in hukuki niteli\u011fi ve <a href=\"https:\/\/www.bicakhukuk.com\/works\/itiraz-istinaf-temyiz\/\" target=\"_blank\" rel=\"noopener\">kanun yolu<\/a> sistemindeki yeri a\u00e7\u0131klanacak; ard\u0131ndan itiraz\u0131n amac\u0131, kapsam\u0131, s\u00fcresi, usul\u00fc ve s\u0131n\u0131rlar\u0131 incelenecek; sonras\u0131nda yarg\u0131laman\u0131n yenilenmesi ve di\u011fer ola\u011fan\u00fcst\u00fc kanun yollar\u0131yla ili\u015fkisi ele al\u0131nacak; son b\u00f6l\u00fcmde ise Yarg\u0131tay i\u00e7tihatlar\u0131 \u0131\u015f\u0131\u011f\u0131nda uygulamaya d\u00f6n\u00fck stratejik de\u011ferlendirmeler yap\u0131lacakt\u0131r. B\u00f6ylece hem uygulamac\u0131lar i\u00e7in pratik bir yol haritas\u0131, hem de akademik tart\u0131\u015fma bak\u0131m\u0131ndan sistematik bir \u00e7er\u00e7eve ortaya konulacakt\u0131r.<\/span><\/p>\n<h3 data-section-id=\"4pt08b\" data-start=\"4060\" data-end=\"4127\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">1. CMK m. 308\u2019in Hukuki Niteli\u011fi ve Kanun Yolu Sistemindeki Yeri<\/span><\/h3>\n<p data-start=\"4129\" data-end=\"4715\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza muhakemesi hukukunda kanun yollar\u0131 klasik olarak ola\u011fan ve ola\u011fan\u00fcst\u00fc kanun yollar\u0131 \u015feklinde iki ana gruba ayr\u0131l\u0131r. Ola\u011fan kanun yollar\u0131, hen\u00fcz kesinle\u015fmemi\u015f kararlara kar\u015f\u0131 ba\u015fvurulan; karar\u0131n maddi ve hukuki y\u00f6nlerden yeniden incelenmesini sa\u011flayan mekanizmalard\u0131r. <a href=\"https:\/\/www.bicakhukuk.com\/works\/itiraz-istinaf-temyiz\/\" target=\"_blank\" rel=\"noopener\">\u0130stinaf<\/a> ve <a href=\"https:\/\/www.bicakhukuk.com\/works\/itiraz-istinaf-temyiz\/\" target=\"_blank\" rel=\"noopener\">temyiz<\/a> bu grupta yer al\u0131r. Buna kar\u015f\u0131l\u0131k ola\u011fan\u00fcst\u00fc kanun yollar\u0131, ola\u011fan denetim a\u015famalar\u0131 sona erdikten sonra ve istisnai nedenlerle devreye giren \u00f6zel denetim ara\u00e7lar\u0131d\u0131r. Bunlar, sistemin ola\u011fan ak\u0131\u015f\u0131n\u0131 bozmayacak \u015fekilde s\u0131n\u0131rl\u0131, dikkatli ve \u00f6l\u00e7\u00fcl\u00fc kullan\u0131lmas\u0131 gereken yollar olarak kabul edilir.<\/span><\/p>\n<p data-start=\"4717\" data-end=\"5405\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019de d\u00fczenlenen Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n itiraz\u0131, normatif konumu itibar\u0131yla a\u00e7\u0131k bi\u00e7imde ola\u011fan\u00fcst\u00fc kanun yoludur. Bu tespit, yaln\u0131zca kanunun sistematik yerinden de\u011fil, ayn\u0131 zamanda Yarg\u0131tay i\u00e7tihatlar\u0131ndan da a\u00e7\u0131k\u00e7a anla\u015f\u0131lmaktad\u0131r. Nitekim Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023 tarihli karar\u0131nda, 1412 say\u0131l\u0131 CMUK d\u00f6neminde temyize ili\u015fkin h\u00fck\u00fcmler aras\u0131nda yer alan bu kurumun, 5271 say\u0131l\u0131 <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a>\u2019da ola\u011fan\u00fcst\u00fc kanun yollar\u0131 b\u00f6l\u00fcm\u00fcnde d\u00fczenlendi\u011fini a\u00e7\u0131k\u00e7a vurgulam\u0131\u015ft\u0131r (Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113). Bu tespit, yaln\u0131zca teknik bir s\u0131n\u0131fland\u0131rma olmay\u0131p, kurumun uygulanma mant\u0131\u011f\u0131n\u0131 belirleyen esasl\u0131 bir hukuki nitelendirmedir.<\/span><\/p>\n<p data-start=\"5407\" data-end=\"5936\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ger\u00e7ekten de <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308, temyizin devam\u0131 veya ikinci bir temyiz de\u011fildir. Bu yol, Yarg\u0131tay ceza dairesi karar\u0131ndan sonra devreye girer. Bir ba\u015fka ifadeyle, ola\u011fan denetim tamamland\u0131ktan sonra, art\u0131k ceza dairesi karar\u0131 verilmi\u015f ve dosya temyiz bak\u0131m\u0131ndan sonu\u00e7land\u0131r\u0131lm\u0131\u015f olduktan sonra, Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131 re\u2019sen veya istem \u00fczerine bu karara kar\u015f\u0131 Ceza Genel Kurulu nezdinde bir denetim s\u00fcreci ba\u015flatabilir. Kurumun bu yap\u0131s\u0131, onun s\u0131radan bir taraf ba\u015fvurusu veya yeni bir derece denetimi olmad\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu ola\u011fan\u00fcst\u00fc nitelik, yetkinin sadece Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131na tan\u0131nm\u0131\u015f olmas\u0131nda da kendisini g\u00f6sterir. San\u0131k, m\u00fcdafi, kat\u0131lan veya vekil do\u011frudan Ceza Genel Kurulu\u2019na giderek CMK m. 308 kapsam\u0131nda ba\u015fvuru yapamaz. Bu ki\u015filer ancak Ba\u015fsavc\u0131l\u0131\u011fa ba\u015fvurarak itiraz yolunun kullan\u0131lmas\u0131n\u0131 talep edebilirler. Dolay\u0131s\u0131yla burada, bireysel bir hak arama yolundan \u00e7ok, ceza adaleti sisteminin b\u00fct\u00fcnl\u00fc\u011f\u00fcn\u00fc korumaya y\u00f6nelen, kurumsal nitelikli bir denetim mekanizmas\u0131 s\u00f6z konusudur.<\/span><\/p>\n<p data-start=\"6423\" data-end=\"6952\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu ba\u011flamda <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in hukuki niteli\u011fini anlamak i\u00e7in \u00fc\u00e7 temel \u00f6zellik vurgulanmal\u0131d\u0131r. Birincisi, bu yol istisnaidir; yani her uyu\u015fmazl\u0131kta ve her hukuka ayk\u0131r\u0131l\u0131k iddias\u0131nda ba\u015fvurulacak genel bir denetim yolu de\u011fildir. \u0130kincisi, bu yol kurumsald\u0131r; \u00e7\u00fcnk\u00fc ba\u015fvuru yetkisi bireylere de\u011fil, Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131na verilmi\u015ftir. \u00dc\u00e7\u00fcnc\u00fcs\u00fc, bu yol i\u00e7tihat d\u00fczenleyici ve d\u00fczeltici bir i\u015fleve sahiptir; \u00e7\u00fcnk\u00fc yaln\u0131zca dosya \u00f6zelinde de\u011fil, Yarg\u0131tay uygulamas\u0131n\u0131n b\u00fct\u00fcn\u00fcnde hukuka uygunluk ve tutarl\u0131l\u0131k sa\u011flamay\u0131 ama\u00e7lar.<\/span><\/p>\n<p data-start=\"6954\" data-end=\"7748\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu noktada, kurumun tarihsel geli\u015fimine de k\u0131saca de\u011finmek gerekir. 1412 say\u0131l\u0131 Ceza Muhakemeleri Usul\u00fc Kanunu d\u00f6neminde benzer bir d\u00fczenleme mevcut olmakla birlikte, 5271 say\u0131l\u0131 CMK d\u00f6neminde kurum sistematik olarak ola\u011fan\u00fcst\u00fc kanun yollar\u0131 aras\u0131nda konumland\u0131r\u0131lm\u0131\u015f ve b\u00f6ylece onun istisnai niteli\u011fi daha belirgin hale getirilmi\u015ftir. Ayr\u0131ca 6352 say\u0131l\u0131 Kanun ile <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019e eklenen h\u00fck\u00fcmler, itiraz\u0131n \u00f6nce karar\u0131 veren dairece incelenmesini, dairenin itiraz\u0131 yerinde g\u00f6r\u00fcrse karar\u0131n\u0131 d\u00fczeltmesini, yerinde g\u00f6rmezse dosyay\u0131 Ceza Genel Kurulu\u2019na g\u00f6ndermesini \u00f6ng\u00f6rerek, kurumun usul\u00ee i\u015fleyi\u015fini daha a\u00e7\u0131k hale getirmi\u015ftir. Bu d\u00fczenleme, hem daireye kendi karar\u0131n\u0131 g\u00f6zden ge\u00e7irme imk\u00e2n\u0131 tan\u0131m\u0131\u015f, hem de Ceza Genel Kurulu\u2019na gidecek dosyalar\u0131n daha s\u00fcz\u00fclm\u00fc\u015f bir i\u00e7erikle ula\u015fmas\u0131n\u0131 sa\u011flam\u0131\u015ft\u0131r.<\/span><\/p>\n<p data-start=\"7750\" data-end=\"8308\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sonu\u00e7 olarak, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308; ceza muhakemesinde ola\u011fan denetim sona erdikten sonra devreye giren, her t\u00fcrl\u00fc hukuka ayk\u0131r\u0131l\u0131k i\u00e7in de\u011fil belirli a\u011f\u0131rl\u0131ktaki hukuka ayk\u0131r\u0131l\u0131klar bak\u0131m\u0131ndan i\u015fletilen, do\u011frudan taraflar\u0131n de\u011fil Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n harekete ge\u00e7irebildi\u011fi, ceza dairesi kararlar\u0131n\u0131 Ceza Genel Kurulu \u00f6n\u00fcne ta\u015f\u0131yabilen ve ayn\u0131 zamanda i\u00e7tihat birli\u011fi ile adli hata d\u00fczeltme i\u015flevi g\u00f6ren ola\u011fan\u00fcst\u00fc bir kanun yoludur. Bu niteli\u011fin do\u011fru anla\u015f\u0131lmas\u0131, kurumun hem ba\u015fvuru stratejisinin hem de akademik de\u011ferlendirmesinin temelini olu\u015fturur.<\/span><\/p>\n<h3 data-section-id=\"i339zk\" data-start=\"8310\" data-end=\"8403\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2. CMK m. 308\u2019in Amac\u0131: Sadece Bireysel Hatan\u0131n D\u00fczeltilmesi mi, Yoksa \u0130\u00e7tihat Birli\u011fi mi?<\/span><\/h3>\n<p data-start=\"8405\" data-end=\"9070\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n itiraz yetkisini do\u011fru de\u011ferlendirebilmek i\u00e7in, bu kurumun amac\u0131n\u0131 yaln\u0131zca \u201c<em>hatal\u0131 karar\u0131 d\u00fczeltme<\/em>\u201d i\u015fleviyle s\u0131n\u0131rlamamak gerekir. \u015e\u00fcphesiz bu yol, bireysel dosyada ortaya \u00e7\u0131kan ciddi hukuka ayk\u0131r\u0131l\u0131klar\u0131n giderilmesine hizmet eder. Ancak kurumun fonksiyonu bundan daha geni\u015ftir. Nitekim Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023 tarihli karar\u0131nda bu ola\u011fan\u00fcst\u00fc yolun yaln\u0131zca \u00f6zel daire kararlar\u0131ndaki hukuka ayk\u0131r\u0131l\u0131klar\u0131n giderilmesine de\u011fil, ayn\u0131 zamanda i\u00e7tihat birli\u011finin sa\u011flanmas\u0131na ve kamuoyunun tatminine de hizmet etti\u011fini a\u00e7\u0131k\u00e7a ifade etmi\u015ftir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu tespit son derece \u00f6nemlidir. \u00c7\u00fcnk\u00fc ceza muhakemesinde baz\u0131 hukuka ayk\u0131r\u0131l\u0131klar yaln\u0131zca somut dosyaya \u00f6zg\u00fc bir hata niteli\u011fi ta\u015f\u0131maz; ayn\u0131 zamanda Yarg\u0131tay uygulamas\u0131n\u0131n genel y\u00f6neliminde bir sapma, bir yorum farkl\u0131la\u015fmas\u0131 veya bir ilkesel sorun bulundu\u011funu da g\u00f6sterebilir. \u0130\u015fte Ba\u015fsavc\u0131l\u0131k itiraz\u0131, tam da b\u00f6yle durumlarda Ceza Genel Kurulu\u2019nu devreye sokarak yaln\u0131zca o dosyada de\u011fil, benzer dosyalar\u0131n tamam\u0131nda etkili olabilecek bir d\u00fczeltme fonksiyonu \u00fcstlenir.<\/span><\/p>\n<p data-start=\"9544\" data-end=\"9981\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu i\u015flevin en \u00f6nemli sonucu \u015fudur: CMK m. 308, sadece \u201c<em>yanl\u0131\u015f karar<\/em>\u201d\u0131 d\u00fczeltmeye de\u011fil, \u201c<em>yanl\u0131\u015f yorum \u00e7izgisi<\/em>\u201dni de d\u00fczeltmeye yarar. \u00d6zellikle ceza dairesi kararlar\u0131n\u0131n kendi i\u00e7inde veya di\u011fer dairelerin yakla\u015f\u0131m\u0131yla uyumsuz hale geldi\u011fi, yerle\u015fik ilkelerden a\u00e7\u0131klanmayan bir sapma g\u00f6sterdi\u011fi veya anayasal\/konvansiyonel standartlarla gerilim yaratt\u0131\u011f\u0131 durumlarda, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 sistem d\u00fczeyinde dengeleyici bir ara\u00e7 haline gelir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Burada kamuoyunun tatmini i\u015flevi de ayr\u0131ca vurgulanmal\u0131d\u0131r. Ceza adaleti sistemi yaln\u0131zca normatif do\u011frulukla de\u011fil, ayn\u0131 zamanda toplumsal g\u00fcvenle de ili\u015fkilidir. \u00c7ok ciddi hukuka ayk\u0131r\u0131l\u0131k i\u00e7eren, hakkaniyet duygusunu zedeleyen veya hukuk g\u00fcvenli\u011fi \u00fczerinde olumsuz etki yaratan baz\u0131 kararlar\u0131n, ola\u011fan temyiz s\u00fcreci sonunda d\u00fczeltilmeden kalmas\u0131, yarg\u0131ya duyulan g\u00fcveni sarsabilir. Bu nedenle Ba\u015fsavc\u0131l\u0131k itiraz\u0131, yaln\u0131zca teknik bir denetim de\u011fil, ayn\u0131 zamanda yarg\u0131sal me\u015fruiyetin korunmas\u0131na d\u00f6n\u00fck bir g\u00fcven mekanizmas\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"10514\" data-end=\"11004\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ancak bu durum, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in s\u0131n\u0131rs\u0131z bir adalet d\u00fczeltme yolu oldu\u011fu anlam\u0131na gelmez. Tam tersine, bu yolun i\u00e7tihat birli\u011fi ve kamuoyu tatmini i\u015flevi ancak onun ola\u011fan\u00fcst\u00fc niteli\u011fi korunarak anlam kazan\u0131r. E\u011fer bu yol her kararda ve her memnuniyetsizlik halinde i\u015fletilen bir ba\u015fvuruya d\u00f6n\u00fc\u015f\u00fcrse, ne ola\u011fan\u00fcst\u00fc niteli\u011fi kal\u0131r ne de Ceza Genel Kurulu\u2019nun i\u015flevi sa\u011fl\u0131kl\u0131 bi\u00e7imde s\u00fcrd\u00fcr\u00fclebilir. Dolay\u0131s\u0131yla ama\u00e7 geni\u015f olmakla birlikte, kullan\u0131m alan\u0131 istisnai ve dikkatli olmak zorundad\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in amac\u0131n\u0131 \u00fc\u00e7 katmanda a\u00e7\u0131klamak m\u00fcmk\u00fcnd\u00fcr. \u0130lk katman, bireysel adalet katman\u0131d\u0131r: somut dosyada ortaya \u00e7\u0131kan ciddi hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 gidermek. \u0130kinci katman, kurumsal tutarl\u0131l\u0131k katman\u0131d\u0131r: Yarg\u0131tay i\u00e7tihatlar\u0131 aras\u0131nda uyum sa\u011flamak, yorum farkl\u0131l\u0131klar\u0131n\u0131 gidermek. \u00dc\u00e7\u00fcnc\u00fc katman ise hukuk devleti ve g\u00fcven katman\u0131d\u0131r: a\u011f\u0131r adli hatalar\u0131n d\u00fczeltilmesi yoluyla yarg\u0131ya duyulan g\u00fcveni korumak.<\/span><\/p>\n<p data-start=\"11449\" data-end=\"11961\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu nedenle Ba\u015fsavc\u0131l\u0131k itiraz\u0131 haz\u0131rlarken veya bu kurumu akademik olarak incelerken, meseleye yaln\u0131zca \u201c<em>san\u0131k lehine mi, aleyhine mi sonu\u00e7 do\u011furur?<\/em>\u201d sorusuyla bakmak yeterli de\u011fildir. Ayn\u0131 zamanda \u015fu sorular da sorulmal\u0131d\u0131r: Bu karar, Yarg\u0131tay i\u00e7tihat \u00e7izgisinde sorun yarat\u0131yor mu? Ceza dairesinin yakla\u015f\u0131m\u0131 yerle\u015fik ilkelere ayk\u0131r\u0131 m\u0131? Karar\u0131n s\u00fcrd\u00fcr\u00fclmesi benzer dosyalarda sistematik bir yanl\u0131\u015f uygulamaya yol a\u00e7ar m\u0131? Ceza Genel Kurulu m\u00fcdahalesi yaln\u0131zca bu dosyay\u0131 de\u011fil, genel uygulamay\u0131 da d\u00fczeltir mi?\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00f6r\u00fcld\u00fc\u011f\u00fc gibi CMK m. 308\u2019in amac\u0131, klasik bir bireysel kanun yolu mant\u0131\u011f\u0131n\u0131n \u00f6tesindedir. Bu yol, bireysel uyu\u015fmazl\u0131k ile i\u00e7tihat hukuku aras\u0131nda k\u00f6pr\u00fc kuran; ciddi hukuka ayk\u0131r\u0131l\u0131klar\u0131n hem dosya baz\u0131nda hem sistem baz\u0131nda d\u00fczeltilmesini hedefleyen \u00f6zg\u00fcn bir denetim arac\u0131d\u0131r.<\/span><\/p>\n<h3 data-section-id=\"9z7d76\" data-start=\"12243\" data-end=\"12302\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. \u0130tiraz Yetkisinin Kullan\u0131lma \u015eartlar\u0131 ve \u00d6n Ko\u015fullar\u0131<\/span><\/h3>\n<p data-start=\"12304\" data-end=\"12623\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in en \u00e7ok g\u00f6zden ka\u00e7an y\u00f6nlerinden biri, bu ola\u011fan\u00fcst\u00fc kanun yolunun ancak belirli \u00f6n ko\u015fullar\u0131n varl\u0131\u011f\u0131 halinde i\u015fletilebilmesidir. Her ne kadar kanun metni ilk bak\u0131\u015fta basit g\u00f6r\u00fcnse de, uygulamada bu yola ba\u015fvurulabilmesi i\u00e7in gerekli \u015fartlar, i\u00e7tihatlar taraf\u0131ndan \u00f6nemli \u00f6l\u00e7\u00fcde a\u00e7\u0131kl\u0131\u011fa kavu\u015fturulmu\u015ftur.<\/span><\/p>\n<p data-start=\"12625\" data-end=\"13317\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130lk ve en temel \u00f6n ko\u015ful, ortada bir Yarg\u0131tay ceza dairesi karar\u0131 bulunmas\u0131d\u0131r. Ba\u015fsavc\u0131l\u0131k itiraz\u0131, yerel mahkeme kararlar\u0131na, b\u00f6lge adliye mahkemesi kararlar\u0131na veya hen\u00fcz Yarg\u0131tay denetiminden ge\u00e7memi\u015f i\u015flemlere kar\u015f\u0131 kullan\u0131lamaz. Bu yolun varl\u0131k nedeni, temyiz denetimi sonucunda verilmi\u015f Yarg\u0131tay ceza dairesi kararlar\u0131n\u0131n Ceza Genel Kurulu \u00f6n\u00fcnde yeniden de\u011ferlendirilmesine imk\u00e2n tan\u0131makt\u0131r. Nitekim Ceza Genel Kurulu, 01.03.2023 tarihli karar\u0131nda a\u00e7\u0131k bi\u00e7imde, CMK m. 308\u2019e ba\u015fvurulabilmesinin \u00f6n ko\u015fulunun \u201cY<em>arg\u0131tay ceza dairesince temyiz incelemesi yap\u0131larak bir karar verilmi\u015f olmas\u0131<\/em>\u201d oldu\u011funu vurgulam\u0131\u015ft\u0131r (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u015fart\u0131n do\u011fal sonucu olarak, hakk\u0131nda temyiz incelemesi yap\u0131larak Yarg\u0131tay ceza dairesi karar\u0131 bulunmayan ki\u015fi veya i\u015flemler bak\u0131m\u0131ndan Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yoluna gidilemez. Dolay\u0131s\u0131yla bu kurum, ceza muhakemesinin b\u00fct\u00fcn a\u015famalar\u0131na yay\u0131lm\u0131\u015f genel bir denetim yetkisi de\u011fil; belirli bir yarg\u0131sal a\u015famaya ba\u011flanm\u0131\u015f \u00f6zel bir ola\u011fan\u00fcst\u00fc denetim mekanizmas\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"13680\" data-end=\"14447\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130kinci \u00f6nemli \u00f6n ko\u015ful, itiraz\u0131n itiraza elveri\u015fli bir karara y\u00f6neltilmi\u015f olmas\u0131d\u0131r. Bu mesele, uygulamada son derece kritik olmakla birlikte \u00e7o\u011fu zaman yeterince dikkat edilmemektedir. Her Yarg\u0131tay ceza dairesi karar\u0131 CMK m. 308 kapsam\u0131nda itiraz edilebilir nitelikte de\u011fildir. Ceza Genel Kurulu\u2019nun \u00e7e\u015fitli kararlar\u0131nda a\u00e7\u0131kland\u0131\u011f\u0131 \u00fczere; ele\u015ftiri mahiyetindeki de\u011ferlendirmeler, kabule g\u00f6re bozma kararlar\u0131, sonuca etkili olmayan hukuka ayk\u0131r\u0131l\u0131klar, tutuklulu\u011fun devam\u0131na ili\u015fkin baz\u0131 kararlar ve belirli merci tayini kararlar\u0131 bu kapsamda itiraza elveri\u015fli g\u00f6r\u00fclmemi\u015ftir. Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131nda da bu s\u0131n\u0131rl\u0131 yakla\u015f\u0131m \u00f6nceki i\u00e7tihatlara at\u0131fla tekrar edilmi\u015ftir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).<\/span><\/p>\n<p data-start=\"14449\" data-end=\"15107\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00dc\u00e7\u00fcnc\u00fc \u00f6n ko\u015ful, ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n ciddi ve sonuca etkili olmas\u0131d\u0131r. Ola\u011fan\u00fcst\u00fc kanun yolu niteli\u011finin do\u011fal sonucu olarak CMK m. 308, k\u00fc\u00e7\u00fck, tali, sonuca etkisiz veya sadece teorik d\u00fczeyde kalan hukuk tart\u0131\u015fmalar\u0131 i\u00e7in \u00f6ng\u00f6r\u00fclmemi\u015ftir. Ceza Genel Kurulu\u2019nun vurgulad\u0131\u011f\u0131 \u00fczere, sonuca etkili olmayacak t\u00fcrden hukuka ayk\u0131r\u0131l\u0131klar\u0131n bu yola konu edilmesi, itiraz\u0131n ama\u00e7 ve kapsam\u0131yla ba\u011fda\u015fmaz (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). Bu nedenle Ba\u015fsavc\u0131l\u0131\u011fa sunulacak istemlerde, salt genel memnuniyetsizlik de\u011fil; karar\u0131n sonucunu de\u011fi\u015ftirebilecek a\u011f\u0131rl\u0131kta hukuka ayk\u0131r\u0131l\u0131klar a\u00e7\u0131k bi\u00e7imde ortaya konulmal\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"15109\" data-end=\"15805\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00f6rd\u00fcnc\u00fc husus, itiraz\u0131n do\u011fru karara y\u00f6neltilmesi zorunlulu\u011fudur. \u00d6zellikle 01.03.2023 tarihli Ceza Genel Kurulu karar\u0131 bu konuda \u00f6\u011fretici niteliktedir. O kararda, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n hangi karara y\u00f6neltilmesi gerekti\u011fi belirlenmeden esasa ge\u00e7ilemeyece\u011fi kabul edilmi\u015f; yanl\u0131\u015f karara y\u00f6neltilen itiraz\u0131n esas\u0131 incelenmemi\u015ftir. Daha da \u00f6nemlisi, usule ayk\u0131r\u0131 bi\u00e7imde olu\u015fturulmu\u015f sonraki kararlar \u201c<em>hukuki de\u011ferden yoksun<\/em>\u201d g\u00f6r\u00fclerek ortadan kald\u0131r\u0131lm\u0131\u015ft\u0131r (Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113). Bu tespit, Ba\u015fsavc\u0131l\u0131k itiraz\u0131nda \u201c<em>hangi karar hedef al\u0131nmal\u0131d\u0131r?<\/em>\u201d sorusunun, basit bir \u015fekil meselesi de\u011fil, kabul edilebilirli\u011fin omurgas\u0131 oldu\u011funu g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"15807\" data-end=\"16266\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Be\u015finci unsur, itiraz\u0131n Ba\u015fsavc\u0131 taraf\u0131ndan re\u2019sen veya istem \u00fczerine yap\u0131labilmesidir. Bu ifade, d\u0131\u015far\u0131dan gelen ba\u015fvurular\u0131n Ba\u015fsavc\u0131l\u0131\u011f\u0131 ba\u011flamad\u0131\u011f\u0131n\u0131, ancak Ba\u015fsavc\u0131l\u0131\u011f\u0131n harekete ge\u00e7mesini sa\u011flayabilecek bir istem niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131n\u0131 g\u00f6sterir. Dolay\u0131s\u0131yla san\u0131k, m\u00fcdafi veya kat\u0131lan do\u011frudan Ceza Genel Kurulu\u2019na ba\u015fvuramaz; onlar ancak Ba\u015fsavc\u0131l\u0131\u011fa dilek\u00e7e vererek itiraz yolunun kullan\u0131lmas\u0131n\u0131 talep edebilirler. Son karar yine Ba\u015fsavc\u0131l\u0131\u011fa aittir.<\/span><\/p>\n<p data-start=\"16268\" data-end=\"16790\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Alt\u0131nc\u0131 husus ise s\u00fcredir. <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019e g\u00f6re Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131, ilam\u0131n kendisine verildi\u011fi tarihten itibaren otuz g\u00fcn i\u00e7inde Ceza Genel Kurulu\u2019na itiraz edebilir; ancak san\u0131\u011f\u0131n lehine itirazda s\u00fcre aranmaz. Bu d\u00fczenleme, kurumun ola\u011fan\u00fcst\u00fc niteli\u011fini korurken, san\u0131k lehine adli hata d\u00fczeltme fonksiyonunu daha g\u00fc\u00e7l\u00fc hale getirmektedir. Uygulamada \u00f6zellikle lehe itiraz bak\u0131m\u0131ndan bu s\u00fcre s\u0131n\u0131rlamas\u0131n\u0131n bulunmamas\u0131, ciddi hukuka ayk\u0131r\u0131l\u0131klar\u0131n daha sonra da g\u00fcndeme getirilebilmesine olanak tan\u0131maktad\u0131r.<\/span><\/p>\n<p data-start=\"16792\" data-end=\"17406\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcm bu \u015fartlar birlikte de\u011ferlendirildi\u011finde ortaya \u00e7\u0131kan sonu\u00e7 \u015fudur: <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308, sadece \u201c<em>bir hata var<\/em>\u201d denilerek i\u015fletilebilecek bir yol de\u011fildir. Ortada Yarg\u0131tay ceza dairesince verilmi\u015f bir karar bulunmal\u0131; bu karar itiraza elveri\u015fli nitelikte olmal\u0131; ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131k ciddi ve sonuca etkili olmal\u0131; itiraz hukuken do\u011fru karara y\u00f6neltilmeli; s\u00fcre\u00e7 Ba\u015fsavc\u0131l\u0131k iradesiyle ba\u015flat\u0131lmal\u0131 ve s\u00fcre kurallar\u0131 da buna g\u00f6re g\u00f6zetilmelidir. Bu nedenle Ba\u015fsavc\u0131l\u0131k itiraz\u0131, teknik bilgi, i\u00e7tihat h\u00e2kimiyeti ve do\u011fru strateji gerektiren y\u00fcksek nitelikli bir ola\u011fan\u00fcst\u00fc kanun yolu olarak de\u011ferlendirilmelidir.<\/span><\/p>\n<h3 data-section-id=\"hqvaj0\" data-start=\"17408\" data-end=\"17521\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. Ba\u015fsavc\u0131l\u0131k \u0130tiraz\u0131n\u0131n S\u0131n\u0131rlar\u0131: Hangi T\u00fcr Kararlar ve Hangi T\u00fcr Hukuka Ayk\u0131r\u0131l\u0131klar Bu Yola Elveri\u015flidir?<\/span><\/h3>\n<p data-start=\"17523\" data-end=\"17914\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in en \u00f6nemli \u00f6zelliklerinden biri, her t\u00fcrl\u00fc karar ve her t\u00fcrl\u00fc hukuka ayk\u0131r\u0131l\u0131k i\u00e7in a\u00e7\u0131k bir yol olmamas\u0131d\u0131r. Aksine, bu kurumun ola\u011fan\u00fcst\u00fc niteli\u011fi, onun ayn\u0131 zamanda s\u0131n\u0131rland\u0131r\u0131lm\u0131\u015f bir denetim mekanizmas\u0131 olmas\u0131n\u0131 gerektirir. Bu nedenle, uygulamada ba\u015far\u0131l\u0131 bir Ba\u015fsavc\u0131l\u0131k itiraz\u0131 stratejisi kurabilmek i\u00e7in, \u00f6nce bu yolun neye elveri\u015fli olmad\u0131\u011f\u0131n\u0131 iyi anlamak gerekir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza Genel Kurulu\u2019nun yerle\u015fik yakla\u015f\u0131m\u0131, 01.03.2023 tarihli karar\u0131nda da tekrar edildi\u011fi \u00fczere, baz\u0131 kararlar\u0131n ve baz\u0131 hukuka ayk\u0131r\u0131l\u0131klar\u0131n CMK m. 308 kapsam\u0131nda de\u011ferlendirilemeyece\u011fi y\u00f6n\u00fcndedir. Kararda ge\u00e7mi\u015f Ceza Genel Kurulu kararlar\u0131na at\u0131fla; ele\u015ftiriye ili\u015fkin d\u00fc\u015f\u00fcncelerin reddi, kabule g\u00f6re bozma kararlar\u0131, sonuca etkili olmayan hukuka ayk\u0131r\u0131l\u0131klar, tutuklulu\u011fun devam\u0131na ili\u015fkin belirli kararlar ve baz\u0131 merci tayini kararlar\u0131 itiraza elveri\u015fli g\u00f6r\u00fclmemi\u015ftir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu s\u0131n\u0131rlamalar, kurumun kapsam\u0131n\u0131 belirleyen temel parametrelerdir. <\/span><\/p>\n<p data-start=\"17523\" data-end=\"17914\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bunlardan ilki olan ele\u015ftiri mahiyetindeki kararlar, esas itibar\u0131yla h\u00fckm\u00fcn sonucunu de\u011fi\u015ftirmeyen, yaln\u0131zca kararda ele\u015ftiri olarak yer alan, bozma veya d\u00fczeltme sonucuna ba\u011flanmam\u0131\u015f de\u011ferlendirmelerdir. B\u00f6yle durumlarda ortada Ceza Genel Kurulu m\u00fcdahalesini gerektirecek bir sonu\u00e7 hukuku problemi bulunmad\u0131\u011f\u0131 kabul edilmektedir.<\/span><\/p>\n<p data-start=\"18885\" data-end=\"19369\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130kinci \u00f6nemli s\u0131n\u0131rlama, kabule g\u00f6re bozma kararlar\u0131d\u0131r. Kabule g\u00f6re bozma, Yarg\u0131tay\u2019\u0131n as\u0131l kabul\u00fcne g\u00f6re zaten h\u00fckm\u00fc bozdu\u011fu; ek olarak da belli bir varsay\u0131m kabul edilse bile ba\u015fka bir hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n bulundu\u011funu belirtti\u011fi durumlard\u0131r. Bu t\u00fcr kararlar\u0131n, kendi ba\u015f\u0131na ba\u011f\u0131ms\u0131z bir itiraz konusu yap\u0131lmas\u0131 kabul edilmemektedir. \u00c7\u00fcnk\u00fc burada bozma sonucu zaten do\u011fmu\u015ftur; kabule g\u00f6re yap\u0131lan ek de\u011ferlendirme sonuca etki eden ba\u011f\u0131ms\u0131z bir nihai karar niteli\u011fi ta\u015f\u0131mamaktad\u0131r.<\/span><\/p>\n<p data-start=\"19371\" data-end=\"20120\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00dc\u00e7\u00fcnc\u00fc ve en kritik s\u0131n\u0131rlama ise sonuca etkili olmayan hukuka ayk\u0131r\u0131l\u0131klard\u0131r. Ceza Genel Kurulu\u2019nun a\u00e7\u0131k\u00e7a vurgulad\u0131\u011f\u0131 \u00fczere, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 ola\u011fan\u00fcst\u00fc bir kanun yolu oldu\u011fundan, h\u00fckm\u00fcn sonucunu etkilemeyecek t\u00fcrden ayk\u0131r\u0131l\u0131klar\u0131n bu yol arac\u0131l\u0131\u011f\u0131yla denetlenmesi kurumun ama\u00e7 ve yap\u0131s\u0131yla ba\u011fda\u015fmaz (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). Bu ilke, ba\u015fvuru stratejisi bak\u0131m\u0131ndan son derece \u00f6nemlidir. Zira bir\u00e7ok dosyada hukuken tart\u0131\u015f\u0131labilir \u00e7ok say\u0131da nokta bulunabilir; ancak bunlar\u0131n t\u00fcm\u00fc <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> 308\u2019e elveri\u015fli de\u011fildir. Bu yolda ba\u015far\u0131 ihtimali y\u00fcksek istemler, ancak karar\u0131n maddi sonucunu, hukuki niteli\u011fini, uygulanacak yapt\u0131r\u0131m\u0131 veya kanun yolu sistemati\u011fini etkileyen a\u011f\u0131r ayk\u0131r\u0131l\u0131klara dayanmal\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"20122\" data-end=\"20501\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00f6rd\u00fcnc\u00fc s\u0131n\u0131rlama, tutuklulu\u011fun devam\u0131na ili\u015fkin baz\u0131 kararlar bak\u0131m\u0131ndan g\u00f6r\u00fclmektedir. Yarg\u0131tay ceza dairelerinin verdi\u011fi her ara karar\u0131n veya koruma tedbirine ili\u015fkin her i\u015flemin <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019e elveri\u015fli olmad\u0131\u011f\u0131 kabul edilmektedir. Bu yakla\u015f\u0131m, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n esas itibar\u0131yla h\u00fckme veya h\u00fck\u00fcm niteli\u011findeki denetim kararlar\u0131na y\u00f6nelmesi gerekti\u011fini g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"20503\" data-end=\"20973\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Be\u015finci s\u0131n\u0131rlama, merci tayini ve g\u00f6rev sorunlar\u0131 gibi belirli usul kararlar\u0131yla ilgilidir. Ceza Genel Kurulu\u2019nun daha \u00f6nce verdi\u011fi kararlarda, Yarg\u0131tay\u2019\u0131n dahi inceleme konusu yapamayaca\u011f\u0131 veya kesin nitelik ta\u015f\u0131yan baz\u0131 g\u00f6rev-merci kararlar\u0131n\u0131n CMK m. 308 konusu yap\u0131lamayaca\u011f\u0131 ifade edilmi\u015ftir. Bu yakla\u015f\u0131m\u0131n temelinde, ola\u011fan\u00fcst\u00fc itiraz yolunun hukuki sistem i\u00e7inde her karar\u0131 ikinci kez tart\u0131\u015fmaya a\u00e7an genel bir yol haline getirilmemesi d\u00fc\u015f\u00fcncesi yatmaktad\u0131r.<\/span><\/p>\n<p data-start=\"20975\" data-end=\"21329\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ancak bu s\u0131n\u0131rlamalar, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in etkisiz bir yol oldu\u011fu anlam\u0131na gelmez. Tam tersine, bu s\u0131n\u0131rl\u0131 yap\u0131 onun as\u0131l g\u00fcc\u00fcn\u00fc olu\u015fturur. \u00c7\u00fcnk\u00fc Ceza Genel Kurulu\u2019nun m\u00fcdahalesi, ancak ciddi, sistematik, i\u00e7tihat d\u00fczeyinde \u00f6nem ta\u015f\u0131yan veya a\u00e7\u0131k adli hata niteli\u011findeki uyu\u015fmazl\u0131klarda devreye girdi\u011fi i\u00e7in, verilen kararlar daha y\u00fcksek normatif a\u011f\u0131rl\u0131k ta\u015f\u0131r.\u00a0<\/span><\/p>\n<p data-start=\"20975\" data-end=\"21329\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu noktada, hangi t\u00fcr hukuka ayk\u0131r\u0131l\u0131klar\u0131n Ba\u015fsavc\u0131l\u0131k itiraz\u0131na daha uygun oldu\u011fu da belirtilmelidir. Genel olarak \u015fu t\u00fcr problemler CMK m. 308 bak\u0131m\u0131ndan daha elveri\u015fli g\u00f6r\u00fcnmektedir:<\/span><\/p>\n<ul>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130lk olarak, su\u00e7 vasf\u0131n\u0131n a\u00e7\u0131k\u00e7a yanl\u0131\u015f belirlenmesi ve bunun h\u00fckm\u00fcn niteli\u011fini de\u011fi\u015ftirmesi.<\/span><\/li>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130kinci olarak, kanunun a\u00e7\u0131k h\u00fckm\u00fcne ayk\u0131r\u0131 yorum yap\u0131lmas\u0131.<\/span><\/li>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00dc\u00e7\u00fcnc\u00fc olarak, yerle\u015fik i\u00e7tihattan a\u00e7\u0131klamas\u0131z sapma bulunmas\u0131.<\/span><\/li>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00f6rd\u00fcnc\u00fc olarak, anayasal veya A\u0130HS temelli g\u00fcvencelerin a\u011f\u0131r bi\u00e7imde g\u00f6z ard\u0131 edilmesi.<\/span><\/li>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Be\u015finci olarak, kanun yolu sistemati\u011finin bozulmas\u0131, \u00f6rne\u011fin yanl\u0131\u015f kanun yoluna gidilmesi veya hukuki de\u011ferden yoksun karar silsilesi olu\u015fturulmas\u0131.<\/span><\/li>\n<li data-start=\"21519\" data-end=\"22092\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Alt\u0131nc\u0131 olarak, san\u0131k lehine veya aleyhine \u00f6nemli sonu\u00e7 do\u011furan a\u00e7\u0131k usul hatalar\u0131.<\/span><\/li>\n<\/ul>\n<p data-start=\"22094\" data-end=\"22494\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Dolay\u0131s\u0131yla <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308 bak\u0131m\u0131ndan esas mesele, hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n sadece varl\u0131\u011f\u0131 de\u011fil, onun yo\u011funlu\u011fu, sonuca etkisi ve sistematik \u00f6nemidir. Ba\u015fsavc\u0131l\u0131\u011fa sunulacak istemlerde de buna uygun bir se\u00e7icilik izlenmelidir. Her dosyada ileri s\u00fcr\u00fclebilecek bir\u00e7ok iddia bulunabilir; fakat bunlar\u0131n yaln\u0131zca k\u00fc\u00e7\u00fck bir k\u0131sm\u0131 Ba\u015fsavc\u0131l\u0131k itiraz\u0131 bak\u0131m\u0131ndan ger\u00e7ek anlamda stratejik de\u011fere sahiptir.<\/span><\/p>\n<h3 data-section-id=\"1ogqcy1\" data-start=\"22496\" data-end=\"22585\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5. \u0130tiraz\u0131n Hangi Karara Y\u00f6neltilece\u011fi Meselesi: Usul\u00ee Kabul Edilebilirli\u011fin Belkemi\u011fi<\/span><\/h3>\n<p data-start=\"22587\" data-end=\"23125\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CMK m. 308 bak\u0131m\u0131ndan en kritik sorunlardan biri, itiraz\u0131n hangi karara y\u00f6neltilece\u011finin do\u011fru belirlenmesidir. Uygulamada \u00e7o\u011fu zaman hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n varl\u0131\u011f\u0131na odaklan\u0131l\u0131r; oysa Ceza Genel Kurulu\u2019nun yakla\u015f\u0131m\u0131, esasa ge\u00e7meden \u00f6nce itiraz\u0131n hedefinin hukuken isabetli bi\u00e7imde belirlenmesini zorunlu g\u00f6rmektedir. Nitekim 01.03.2023 tarihli Ceza Genel Kurulu karar\u0131, bu konuyu ola\u011fan\u00fcst\u00fc itiraz\u0131n kabul edilebilirli\u011fi a\u00e7\u0131s\u0131ndan merkezi bir mesele haline getirmi\u015ftir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">S\u00f6z konusu kararda, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n; yarg\u0131laman\u0131n yenilenmesi sonras\u0131nda verilen ve daha sonra bozulan karara m\u0131, yoksa ilk h\u00fckm\u00fcn onanmas\u0131na ili\u015fkin \u00f6nceki Yarg\u0131tay karar\u0131na m\u0131 y\u00f6neltilmesi gerekti\u011fi tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. Ceza Genel Kurulu, \u00f6nce bu usul sorununu ele alm\u0131\u015f; su\u00e7 vasf\u0131, kamu davas\u0131n\u0131n usul\u00fcne uygun a\u00e7\u0131l\u0131p a\u00e7\u0131lmad\u0131\u011f\u0131 ve zamana\u015f\u0131m\u0131 gibi esasl\u0131 maddi sorunlara ise hi\u00e7 girmemi\u015ftir. Bu yakla\u015f\u0131m, CMK m. 308 incelemesinde \u201c<em>\u00f6nce do\u011fru hedef, sonra esas<\/em>\u201d ilkesinin ge\u00e7erli oldu\u011funu g\u00f6stermektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Karar\u0131n ortaya koydu\u011fu en \u00f6nemli ders \u015fudur: Bir hukuka ayk\u0131r\u0131l\u0131k ne kadar ciddi olursa olsun, e\u011fer itiraz yanl\u0131\u015f karara y\u00f6neltilmi\u015fse, Ceza Genel Kurulu esas incelemeye ge\u00e7meyebilir. Bu durum, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n yaln\u0131zca maddi gerek\u00e7e g\u00fcc\u00fcne de\u011fil, ayn\u0131 zamanda do\u011fru usul\u00ee kurgulanmas\u0131na ba\u011fl\u0131 oldu\u011funu g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"23963\" data-end=\"24414\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu mesele \u00f6zellikle, bir dosyada birden fazla ola\u011fan\u00fcst\u00fc s\u00fcre\u00e7 ya\u015fanm\u0131\u015fsa daha da karma\u015f\u0131k hale gelir. \u00d6rne\u011fin \u00f6nce bir Yarg\u0131tay ceza dairesi karar\u0131 verilmi\u015f, sonra yarg\u0131laman\u0131n yenilenmesi yoluna gidilmi\u015f, ard\u0131ndan bu yeni karar da Yarg\u0131tay taraf\u0131ndan incelenmi\u015f olabilir. B\u00f6yle bir durumda \u201c<em>itiraza esas al\u0131nacak karar hangisidir?<\/em>\u201d sorusu basit bir kronoloji meselesi de\u011fildir; hangi karar\u0131n hukuken ge\u00e7erli ve incelemeye elveri\u015fli oldu\u011fu sorusudur.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131nda vard\u0131\u011f\u0131 sonu\u00e7, bu bak\u0131mdan son derece \u00e7arp\u0131c\u0131d\u0131r: Yanl\u0131\u015f ola\u011fan\u00fcst\u00fc kanun yolu \u00fczerine in\u015fa edilen sonraki kararlar, baz\u0131 hallerde hukuki de\u011ferden yoksun kabul edilebilir. Uygulamada bu iki ola\u011fan\u00fcst\u00fc kanun yolu zaman zaman birbirine kar\u0131\u015ft\u0131r\u0131lmakta, kimi durumlarda birinde ileri s\u00fcr\u00fclmesi gereken iddialar di\u011ferine ta\u015f\u0131nmakta, bunun sonucunda da kanun yolu stratejisi yap\u0131sal olarak sakatlanmaktad\u0131r. Yarg\u0131tay Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131, tam da bu noktada son derece \u00f6nemli ilkeler ortaya koymu\u015ftur.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Her \u015feyden \u00f6nce belirtilmelidir ki, yarg\u0131laman\u0131n yenilenmesi ile Ba\u015fsavc\u0131l\u0131k itiraz\u0131 farkl\u0131 ama\u00e7lara, farkl\u0131 \u00f6n ko\u015fullara ve farkl\u0131 normatif yap\u0131lara sahiptir. Yarg\u0131laman\u0131n yenilenmesi, esas itibar\u0131yla kesinle\u015fmi\u015f h\u00fckme kar\u015f\u0131 ba\u015fvurulan, kanunda s\u0131n\u0131rl\u0131 \u015fekilde say\u0131lan nedenlerle i\u015fletilebilen ve kesin h\u00fckm\u00fcn istisnas\u0131n\u0131 olu\u015fturan bir ola\u011fan\u00fcst\u00fc kanun yoludur. Buna kar\u015f\u0131l\u0131k <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308, Yarg\u0131tay ceza dairesi karar\u0131na kar\u015f\u0131 Ba\u015fsavc\u0131l\u0131k taraf\u0131ndan i\u015fletilen, i\u00e7tihat d\u00fczeltici ve ciddi hukuka ayk\u0131r\u0131l\u0131klar\u0131 giderici nitelikte ayr\u0131 bir ola\u011fan\u00fcst\u00fc denetim yoludur. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza Genel Kurulu\u2019nun s\u00f6z konusu karar\u0131nda, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 315\/2\u2019de yer alan \u201c<em>Hatan\u0131n giderilebilmesini sa\u011flayacak ba\u015fka bir yol varsa, yarg\u0131laman\u0131n yenilenmesi yoluna gidilemez<\/em>\u201d h\u00fckm\u00fc \u00f6zel olarak vurgulanm\u0131\u015ft\u0131r (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). Bu h\u00fck\u00fcm, ola\u011fan\u00fcst\u00fc kanun yollar\u0131 aras\u0131nda bir i\u015flev ayr\u0131m\u0131 ve \u00f6ncelik ili\u015fkisi bulundu\u011funu g\u00f6stermektedir. Bir ba\u015fka ifadeyle, her hukuka ayk\u0131r\u0131l\u0131k i\u00e7in yarg\u0131laman\u0131n yenilenmesine gidilemez; e\u011fer o hata ba\u015fka bir kanun yolu ile giderilebilecek nitelikteyse, yenileme yolunun devreye sokulmas\u0131 kanun sistemati\u011fiyle ba\u011fda\u015fmaz.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130\u015fte Ceza Genel Kurulu, 01.03.2023 tarihli karar\u0131nda tam da bunu yapm\u0131\u015ft\u0131r. Somut olayda ileri s\u00fcr\u00fclen baz\u0131 sebeplerin, yarg\u0131laman\u0131n yenilenmesi kapsam\u0131nda de\u011fil, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 \u00e7er\u00e7evesinde de\u011ferlendirilmesi gerekti\u011fini kabul etmi\u015ftir. Yerel mahkemenin bu sebepleri yarg\u0131laman\u0131n yenilenmesi yolu i\u00e7inde ele almas\u0131 ise, kanun yolu sistemati\u011fine ayk\u0131r\u0131 bulunmu\u015ftur. Sonu\u00e7ta da, bu usule ayk\u0131r\u0131 yol \u00fczerinden olu\u015fturulan sonraki kararlar hukuki de\u011ferden yoksun say\u0131lm\u0131\u015ft\u0131r.<\/span><\/p>\n<p data-start=\"28902\" data-end=\"29373\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu tespit, son derece \u00f6nemlidir. \u00c7\u00fcnk\u00fc uygulamada \u00e7o\u011fu zaman, bir dosyada hukuka ayk\u0131r\u0131l\u0131k g\u00f6r\u00fcld\u00fc\u011f\u00fcnde, \u201c<em>hangi ola\u011fan\u00fcst\u00fc yol daha etkili olur?<\/em>\u201d sorusundan ziyade \u201c<em>hangi yol m\u00fcmk\u00fcn g\u00f6r\u00fcn\u00fcyorsa ona ba\u015fvural\u0131m<\/em>\u201d yakla\u015f\u0131m\u0131 \u00f6ne \u00e7\u0131kmaktad\u0131r. Oysa Ceza Genel Kurulu\u2019nun karar\u0131, yanl\u0131\u015f ola\u011fan\u00fcst\u00fc kanun yolunun se\u00e7ilmesinin yaln\u0131zca ba\u015fvurunun reddine de\u011fil, sonraki kararlar\u0131n hukuki de\u011ferden yoksun say\u0131lmas\u0131na kadar gidebilecek ciddi sonu\u00e7lar do\u011furabilece\u011fini g\u00f6stermektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu ba\u011flamda yarg\u0131laman\u0131n yenilenmesi ile CMK m. 308 aras\u0131ndaki fark\u0131 daha net ortaya koymak gerekir. Yarg\u0131laman\u0131n yenilenmesi, esasen yeni olay veya yeni delil gibi, \u00f6nceki h\u00fckm\u00fcn maddi temelini sarsan veya S\u00f6zle\u015fme ihlali gibi belirli ko\u015fullara ba\u011fl\u0131 sebepler i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Ba\u015fsavc\u0131l\u0131k itiraz\u0131 ise, Yarg\u0131tay ceza dairesinin karar\u0131nda ortaya \u00e7\u0131kan a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar\u0131n Ceza Genel Kurulu \u00f6n\u00fcne ta\u015f\u0131nmas\u0131na y\u00f6neliktir. Dolay\u0131s\u0131yla biri daha \u00e7ok kesin h\u00fckm\u00fcn maddi ve hukuki temelini sarsan yeni unsurlara odaklan\u0131rken, di\u011feri Yarg\u0131tay denetiminde do\u011fan veya g\u00f6r\u00fcn\u00fcr hale gelen ciddi hukuki hatalara odaklan\u0131r.<\/span><\/p>\n<p data-start=\"29996\" data-end=\"30757\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131 ayr\u0131ca yarg\u0131laman\u0131n yenilenmesindeki \u201c<em>yeni delil<\/em>\u201d ve \u201c<em>yeni olay<\/em>\u201d kavram\u0131n\u0131 da ayr\u0131nt\u0131l\u0131 bi\u00e7imde a\u00e7\u0131klamaktad\u0131r. Karara g\u00f6re, bir delilin yeni say\u0131lmas\u0131 i\u00e7in taraf bak\u0131m\u0131ndan de\u011fil, mahkeme bak\u0131m\u0131ndan yeni olmas\u0131 gerekir; yani h\u00fckm\u00fc veren mahkeme taraf\u0131ndan bilinmemi\u015f, de\u011ferlendirilmemi\u015f veya yarg\u0131lama konusu yap\u0131lmam\u0131\u015f olmas\u0131 gerekir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). Mahkemenin bildi\u011fi, temas etti\u011fi veya de\u011ferlendirdi\u011fi hususlar sonradan \u201c<em>yeni delil<\/em>\u201d olarak ileri s\u00fcr\u00fclemez. Bu a\u00e7\u0131klama, yarg\u0131laman\u0131n yenilenmesinin s\u0131n\u0131rlar\u0131n\u0131 g\u00f6sterdi\u011fi kadar, hangi durumlarda bu yola gidilemeyece\u011fini ve dolay\u0131s\u0131yla ba\u015fka ola\u011fan\u00fcst\u00fc yollar\u0131n g\u00fcndeme gelebilece\u011fini de g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"30759\" data-end=\"31280\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">B\u00fct\u00fcn bu \u00e7er\u00e7eve i\u00e7inde \u015fu genel sonuca ula\u015f\u0131labilir: Yarg\u0131laman\u0131n yenilenmesi ile Ba\u015fsavc\u0131l\u0131k itiraz\u0131 aras\u0131nda bir yar\u0131\u015fma de\u011fil, i\u015flevsel ayr\u0131m vard\u0131r. Her biri farkl\u0131 t\u00fcrde hukuka ayk\u0131r\u0131l\u0131klar i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Birinin alan\u0131na giren meseleyi di\u011ferinde \u00e7\u00f6zmeye \u00e7al\u0131\u015fmak, sadece usul\u00ee hata yaratmakla kalmaz; kanun yolu sistemati\u011fini de bozabilir. Bu nedenle uygulamac\u0131, \u00f6n\u00fcne gelen dosyada \u00f6nce hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n niteli\u011fini belirlemeli; daha sonra bunun hangi ola\u011fan\u00fcst\u00fc kanun yoluna uygun oldu\u011funu tespit etmelidir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu bak\u0131m\u0131ndan 01.03.2023 tarihli Ceza Genel Kurulu karar\u0131 \u015fu b\u00fcy\u00fck dersi vermektedir: Do\u011fru gerek\u00e7eyi bulmak kadar, do\u011fru ola\u011fan\u00fcst\u00fc kanun yolunu se\u00e7mek de zorunludur. Aksi halde, maddi a\u00e7\u0131dan g\u00fc\u00e7l\u00fc g\u00f6r\u00fcnen bir hukuki iddia, yanl\u0131\u015f kanun yolu nedeniyle usul\u00ee zeminde etkisiz hale gelebilir.<\/span><\/p>\n<h3 data-section-id=\"8p9qsv\" data-start=\"31578\" data-end=\"31653\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">7. \u201cHukuki De\u011ferden Yoksun Karar\u201d Kavram\u0131 ve CMK m. 308 Bak\u0131m\u0131ndan \u00d6nemi<\/span><\/h3>\n<p data-start=\"31655\" data-end=\"32109\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yarg\u0131tay Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131n\u0131n en dikkat \u00e7ekici y\u00f6nlerinden biri, baz\u0131 kararlar\u0131 \u201c<em>hukuki de\u011ferden yoksun<\/em>\u201d olarak nitelendirmesidir. Bu ifade, yaln\u0131zca hatal\u0131 bir karar de\u011ferlendirmesi de\u011fildir; \u00e7ok daha g\u00fc\u00e7l\u00fc, \u00e7ok daha yap\u0131sal bir sonu\u00e7 do\u011furmaktad\u0131r. \u00c7\u00fcnk\u00fc hukuki de\u011ferden yoksun say\u0131lan bir karar, yaln\u0131zca yanl\u0131\u015f bulunmu\u015f olmaz; ayn\u0131 zamanda onun \u00fczerine in\u015fa edilen sonraki yarg\u0131sal i\u015flemler de me\u015fruiyetini kaybedebilir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Somut olayda Ceza Genel Kurulu, yarg\u0131laman\u0131n yenilenmesi yoluna kanunun \u00f6ng\u00f6rmedi\u011fi \u015fekilde ba\u015fvuruldu\u011fu sonucuna ula\u015fm\u0131\u015f, bu yanl\u0131\u015f yol \u00fczerinden kurulan yerel mahkeme karar\u0131n\u0131 ve onu bozan Yarg\u0131tay dairesi karar\u0131n\u0131 da hukuki de\u011ferden yoksun kabul etmi\u015ftir. Sonu\u00e7 olarak bu kararlar ortadan kald\u0131r\u0131lm\u0131\u015ft\u0131r (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).<\/span><\/p>\n<p data-start=\"32488\" data-end=\"33026\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu yakla\u015f\u0131m, ceza muhakemesi hukukunda usul\u00fcn ne kadar kurucu oldu\u011funu g\u00f6stermektedir. Bazen uygulamada, \u201c<em>esas do\u011fruysa usul eksikli\u011fi tolere edilebilir<\/em>\u201d gibi \u00f6rt\u00fck bir e\u011filim g\u00f6r\u00fclebilir. Oysa Ceza Genel Kurulu\u2019nun bu karar\u0131, \u00f6zellikle ola\u011fan\u00fcst\u00fc kanun yollar\u0131 bak\u0131m\u0131ndan usul\u00fcn yaln\u0131zca \u015fekli de\u011fil, normatif varl\u0131k \u015fart\u0131 oldu\u011funu ortaya koymaktad\u0131r. E\u011fer yanl\u0131\u015f kanun yolu se\u00e7ilmi\u015fse ve bu se\u00e7im sonraki kararlar\u0131n temelini olu\u015fturmu\u015fsa, art\u0131k ortada yaln\u0131zca d\u00fczeltilmesi gereken bir hata de\u011fil, hukuki me\u015fruiyet sorunu bulunmaktad\u0131r.<\/span><\/p>\n<p data-start=\"33028\" data-end=\"33121\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cHukuki de\u011ferden yoksunluk\u201d kavram\u0131, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 bak\u0131m\u0131ndan birka\u00e7 a\u00e7\u0131dan \u00f6nem ta\u015f\u0131r. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Birincisi, bu kavram itiraz\u0131n hedef karar\u0131n\u0131 belirleme s\u00fcrecinde belirleyicidir. E\u011fer dosyada birden fazla Yarg\u0131tay veya mahkeme karar\u0131 varsa, bunlardan hangisinin ger\u00e7ekten hukuken ayakta oldu\u011fu, hangisinin ise yap\u0131sal nedenle ge\u00e7erli bir inceleme nesnesi say\u0131lamayaca\u011f\u0131 \u00f6nce saptanmal\u0131d\u0131r. Aksi halde itiraz, varl\u0131\u011f\u0131 hukuken tart\u0131\u015fmal\u0131 bir karara y\u00f6neltilmi\u015f olabilir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130kincisi, bu kavram CMK m. 308\u2019in yaln\u0131zca i\u00e7erik denetimi de\u011fil, ayn\u0131 zamanda kanun yolu sistemati\u011fi denetimi de yapt\u0131\u011f\u0131n\u0131 g\u00f6sterir. Ba\u015fka bir anlat\u0131mla, Ceza Genel Kurulu yaln\u0131zca \u201c<em>su\u00e7 vasf\u0131 do\u011fru mu?<\/em>\u201d, \u201c<em>zamana\u015f\u0131m\u0131 dolmu\u015f mu?<\/em>\u201d, \u201c<em>delil yeterli mi?<\/em>\u201d gibi klasik maddi sorunlara bakmaz; ayn\u0131 zamanda dosyan\u0131n hangi kanun yolu zemininde ilerledi\u011fini, bu zeminin hukuka uygun olup olmad\u0131\u011f\u0131n\u0131 da denetler.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00dc\u00e7\u00fcnc\u00fcs\u00fc, hukuki de\u011ferden yoksunluk tespiti, ola\u011fan\u00fcst\u00fc kanun yollar\u0131nda stratejik disiplin gerektirdi\u011fini ortaya koyar. Yanl\u0131\u015f kanun yoluna ba\u015fvurmak, s\u0131radan bir usul hatas\u0131 de\u011fildir; bazen b\u00fct\u00fcn sonraki s\u00fcreci sakatlayabilir. Bu nedenle bir hukuki meselenin hangi ara\u00e7la ileri s\u00fcr\u00fclece\u011fi, en az onun ne kadar g\u00fc\u00e7l\u00fc oldu\u011fu kadar \u00f6nemlidir.<\/span><\/p>\n<p data-start=\"34253\" data-end=\"34685\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kavram ayr\u0131ca, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in neden i\u00e7tihat birli\u011fi ve sistem d\u00fczeltme i\u015flevi ta\u015f\u0131d\u0131\u011f\u0131n\u0131 da a\u00e7\u0131klamaktad\u0131r. \u00c7\u00fcnk\u00fc bir karar silsilesinin hukuki de\u011ferden yoksun say\u0131lmas\u0131, yaln\u0131zca somut dosyada de\u011fil, benzer hatalar\u0131n gelecekte tekrar edilmesini \u00f6nleyici ilkesel bir m\u00fcdahale anlam\u0131na gelir. Ceza Genel Kurulu bu yolla, uygulamaya \u201c<em>yanl\u0131\u015f kanun yolu \u00fczerine kurulan bir s\u00fcreci sonradan me\u015fru kabul etmeyece\u011fim<\/em>\u201d mesaj\u0131 vermektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu ba\u011flamda, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 haz\u0131rlan\u0131rken \u015fu sorular mutlaka sorulmal\u0131d\u0131r: Dosyada sonraki kararlar hukuken sa\u011flam bir zemine mi dayan\u0131yor? Kanun yolu tercihi do\u011fru yap\u0131lm\u0131\u015f m\u0131? \u0130nceleme konusu yap\u0131lmak istenen karar\u0131n varl\u0131\u011f\u0131 normatif bak\u0131mdan sorunlu olabilir mi? Ba\u015fsavc\u0131l\u0131k \u0130tiraz\u0131nda Esas \u0130ncelemeden \u00d6nce Usul\u00ee Zemin Denetimi<\/span><\/h3>\n<p data-start=\"36034\" data-end=\"36563\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza muhakemesinde bir\u00e7ok uygulamac\u0131, hukuki tart\u0131\u015fmay\u0131 do\u011frudan maddi uyu\u015fmazl\u0131k ekseninde kurma e\u011filimindedir. Su\u00e7un unsurlar\u0131n\u0131n olu\u015fup olu\u015fmad\u0131\u011f\u0131, vasf\u0131n do\u011fru belirlenip belirlenmedi\u011fi, delillerin yeterlili\u011fi, zamana\u015f\u0131m\u0131, hukuka uygunluk nedenleri veya bireyselle\u015ftirme kurumlar\u0131n\u0131n uygulanmas\u0131 gibi meseleler \u00e7o\u011fu zaman dosyan\u0131n ana eksenini olu\u015fturur. Ancak <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308 bak\u0131m\u0131ndan Yarg\u0131tay Ceza Genel Kurulu\u2019nun yakla\u015f\u0131m\u0131, esasa ge\u00e7meden \u00f6nce mutlaka usul\u00ee zeminin sa\u011fl\u0131kl\u0131 olup olmad\u0131\u011f\u0131n\u0131 denetlemeyi gerektirmektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Nitekim 01.03.2023 tarihli Ceza Genel Kurulu karar\u0131, bu ilkenin en g\u00fc\u00e7l\u00fc \u00f6rneklerinden biridir. Kararda Ba\u015fsavc\u0131l\u0131k itiraz\u0131 esas itibar\u0131yla su\u00e7 vasf\u0131, kamu davas\u0131n\u0131n usul\u00fcne uygun a\u00e7\u0131l\u0131p a\u00e7\u0131lmad\u0131\u011f\u0131 ve zamana\u015f\u0131m\u0131 gibi son derece \u00f6nemli ceza hukuku meselelerine dayanmas\u0131na ra\u011fmen, Ceza Genel Kurulu \u00f6nce bunlara girmemi\u015f; itiraz\u0131n hangi karara y\u00f6neltildi\u011fini, incelemeye konu yap\u0131lan karar\u0131n hukuken ge\u00e7erli olup olmad\u0131\u011f\u0131n\u0131 ve kanun yolu s\u00fcrecinin do\u011fru kurulup kurulmad\u0131\u011f\u0131n\u0131 tart\u0131\u015fm\u0131\u015ft\u0131r. Sonu\u00e7ta da esasa ge\u00e7meden, itiraz\u0131n esas\u0131n\u0131n incelenmeksizin reddine karar verilmi\u015ftir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>).\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu yakla\u015f\u0131m, CMK m. 308\u2019in bir \u201c<em>ikinci temyiz<\/em>\u201d veya \u201c<em>s\u0131n\u0131rs\u0131z maddi denetim yolu<\/em>\u201d olmad\u0131\u011f\u0131n\u0131 a\u00e7\u0131k bi\u00e7imde g\u00f6stermektedir. Ceza Genel Kurulu bak\u0131m\u0131ndan ilk mesele, \u201c<em>karar do\u011fru mu?<\/em>\u201d de\u011fil; \u201c<em>bu karar bu kanun yolu i\u00e7inde incelenebilir nitelikte mi?<\/em>\u201d sorusudur. Lehe ve Aleyhe \u0130tiraz Ayr\u0131m\u0131, S\u00fcre Rejimi ve San\u0131k Lehine Koruma Mant\u0131\u011f\u0131<\/span><\/h3>\n<p data-start=\"39930\" data-end=\"40418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in dikkat \u00e7ekici y\u00f6nlerinden biri de, lehe ve aleyhe itiraz bak\u0131m\u0131ndan farkl\u0131 bir s\u00fcre rejimi \u00f6ng\u00f6rmesidir. Kanun h\u00fckm\u00fcne g\u00f6re Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131, Yarg\u0131tay ceza dairesinin karar\u0131na kar\u015f\u0131 ilam\u0131n kendisine verildi\u011fi tarihten itibaren otuz g\u00fcn i\u00e7inde Ceza Genel Kurulu\u2019na itiraz edebilir; ancak san\u0131\u011f\u0131n lehine itirazda s\u00fcre aranmaz. Bu ayr\u0131m, kurumun sadece teknik de\u011fil, ayn\u0131 zamanda ceza adaletinin koruyucu mant\u0131\u011f\u0131na uygun bi\u00e7imde kurguland\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.\u00a0<\/span><\/p>\n<p data-start=\"39930\" data-end=\"40418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00d6ncelikle belirtmek gerekir ki, aleyhe itiraz bak\u0131m\u0131ndan s\u00fcre s\u0131n\u0131rlamas\u0131n\u0131n bulunmas\u0131, hukuki g\u00fcvenlik ve kararlar\u0131n belirlili\u011fi ilkeleriyle ili\u015fkilidir. Ceza muhakemesi sisteminde san\u0131k aleyhine sonu\u00e7 do\u011furabilecek ola\u011fan\u00fcst\u00fc m\u00fcdahalelerin s\u00fcresiz hale getirilmesi, hukuk devleti ilkesiyle ba\u011fda\u015fmaz. Bu nedenle kanun koyucu, Ba\u015fsavc\u0131l\u0131\u011f\u0131n aleyhe itiraz\u0131n\u0131 belli bir s\u00fcreyle s\u0131n\u0131rlam\u0131\u015ft\u0131r. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Buna kar\u015f\u0131l\u0131k, san\u0131k lehine itirazda s\u00fcre aranmamas\u0131, ceza muhakemesinde bireyin korunmas\u0131 ve adli hatalar\u0131n sonradan da d\u00fczeltilebilmesi d\u00fc\u015f\u00fcncesine dayanmaktad\u0131r. Ceza yarg\u0131lamas\u0131, sadece h\u0131zl\u0131 ve kesin karar vermeyi de\u011fil, ayn\u0131 zamanda a\u011f\u0131r adli hatalar\u0131n m\u00fcmk\u00fcn oldu\u011funca giderilmesini hedefler. E\u011fer Yarg\u0131tay ceza dairesi karar\u0131nda san\u0131k aleyhine ciddi bir hukuka ayk\u0131r\u0131l\u0131k varsa, bunun yaln\u0131zca s\u00fcre ge\u00e7ti\u011fi i\u00e7in d\u00fczeltilmemesi, adalet duygusunu ciddi bi\u00e7imde zedelerdi. Kanun koyucu bu nedenle, lehe itiraz bak\u0131m\u0131ndan s\u00fcre s\u0131n\u0131r\u0131 \u00f6ng\u00f6rmeyerek Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131 san\u0131k lehine daha g\u00fc\u00e7l\u00fc bir g\u00fcvence arac\u0131 haline getirmi\u015ftir.<\/span><\/p>\n<p data-start=\"41448\" data-end=\"41956\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu d\u00fczenleme,<a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\"> CMK<\/a> m. 308\u2019in ola\u011fan\u00fcst\u00fc kanun yolu niteli\u011fiyle de uyumludur. \u00c7\u00fcnk\u00fc ola\u011fan\u00fcst\u00fc yollar \u00e7o\u011fu zaman kesinli\u011fin istisnas\u0131n\u0131 olu\u015fturur; ancak bu istisna \u00f6zellikle san\u0131k lehine sonu\u00e7 do\u011furacak a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar bak\u0131m\u0131ndan daha kolay kabul edilir. Ceza hukukunun genel yap\u0131s\u0131 da buna uygundur: ku\u015fku san\u0131k lehine yorumlan\u0131r, aleyhe k\u0131yas yasakt\u0131r, cezaland\u0131rmada birey lehine koruma mant\u0131\u011f\u0131 \u00f6ne \u00e7\u0131kar. Ba\u015fsavc\u0131l\u0131k itiraz\u0131nda lehe s\u00fcre rejimi de bu temel y\u00f6nelimin usul hukukundaki yans\u0131mas\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ne var ki san\u0131k lehine s\u00fcresiz itiraz imk\u00e2n\u0131, bu yolun s\u0131n\u0131rs\u0131z veya keyfi bi\u00e7imde kullan\u0131labilece\u011fi anlam\u0131na gelmez. Yukar\u0131da a\u00e7\u0131kland\u0131\u011f\u0131 gibi, yine de ortada Yarg\u0131tay ceza dairesi karar\u0131 bulunmal\u0131, itiraz itiraza elveri\u015fli karara y\u00f6neltilmeli ve ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131k ciddi ve sonuca etkili olmal\u0131d\u0131r. S\u00fcresizlik sadece zaman bak\u0131m\u0131ndand\u0131r; konu bak\u0131m\u0131ndan s\u0131n\u0131rlar aynen devam etmektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uygulamada lehe itiraz\u0131n bu \u00f6zelli\u011fi, \u00f6zellikle \u015fu t\u00fcr dosyalarda \u00f6nem kazanmaktad\u0131r:<\/span><\/p>\n<ul>\n<li data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sonradan belirgin hale gelen a\u00e7\u0131k kanun yanl\u0131\u015fl\u0131klar\u0131,<\/span><\/li>\n<li data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">lehe i\u00e7tihat de\u011fi\u015fiklikleri,<\/span><\/li>\n<li data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">anayasal g\u00fcvenceler a\u00e7\u0131s\u0131ndan a\u011f\u0131r sorun ta\u015f\u0131yan kararlar,<\/span><\/li>\n<li data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ceza miktar\u0131 veya su\u00e7 vasf\u0131 bak\u0131m\u0131ndan belirgin hatalar,<\/span><\/li>\n<li data-start=\"41958\" data-end=\"42358\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">kanun yolu sistemati\u011fini bozan yap\u0131sal problemler.<\/span><\/li>\n<\/ul>\n<p data-start=\"42708\" data-end=\"42851\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu dosyalarda, ola\u011fan s\u00fcreler ge\u00e7mi\u015f olsa bile Ba\u015fsavc\u0131l\u0131k \u00f6n\u00fcnde h\u00e2l\u00e2 bir imk\u00e2n\u0131n bulunmas\u0131, san\u0131k lehine ciddi bir koruma i\u015flevi g\u00f6rmektedir. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ayr\u0131ca lehe itiraz rejimi, Ba\u015fsavc\u0131l\u0131\u011f\u0131n sadece kurumsal denetim organ\u0131 de\u011fil, ayn\u0131 zamanda ceza adaletinde denge unsuru oldu\u011funu da g\u00f6stermektedir. Ba\u015fsavc\u0131l\u0131k klasik olarak iddia makam\u0131yla \u00f6zde\u015fle\u015ftirilse de, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308 \u00e7er\u00e7evesinde Ba\u015fsavc\u0131 sadece mahk\u00fbmiyetin korunmas\u0131 y\u00f6n\u00fcnde de\u011fil, gerekti\u011finde san\u0131k lehine a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar\u0131n d\u00fczeltilmesi y\u00f6n\u00fcnde de hareket edebilen bir hukuka uygunluk makam\u0131d\u0131r. Bu y\u00f6n\u00fcyle Ba\u015fsavc\u0131l\u0131k itiraz\u0131, cezaland\u0131rma fonksiyonunun \u00f6tesinde, adil yarg\u0131lanma ve hukuki do\u011fruluk fonksiyonuna da hizmet etmektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu nedenle akademik de\u011ferlendirmede \u015fu sonu\u00e7 \u00f6zellikle vurgulanmal\u0131d\u0131r: <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019de san\u0131k lehine s\u00fcresiz itiraz imk\u00e2n\u0131, yaln\u0131zca usul\u00ee bir ayr\u0131nt\u0131 de\u011fil; ceza muhakemesinin san\u0131\u011f\u0131 koruyucu y\u00f6n\u00fcn\u00fcn ola\u011fan\u00fcst\u00fc kanun yollar\u0131ndaki yans\u0131mas\u0131d\u0131r. Bu kurum, kesinlik ile adalet aras\u0131ndaki dengenin, \u00f6zellikle san\u0131k lehine bozulan durumlarda yeniden kurulmas\u0131n\u0131 m\u00fcmk\u00fcn k\u0131lmaktad\u0131r.<\/span><\/p>\n<h3 data-section-id=\"1o1vqw6\" data-start=\"43784\" data-end=\"43848\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">10. \u0130\u00e7tihat Birli\u011fi ve Ceza Genel Kurulu\u2019nun D\u00fczenleyici Rol\u00fc<\/span><\/h3>\n<p data-start=\"43850\" data-end=\"44364\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ba\u015fsavc\u0131l\u0131k itiraz\u0131 kurumunun en \u00f6nemli boyutlar\u0131ndan biri, Ceza Genel Kurulu\u2019nun i\u00e7tihat birli\u011fini sa\u011flamadaki rol\u00fcyle ba\u011flant\u0131l\u0131d\u0131r. Yarg\u0131tay ceza daireleri \u00e7ok say\u0131da dosya hakk\u0131nda karar vermekte; bu s\u00fcre\u00e7te bazen yorum farkl\u0131l\u0131klar\u0131, bazen istikrarl\u0131 g\u00f6r\u00fcnen i\u00e7tihattan sapmalar, bazen de anayasal ve uluslararas\u0131 standartlarla gerilim yaratan sonu\u00e7lar ortaya \u00e7\u0131kabilmektedir. Ceza Genel Kurulu ise bu da\u011f\u0131n\u0131k alan i\u00e7inde dengeleyici, y\u00f6nlendirici ve gerekti\u011finde d\u00fczeltici bir \u00fcst i\u00e7tihat i\u015flevi g\u00f6rmektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yarg\u0131tay Ceza Genel Kurulu\u2019nun 01.03.2023 tarihli karar\u0131nda a\u00e7\u0131k\u00e7a belirtildi\u011fi \u00fczere, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yaln\u0131zca somut dosyadaki hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 gidermeye de\u011fil, i\u00e7tihat birli\u011fini sa\u011flamaya da y\u00f6neliktir (<em>Yarg\u0131tay Ceza Genel Kurulu, 01.03.2023, E. 2023\/5-35, K. 2023\/113<\/em>). Bu tespit, Ceza Genel Kurulu kararlar\u0131n\u0131n neden yaln\u0131zca bireysel uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm\u00fc olarak de\u011fil, ayn\u0131 zamanda yarg\u0131 prati\u011fine y\u00f6n veren normatif kararlar olarak okunmas\u0131 gerekti\u011fini g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"44848\" data-end=\"45437\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130\u00e7tihat birli\u011fi i\u015flevi birka\u00e7 \u015fekilde ortaya \u00e7\u0131kar. Birincisi, daire kararlar\u0131 aras\u0131nda a\u00e7\u0131k veya \u00f6rt\u00fck \u00e7eli\u015fki bulundu\u011funda Ceza Genel Kurulu, ayn\u0131 konudaki yakla\u015f\u0131m\u0131 netle\u015ftirerek uygulamaya y\u00f6n verir. \u0130kincisi, daire karar\u0131nda yerle\u015fik bir ilkeye ayk\u0131r\u0131 veya onunla gerilimli bir yorum ortaya \u00e7\u0131kt\u0131\u011f\u0131nda, Ceza Genel Kurulu bu sapmay\u0131 d\u00fczelterek standard\u0131 yeniden kurar. \u00dc\u00e7\u00fcnc\u00fcs\u00fc, baz\u0131 meselelerde a\u00e7\u0131k bir kanun h\u00fckm\u00fc bulunsa bile uygulamada farkl\u0131 y\u00f6nlerde yorumlar geli\u015febilir; Ceza Genel Kurulu bu noktada ba\u011flay\u0131c\u0131 olmasa bile son derece g\u00fc\u00e7l\u00fc y\u00f6nlendirici bir i\u00e7tihat i\u015flevi g\u00f6r\u00fcr.<\/span><\/p>\n<p data-start=\"45439\" data-end=\"45832\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ba\u015fsavc\u0131l\u0131k itiraz\u0131 tam da bu nedenle, yaln\u0131zca bireysel bir taraf menfaatine indirgenmemelidir. Bazen bir dosyada ileri s\u00fcr\u00fclen hukuka ayk\u0131r\u0131l\u0131k, g\u00f6r\u00fcn\u00fc\u015fte tek bir ki\u015fiyle ilgili olsa da, esasen y\u00fczlerce benzer dosyaya etki edebilecek ilkesel bir sorunun yans\u0131mas\u0131 olabilir. Ba\u015fsavc\u0131l\u0131k b\u00f6yle durumlarda Ceza Genel Kurulu\u2019nu devreye sokarak, sistem \u00e7ap\u0131nda a\u00e7\u0131kl\u0131k ve tutarl\u0131l\u0131k sa\u011flayabilir. U<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ygulamac\u0131lar \u00e7o\u011fu zaman Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131 sadece \u201c<em>ola\u011fan\u00fcst\u00fc denetim<\/em>\u201d olarak g\u00f6rmekte, onun i\u00e7tihat \u00fcretici niteli\u011fini yeterince vurgulamamaktad\u0131r. Oysa Ceza Genel Kurulu kararlar\u0131n\u0131n bir\u00e7o\u011fu, sonraki uygulama bak\u0131m\u0131ndan referans noktas\u0131 haline gelmektedir. 01.03.2023 tarihli karar\u0131n da tam olarak b\u00f6yle bir i\u015flev g\u00f6rd\u00fc\u011f\u00fc s\u00f6ylenebilir. Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yoluyla Ceza Genel Kurulu\u2019nun devreye girmesi, bu da\u011f\u0131n\u0131kl\u0131\u011f\u0131 azalt\u0131r ve uygulamaya ortak bir referans noktas\u0131 sunar. Bu y\u00f6n\u00fcyle kurum, yaln\u0131zca d\u00fczeltici de\u011fil; \u00f6nleyici i\u015flev de g\u00f6r\u00fcr. \u00c7\u00fcnk\u00fc verilen Genel Kurul kararlar\u0131, benzer hatalar\u0131n gelecekte tekrarlanmas\u0131n\u0131 azalt\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ayr\u0131ca Ceza Genel Kurulu\u2019nun d\u00fczenleyici rol\u00fc, anayasal ve insan haklar\u0131 standartlar\u0131n\u0131n yarg\u0131sal yoruma yedirilmesi bak\u0131m\u0131ndan da \u00f6nemlidir. Ceza dairelerinin baz\u0131 kararlar\u0131nda ifade \u00f6zg\u00fcrl\u00fc\u011f\u00fc, savunma hakk\u0131, gerek\u00e7eli karar hakk\u0131, masumiyet karinesi veya \u00f6l\u00e7\u00fcl\u00fcl\u00fck gibi anayasal g\u00fcvenceler yeterince g\u00f6r\u00fcn\u00fcr olmayabilir. Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yoluyla Ceza Genel Kurulu \u00f6n\u00fcne ta\u015f\u0131nan dosyalarda bu ilkeler daha g\u00fc\u00e7l\u00fc bi\u00e7imde tart\u0131\u015f\u0131labilir ve sonras\u0131nda uygulamaya yay\u0131labilir.<\/span><\/p>\n<p data-start=\"47861\" data-end=\"48148\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sonu\u00e7 olarak Ba\u015fsavc\u0131l\u0131k itiraz\u0131, Ceza Genel Kurulu\u2019nun i\u00e7tihat d\u00fczenleyici rol\u00fcn\u00fc hayata ge\u00e7iren en \u00f6nemli ara\u00e7lardan biridir. Bu kurumun de\u011feri, yaln\u0131zca bir mahk\u00fbmiyetin d\u00fczeltilmesinde de\u011fil; yarg\u0131 prati\u011finin b\u00fct\u00fcn\u00fcnde hukuka uygunluk, tutarl\u0131l\u0131k ve \u00f6ng\u00f6r\u00fclebilirlik sa\u011flamas\u0131ndad\u0131r.<\/span><\/p>\n<h3 data-section-id=\"13w74tg\" data-start=\"48150\" data-end=\"48248\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">11. Uygulamada en s\u0131k yap\u0131lan hata, bu yolun \u201c<em>bir kez daha ayn\u0131 arg\u00fcmanlar\u0131 sunma<\/em>\u201d imk\u00e2n\u0131 olarak g\u00f6r\u00fclmesidir. Oysa Ba\u015fsavc\u0131l\u0131k itiraz\u0131, tekrar de\u011fil se\u00e7icilik; yayg\u0131nl\u0131k de\u011fil yo\u011funluk; genel itiraz de\u011fil nokta at\u0131\u015f\u0131 hukuka ayk\u0131r\u0131l\u0131k mant\u0131\u011f\u0131yla yaz\u0131lmal\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"48821\" data-end=\"49315\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130lk stratejik ilke \u015fudur: Dilek\u00e7e, m\u00fcmk\u00fcn olan her \u015feyi de\u011fil, sonuca etkili en g\u00fc\u00e7l\u00fc birka\u00e7 hukuka ayk\u0131r\u0131l\u0131\u011f\u0131 merkezine almal\u0131d\u0131r. Ceza Genel Kurulu\u2019nun yakla\u015f\u0131m\u0131 da bunu desteklemektedir. Ba\u015fsavc\u0131l\u0131k itiraz\u0131, sonuca etkili olmayan tali hatalar i\u00e7in \u00f6ng\u00f6r\u00fclm\u00fc\u015f bir yol de\u011fildir. Bu nedenle dilek\u00e7ede onlarca ba\u015fl\u0131k s\u0131ralamak yerine, karar\u0131n sonucunu de\u011fi\u015ftirebilecek, i\u00e7tihat d\u00fczeyinde \u00f6nem ta\u015f\u0131yan, a\u00e7\u0131k ve derin hukuka ayk\u0131r\u0131l\u0131klar belirlenmeli ve bunlar sistematik bi\u00e7imde i\u015flenmelidir.<\/span><\/p>\n<p data-start=\"49317\" data-end=\"49823\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130kinci stratejik ilke, dilek\u00e7enin ba\u015f\u0131nda mutlaka usul\u00ee kabul edilebilirlik zemininin kurulmas\u0131d\u0131r. Yukar\u0131da a\u00e7\u0131kland\u0131\u011f\u0131 gibi, Ceza Genel Kurulu \u00e7o\u011fu durumda esasa ge\u00e7meden \u00f6nce \u015fu sorulara bakmaktad\u0131r: Ortada itiraza elveri\u015fli bir Yarg\u0131tay ceza dairesi karar\u0131 var m\u0131? \u0130tiraz do\u011fru karara m\u0131 y\u00f6neltilmi\u015f? \u0130leri s\u00fcr\u00fclen ayk\u0131r\u0131l\u0131k ciddi ve sonuca etkili mi? Bu nedenle iyi bir dilek\u00e7e, do\u011frudan esas tart\u0131\u015fmas\u0131na ba\u015flamamal\u0131; \u00f6nce CMK m. 308 bak\u0131m\u0131ndan neden inceleme yap\u0131lmas\u0131 gerekti\u011fini a\u00e7\u0131klamal\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"49825\" data-end=\"50271\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00dc\u00e7\u00fcnc\u00fc stratejik ilke, dosyan\u0131n kanun yolu kronolojisinin net bi\u00e7imde ortaya konulmas\u0131d\u0131r. \u00d6zellikle dosyada yarg\u0131laman\u0131n yenilenmesi, kanun yarar\u0131na bozma, birden fazla Yarg\u0131tay karar\u0131 veya ba\u015fka ola\u011fan\u00fcst\u00fc s\u00fcre\u00e7ler bulunuyorsa, itiraz\u0131n y\u00f6neltildi\u011fi karar\u0131n neden do\u011fru hedef oldu\u011fu a\u00e7\u0131k bi\u00e7imde g\u00f6sterilmelidir. 01.03.2023 tarihli Ceza Genel Kurulu karar\u0131, bu noktan\u0131n ihmal edilmesinin ne kadar a\u011f\u0131r sonu\u00e7 do\u011furabilece\u011fini g\u00f6stermektedir.<\/span><\/p>\n<p data-start=\"50273\" data-end=\"50830\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00f6rd\u00fcnc\u00fc stratejik ilke, dilek\u00e7enin yaln\u0131zca bireysel ma\u011fduriyet diliyle de\u011fil, i\u00e7tihat ve sistem diliyle de kurulmas\u0131d\u0131r. Ba\u015fsavc\u0131l\u0131k itiraz\u0131, kurumsal nitelikli bir denetim yoludur. Bu nedenle \u201c<em>m\u00fcvekkilin ma\u011fduriyeti<\/em>\u201d kadar, \u201c<em>karar\u0131n Yarg\u0131tay i\u00e7tihat \u00e7izgisi bak\u0131m\u0131ndan ta\u015f\u0131d\u0131\u011f\u0131 sorun<\/em>\u201d da vurgulanmal\u0131d\u0131r. Ba\u015fsavc\u0131l\u0131\u011f\u0131 harekete ge\u00e7irmede \u00e7o\u011fu zaman bu ikinci boyut daha etkili olabilir. Karar\u0131n yerle\u015fik ilkelere ayk\u0131r\u0131l\u0131\u011f\u0131, benzer dosyalarda tekrar edebilecek yanl\u0131\u015f uygulama riski, anayasal standartlarla \u00e7at\u0131\u015fmas\u0131 gibi hususlar bu y\u00fczden \u00f6nemlidir.<\/span><\/p>\n<p data-start=\"50832\" data-end=\"51475\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Be\u015finci stratejik ilke, dilek\u00e7ede karar referanslar\u0131n\u0131n ve ilke c\u00fcmlelerinin g\u00fc\u00e7l\u00fc kullan\u0131lmas\u0131d\u0131r. Baz\u0131 dilek\u00e7eler sadece hukuka ayk\u0131r\u0131l\u0131klar\u0131 saymakta, fakat itiraz\u0131n somut sonucunu yeterince form\u00fcle etmemektedir. Oysa Ba\u015fsavc\u0131l\u0131k istemi ve sonras\u0131nda olas\u0131 Ceza Genel Kurulu incelemesi bak\u0131m\u0131ndan, talep a\u00e7\u0131k olmal\u0131d\u0131r: karar\u0131n kald\u0131r\u0131lmas\u0131 m\u0131, bozma m\u0131, belirli hukuki nitelendirmenin d\u00fczeltilmesi mi, kanun yolu sistemati\u011fi bak\u0131m\u0131ndan \u00f6n sorunun \u00e7\u00f6z\u00fclmesi mi istenmektedir? Bu a\u00e7\u0131kl\u0131k, dosyan\u0131n daha rahat kavranmas\u0131n\u0131 sa\u011flar.<\/span><\/p>\n<p data-start=\"52018\" data-end=\"52418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yedinci stratejik ilke, Ba\u015fsavc\u0131l\u0131k itiraz\u0131n\u0131n her zaman \u201c<em>\u00e7ok say\u0131da arg\u00fcman<\/em>\u201dla de\u011fil, bazen tek ama y\u0131k\u0131c\u0131 bir hukuk\u00ee problemle daha etkili olabilece\u011finin bilinmesidir. \u00d6zellikle usul\u00ee zemin hatalar\u0131, itiraz\u0131n hedefinin yanl\u0131\u015f belirlenmesi, a\u00e7\u0131k kanun h\u00fckm\u00fcne ayk\u0131r\u0131l\u0131k, a\u011f\u0131r anayasal sorunlar veya belirgin i\u00e7tihat sapmalar\u0131 gibi meseleler, uzun fakat da\u011f\u0131n\u0131k dilek\u00e7elerden \u00e7ok daha g\u00fc\u00e7l\u00fc olabilir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu nedenle iyi bir Ba\u015fsavc\u0131l\u0131k itiraz\u0131 dilek\u00e7esi \u015fu yap\u0131da kurulmal\u0131d\u0131r:<\/span><\/p>\n<ul>\n<li data-start=\"52018\" data-end=\"52418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00d6nce CMK m. 308 bak\u0131m\u0131ndan usul\u00ee uygunluk ve inceleme kabiliyeti g\u00f6sterilir.<\/span><\/li>\n<li data-start=\"52018\" data-end=\"52418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sonra karar\u0131n neden ciddi ve sonuca etkili hukuka ayk\u0131r\u0131l\u0131k ta\u015f\u0131d\u0131\u011f\u0131 a\u00e7\u0131klan\u0131r.<\/span><\/li>\n<li data-start=\"52018\" data-end=\"52418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ard\u0131ndan bu hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n sadece dosya \u00f6zelinde de\u011fil, i\u00e7tihat ve uygulama bak\u0131m\u0131ndan da neden \u00f6nemli oldu\u011fu anlat\u0131l\u0131r.<\/span><\/li>\n<li data-start=\"52018\" data-end=\"52418\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Son olarak da a\u00e7\u0131k, teknik ve net bir talep form\u00fcle edilir.<\/span><\/li>\n<\/ul>\n<p data-start=\"52844\" data-end=\"53042\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu strateji izlendi\u011finde, Ba\u015fsavc\u0131l\u0131k itiraz\u0131 yaln\u0131zca bir \u201c<em>son \u015fans dilek\u00e7esi<\/em>\u201d olmaktan \u00e7\u0131kar; hukuken hedefi do\u011fru belirlenmi\u015f, sistemli ve etkili bir ola\u011fan\u00fcst\u00fc kanun yolu ba\u015fvurusu haline gelir.<\/span><\/p>\n<h3 data-section-id=\"l6kl5\" data-start=\"53044\" data-end=\"53127\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">12. De\u011ferlendirme: CMK m. 308\u2019in T\u00fcrk Ceza Muhakemesi Sistemindeki Ger\u00e7ek \u0130\u015flevi<\/span><\/h3>\n<p data-start=\"53129\" data-end=\"53693\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">B\u00fct\u00fcn bu a\u00e7\u0131klamalar birlikte de\u011ferlendirildi\u011finde, Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n itiraz yetkisinin T\u00fcrk ceza muhakemesi sisteminde \u00e7ok \u00f6zel bir yere sahip oldu\u011fu g\u00f6r\u00fclmektedir. Bu kurum, ne klasik anlamda bir taraf ba\u015fvurusu, ne yeni bir derece denetimi, ne de sadece teorik bir ola\u011fan\u00fcst\u00fc yol olarak okunabilir. Ger\u00e7ekte <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308, ceza muhakemesi sisteminde ola\u011fan denetim sonras\u0131nda ortaya \u00e7\u0131kabilecek a\u011f\u0131r hukuka ayk\u0131r\u0131l\u0131klar\u0131n, i\u00e7tihat d\u00fczeyinde etkili bir mercide yeniden de\u011ferlendirilmesini sa\u011flayan kurumsal bir emniyet supab\u0131 i\u015flevi g\u00f6rmektedir.<\/span><\/p>\n<p data-start=\"53695\" data-end=\"54210\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kurumun en \u00f6nemli y\u00f6nlerinden biri, ceza dairesi kararlar\u0131n\u0131 tamamen dokunulmaz ve tart\u0131\u015f\u0131lmaz g\u00f6rmeyen bir denge mekanizmas\u0131 yaratmas\u0131d\u0131r. Ba\u015far\u0131 Hik\u00e2yesi: K.Y.B. \u00d6rne\u011fi ve CMK m. 308\u2019in Somut Etkisi<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CMK m. 308 kapsam\u0131nda Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131s\u0131n\u0131n itiraz yetkisinin yaln\u0131zca teorik veya sistematik bir hukuk kurumu olmad\u0131\u011f\u0131, baz\u0131 dosyalarda bireyin mesleki ve ki\u015fisel stat\u00fcs\u00fcn\u00fc do\u011frudan etkileyen \u00e7ok somut sonu\u00e7lar do\u011furabildi\u011fi g\u00f6r\u00fclmektedir. Bu hususu g\u00f6stermek bak\u0131m\u0131ndan, isimler anonimle\u015ftirilerek bir uygulama \u00f6rne\u011fine yer verilmesi yararl\u0131 olacakt\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kapsamda, K.Y.B. hakk\u0131nda 765 say\u0131l\u0131 T\u00fcrk Ceza Kanunu d\u00f6nemine ili\u015fkin \u201c<em>hizmet nedeniyle emniyeti suiistimal etmek<\/em>\u201d isnad\u0131yla y\u00fcr\u00fct\u00fclen ceza yarg\u0131lamas\u0131nda, Elmal\u0131 A\u011f\u0131r Ceza Mahkemesince mahk\u00fbmiyet h\u00fckm\u00fc kurulmu\u015f; daha sonra Yarg\u0131tay 15. Ceza Dairesi taraf\u0131ndan h\u00fck\u00fcm d\u00fczeltilerek onanm\u0131\u015ft\u0131r. H\u00fck\u00fcm kesinle\u015ftikten sonra taraf\u0131m\u0131zdan dosya \u00fczerinde haz\u0131rlanan bilimsel m\u00fctalaada, somut olay bak\u0131m\u0131ndan 5237 say\u0131l\u0131 TCK\u2019daki daha uzun zamana\u015f\u0131m\u0131 rejiminin de\u011fil, san\u0131k lehine olan 765 say\u0131l\u0131 TCK h\u00fck\u00fcmlerinin uygulanmas\u0131 gerekti\u011fi; buna g\u00f6re su\u00e7un 5 y\u0131ll\u0131k asli ve 7 y\u0131l 6 ayl\u0131k uzam\u0131\u015f dava zamana\u015f\u0131m\u0131 s\u00fcresine tabi oldu\u011fu; su\u00e7 tarihi 18.04.2005 esas al\u0131nd\u0131\u011f\u0131nda uzam\u0131\u015f dava zamana\u015f\u0131m\u0131n\u0131n 18.10.2012 tarihinde doldu\u011fu; buna ra\u011fmen Yarg\u0131tay karar\u0131n\u0131n 03.12.2012 tarihinde verildi\u011fi ve bu sebeple kamu davas\u0131n\u0131n d\u00fc\u015fmesi gerekirken mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn ayakta b\u0131rak\u0131ld\u0131\u011f\u0131 ortaya konulmu\u015ftur. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">S\u00f6z konusu bilimsel m\u00fctalaada ayr\u0131ca, zamana\u015f\u0131m\u0131n\u0131n kamu d\u00fczenine ili\u015fkin oldu\u011fu, re\u2019sen uygulanmas\u0131 gerekti\u011fi, san\u0131\u011f\u0131n bundan vazge\u00e7emeyece\u011fi ve zamana\u015f\u0131m\u0131 ger\u00e7ekle\u015fti\u011fi anda art\u0131k uyu\u015fmazl\u0131\u011f\u0131n esas\u0131na girilerek mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn korunamayaca\u011f\u0131 \u00f6zellikle vurgulanm\u0131\u015ft\u0131r. M\u00fctalaan\u0131n temel tezi, yarg\u0131lama s\u00fcrerken y\u00fcr\u00fcrl\u00fc\u011fe giren yeni ceza kanunundaki daha uzun zamana\u015f\u0131m\u0131 s\u00fcrelerinin de\u011fil, san\u0131k lehine olan \u00f6nceki kanundaki zamana\u015f\u0131m\u0131 rejiminin uygulanmas\u0131 gerekti\u011fi; bu sebeple de mahk\u00fbmiyetin de\u011fil, davan\u0131n d\u00fc\u015fmesinin hukuken zorunlu oldu\u011fudur. B<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">u bilimsel de\u011ferlendirme sonras\u0131nda Yarg\u0131tay Cumhuriyet Ba\u015fsavc\u0131l\u0131\u011f\u0131 CMK m. 308 kapsam\u0131ndaki itiraz yetkisini kullanm\u0131\u015f; mahk\u00fbmiyet h\u00fckm\u00fcn\u00fcn yaratt\u0131\u011f\u0131 sonu\u00e7lar ortadan kalkm\u0131\u015f ve hapis cezas\u0131 nedeniyle noterlik mesle\u011fini kaybeden ilgili ki\u015fi yeniden noterlik g\u00f6revine d\u00f6nebilmi\u015ftir. Bu \u00f6rnek, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in sadece Yarg\u0131tay i\u00e7tihat birli\u011fini sa\u011flamaya yarayan teknik bir ola\u011fan\u00fcst\u00fc kanun yolu olmad\u0131\u011f\u0131n\u0131; bazen bir meslek hayat\u0131n\u0131, stat\u00fc kayb\u0131n\u0131 ve a\u011f\u0131r bir adli sonucun d\u00fczeltilmesini m\u00fcmk\u00fcn k\u0131lan son derece etkili bir hukuki g\u00fcvence i\u015flevi g\u00f6rd\u00fc\u011f\u00fcn\u00fc g\u00f6stermektedir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00d6zellikle bu \u00f6rnekte dikkat \u00e7eken nokta, hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n yaln\u0131zca soyut bir yorum fark\u0131ndan ibaret olmamas\u0131d\u0131r. Zamana\u015f\u0131m\u0131n\u0131n yanl\u0131\u015f uygulanmas\u0131, ceza muhakemesinin devam edip edemeyece\u011fini belirleyen kurucu bir meseledir. Bu nedenle Ba\u015fsavc\u0131l\u0131k itiraz\u0131, burada tali veya ikincil bir d\u00fczeltme arac\u0131 olarak de\u011fil; do\u011frudan h\u00fckm\u00fcn hukuki varl\u0131\u011f\u0131n\u0131 ve sonu\u00e7lar\u0131n\u0131 etkileyen a\u011f\u0131r bir hatan\u0131n giderilmesi i\u00e7in devreye giren ola\u011fan\u00fcst\u00fc bir koruma mekanizmas\u0131 olarak i\u015flev g\u00f6rm\u00fc\u015ft\u00fcr.\u00a0<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu t\u00fcr \u00f6rnekler, <a href=\"http:\/\/www.mevzuat.gov.tr\/MevzuatMetin\/1.5.5271.pdf\" target=\"_blank\" rel=\"noopener\">CMK<\/a> m. 308\u2019in uygulamadaki de\u011ferini a\u00e7\u0131k bi\u00e7imde ortaya koymaktad\u0131r. Teoride \u201c<em>ola\u011fan\u00fcst\u00fc kanun yolu<\/em>\u201d olarak tan\u0131mlanan bu kurum, pratikte bazen ki\u015finin h\u00fcrriyeti, mesleki itibar\u0131, kamu g\u00f6revine veya mesle\u011fine devam edebilmesi ve medeni hayat\u0131n\u0131n yeniden kurulabilmesi a\u00e7\u0131s\u0131ndan belirleyici sonu\u00e7lar do\u011furabilmektedir.
