Bu sekiz y\u0131l boyunca, kira s\u00f6zle\u015fmelerinde bu maddelerde belirtilmi\u015f olan konulara ili\u015fkin olarak s\u00f6zle\u015fme serbestisi gere\u011fi kira s\u00f6zle\u015fmesi h\u00fck\u00fcmleri tatbik olundu. Kira s\u00f6zle\u015fmelerinde h\u00fck\u00fcm olmayan hallerde ise, m\u00fclga Bor\u00e7lar Kanunu h\u00fck\u00fcmleri uygulanmaya devam edildi (TBK Ge\u00e7ici Md 2- De\u011fi\u015fik: 4\/7\/2012-6353\/53 md.). Sekiz y\u0131ll\u0131k y\u00fcr\u00fcrl\u00fck erteleme s\u00fcresi 1 Temmuz 2020 tarihinde doluyor. Tekrar bir erteleme olmazsa, y\u00fcr\u00fcrl\u00fc\u011f\u00fc ertelenen Bor\u00e7lar Kanunu h\u00fck\u00fcmleri 1 Temmuz 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecek. Bu tarihe kadar kirac\u0131s\u0131n\u0131n tacir veya t\u00fczel ki\u015fi oldu\u011fu i\u015fyeri kira s\u00f6zle\u015fmelerinin g\u00f6zden ge\u00e7irilmesinde fayda vard\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130\u015fyeri kiralar\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girecek h\u00fck\u00fcmler<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131n\u0131n T\u00fcrk Ticaret Kanununda tacir olarak say\u0131lan ki\u015filer ile \u00f6zel hukuk ve kamu hukuku t\u00fczel ki\u015fileri oldu\u011fu i\u015fyeri kiralar\u0131nda y\u00fcr\u00fcrl\u00fc\u011fe girecek h\u00fck\u00fcmler;\u00a0<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira ili\u015fkisinin ba\u015fkas\u0131na devri<\/span><\/h3>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131, kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131n\u0131 almad\u0131k\u00e7a, kira ili\u015fkisini ba\u015fkas\u0131na devredemez. Kiraya veren, i\u015fyeri kiralar\u0131nda hakl\u0131 sebep olmad\u0131k\u00e7a bu r\u0131zay\u0131 vermekten ka\u00e7\u0131namaz. Kiraya verenin yaz\u0131l\u0131 r\u0131zas\u0131yla kira ili\u015fkisi kendisine devredilen ki\u015fi, kira s\u00f6zle\u015fmesinde kirac\u0131n\u0131n yerine ge\u00e7er ve devreden kirac\u0131, kiraya verene kar\u015f\u0131 bor\u00e7lar\u0131ndan kurtulur. \u0130\u015fyeri kiralar\u0131nda devreden kirac\u0131, kira s\u00f6zle\u015fmesinin bitimine kadar ve en fazla iki y\u0131l s\u00fcreyle devralanla birlikte m\u00fcteselsilen sorumlu olur. (BK md. 323) Bu d\u00fczenlemeyle kiraya verenlerin art\u0131k kirac\u0131dan gelecek devir talebini sebep g\u00f6stermeksizin reddetmeleri engellenmi\u015f olmaktad\u0131r.\u00a0<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131n devam\u0131<\/span><\/h3>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131, s\u00f6zle\u015fme s\u00fcresine veya fesih d\u00f6nemine uymaks\u0131z\u0131n kiralanan\u0131 geri verdi\u011fi takdirde, kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131, kiralanan\u0131n benzer ko\u015fullarla kiraya verilebilece\u011fi makul bir s\u00fcre i\u00e7in devam eder. Kirac\u0131n\u0131n bu s\u00fcrenin ge\u00e7mesinden \u00f6nce kiraya verenden kabul etmesi beklenebilecek, \u00f6deme g\u00fcc\u00fcne sahip ve kira ili\u015fkisini devralmaya haz\u0131r yeni bir kirac\u0131 bulmas\u0131 h\u00e2linde, kirac\u0131n\u0131n kira s\u00f6zle\u015fmesinden do\u011fan bor\u00e7lar\u0131 sona erer. Kiraya veren, yapmaktan kurtuldu\u011fu giderler ile kiralanan\u0131 ba\u015fka bi\u00e7imde kullanmakla elde etti\u011fi veya elde etmekten kasten ka\u00e7\u0131nd\u0131\u011f\u0131 yararlar\u0131 kira bedelinden indirmekle y\u00fck\u00fcml\u00fcd\u00fcr (BK. md 325). Bu d\u00fczenlemeyle kirac\u0131ya ikame kirac\u0131 bularak makul s\u00fcreyle sorumlu olmaks\u0131z\u0131n kiralanan\u0131 s\u00f6zle\u015fme bitiminden \u00f6nce geri verme imkan\u0131 tan\u0131nm\u0131\u015ft\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">S\u00f6zle\u015fmenin feshi<\/span><\/h3>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Taraflardan her biri, kira ili\u015fkisinin devam\u0131n\u0131 kendisi i\u00e7in \u00e7ekilmez h\u00e2le getiren \u00f6nemli sebeplerin varl\u0131\u011f\u0131 durumunda, s\u00f6zle\u015fmeyi yasal fesih bildirim s\u00fcresine uyarak her zaman feshedebilir. H\u00e2kim, durum ve ko\u015fullar\u0131 g\u00f6z \u00f6n\u00fcnde tutarak, ola\u011fan\u00fcst\u00fc<strong>\u00a0<\/strong>fesih bildiriminin parasal sonu\u00e7lar\u0131n\u0131 karara ba\u011flar (BK md 331). BK madde 264\u2019te \u00f6n g\u00f6r\u00fclen kira ili\u015fkisinin bir y\u0131ldan fazla s\u00fcrmesi halinde tazminat bedelinin alt\u0131 ayl\u0131k kira bedelinden az olmamas\u0131 d\u00fczenlemesi, yeni h\u00fck\u00fcmle birlikte h\u00e2kimin takdirine b\u0131rak\u0131lmaktad\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirayla ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmenin kurulmas\u0131 ya da s\u00fcrd\u00fcr\u00fclmesi, kirac\u0131n\u0131n yarar\u0131 olmaks\u0131z\u0131n, kiralanan\u0131n kullan\u0131m\u0131yla do\u011frudan ili\u015fkisi olmayan bir bor\u00e7 alt\u0131na girmesine ba\u011flanm\u0131\u015fsa, kirayla ba\u011flant\u0131l\u0131 s\u00f6zle\u015fme ge\u00e7ersizdir (BK md 340). Uygulamadaki baz\u0131 kira s\u00f6zle\u015fmelerinde; kiraya verenin, kirac\u0131ya lisans vermesi ve sahip oldu\u011fu ta\u015f\u0131nmaz\u0131 ancak bu lisans s\u00f6zle\u015fmesi varl\u0131\u011f\u0131n\u0131 s\u00fcrd\u00fcrd\u00fc\u011f\u00fc m\u00fcddet\u00e7e kiralamas\u0131 ya da kiralanan\u0131n ancak baz\u0131 \u00fcr\u00fcnlerin kiraya verenden al\u0131nmas\u0131 \u015fart\u0131yla kiralanmas\u0131 gibi h\u00fck\u00fcmlerin, kira s\u00f6zle\u015fmesi ile do\u011frudan ili\u015fkisi bulunmamas\u0131na kar\u015f\u0131n, ya kira s\u00f6zle\u015fmesi i\u00e7erisinde yan edim olarak ya da ayr\u0131 bir s\u00f6zle\u015fme birlikte kiraya verenler taraf\u0131ndan kirac\u0131lara dayat\u0131ld\u0131\u011f\u0131 ve kira s\u00f6zle\u015fmesinin ak\u0131betinin bu ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmenin varl\u0131\u011f\u0131na ba\u011fland\u0131\u011f\u0131 uygulamada g\u00f6r\u00fclen bir hadisedir. Erteleme s\u00fcresi boyunca, genel i\u015flem ko\u015fulu gibi kanundan kaynaklanan s\u0131n\u0131rlamalar dahilinde, s\u00f6zle\u015fme serbestisi gere\u011fi ba\u011flant\u0131l\u0131 s\u00f6zle\u015fmelerin ge\u00e7erli oldu\u011fu kabul edilmekteydi. Y\u00fcr\u00fcrl\u00fc\u011fe giren h\u00fck\u00fcm, erteleme s\u00fcresinin sona ermesinden sonra imzalanan ve kirac\u0131n\u0131n yarar\u0131 olmaks\u0131z\u0131n kiralanan\u0131n kullan\u0131m\u0131yla do\u011frudan ili\u015fkisi olmayan kirac\u0131y\u0131 bor\u00e7 alt\u0131na sokan ba\u011flant\u0131 s\u00f6zle\u015fmeler kesin h\u00fck\u00fcms\u00fcz say\u0131laca\u011f\u0131n\u0131 d\u00fczenlemesi getirmektedir.\u00a0<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00fcvence verme borcu<\/span><\/h3>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131nda s\u00f6zle\u015fmeyle kirac\u0131ya g\u00fcvence verme borcu getirilmi\u015fse, bu g\u00fcvence \u00fc\u00e7 ayl\u0131k kira bedelini a\u015famaz. G\u00fcvence olarak para veya k\u0131ymetli evrak verilmesi kararla\u015ft\u0131r\u0131lm\u0131\u015fsa kirac\u0131, kiraya verenin onay\u0131 olmaks\u0131z\u0131n \u00e7ekilmemek \u00fczere, paray\u0131 vadeli bir tasarruf hesab\u0131na yat\u0131r\u0131r, k\u0131ymetli evrak\u0131 ise bir bankaya depo eder. Banka, g\u00fcvenceleri ancak iki taraf\u0131n r\u0131zas\u0131yla veya icra takibinin kesinle\u015fmesiyle ya da kesinle\u015fmi\u015f mahkeme karar\u0131na dayanarak geri verebilir. Kiraya veren, kira s\u00f6zle\u015fmesinin sona ermesini izleyen \u00fc\u00e7 ay i\u00e7inde kirac\u0131ya kar\u015f\u0131 kira s\u00f6zle\u015fmesiyle ilgili bir dava a\u00e7t\u0131\u011f\u0131n\u0131 veya icra ya da iflas yoluyla takibe giri\u015fti\u011fini bankaya yaz\u0131l\u0131 olarak bildirmemi\u015fse banka, kirac\u0131n\u0131n istemi \u00fczerine g\u00fcvenceyi geri vermekle y\u00fck\u00fcml\u00fcd\u00fcr (BK md 342).<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131 aleyhine de\u011fi\u015fiklik<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira s\u00f6zle\u015fmelerinde kira bedelinin belirlenmesi d\u0131\u015f\u0131nda, kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamaz (BK md. 342). Kira bedeli d\u0131\u015f\u0131nda kirac\u0131 aleyhine de\u011fi\u015fiklik yap\u0131lamayaca\u011f\u0131n\u0131 \u00f6n g\u00f6ren bu madde, 6570 say\u0131l\u0131 Kanun\u2019un 9. maddesiyle \u00f6rt\u00fc\u015ft\u00fc\u011f\u00fcnden erteleme s\u00fcresi boyunca da herhangi bir de\u011fi\u015fiklik yaratmam\u0131\u015ft\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira bedeline ili\u015fkin anla\u015fma<\/span><\/h3>\n<p style=\"font-weight: 400; text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Taraflar\u0131n yenilenen kira d\u00f6nemlerinde uygulanacak kira bedeline ili\u015fkin anla\u015fmalar\u0131, bir \u00f6nceki kira y\u0131l\u0131nda t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla ge\u00e7erlidir. Bu kural, bir y\u0131ldan daha uzun s\u00fcreli kira s\u00f6zle\u015fmelerinde de uygulan\u0131r. Taraflarca bu konuda bir anla\u015fma yap\u0131lmam\u0131\u015fsa, kira bedeli, bir \u00f6nceki kira y\u0131l\u0131n\u0131n t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131n\u0131 ge\u00e7memek ko\u015fuluyla h\u00e2kim taraf\u0131ndan, kiralanan\u0131n durumu g\u00f6z \u00f6n\u00fcne al\u0131narak hakkaniyete g\u00f6re belirlenir.\u00a0Taraflarca bu konuda bir anla\u015fma yap\u0131l\u0131p yap\u0131lmad\u0131\u011f\u0131na bak\u0131lmaks\u0131z\u0131n, be\u015f y\u0131ldan uzun s\u00fcreli veya be\u015f y\u0131ldan sonra yenilenen kira s\u00f6zle\u015fmelerinde ve bundan sonraki her be\u015f y\u0131l\u0131n sonunda, yeni kira y\u0131l\u0131nda uygulanacak kira bedeli, h\u00e2kim taraf\u0131ndan t\u00fcketici fiyat endeksindeki oniki ayl\u0131k ortalamalara g\u00f6re de\u011fi\u015fim oran\u0131, kiralanan\u0131n durumu ve emsal kira bedelleri g\u00f6z \u00f6n\u00fcnde tutularak hakkaniyete uygun bi\u00e7imde belirlenir.\u00a0S\u00f6zle\u015fmede kira bedeli yabanc\u0131 para olarak kararla\u015ft\u0131r\u0131lm\u0131\u015fsa 20\/2\/1930 tarihli ve 1567 say\u0131l\u0131 T\u00fcrk Paras\u0131n\u0131n K\u0131ymetini Koruma Hakk\u0131nda Kanun h\u00fck\u00fcmleri sakl\u0131 kalmak \u015fart\u0131yla, be\u015f y\u0131l ge\u00e7medik\u00e7e kira bedelinde de\u011fi\u015fiklik yap\u0131lamaz. Ancak, bu Kanunun, \u201cA\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc\u201d ba\u015fl\u0131kl\u0131 138 inci maddesi h\u00fckm\u00fc sakl\u0131d\u0131r. Be\u015f y\u0131l ge\u00e7tikten sonra kira bedelinin belirlenmesinde, yabanc\u0131 paran\u0131n de\u011ferindeki de\u011fi\u015fiklikler de g\u00f6z \u00f6n\u00fcnde tutularak uyarlama yap\u0131labilir (BK md 344). Mevcut kira s\u00f6zle\u015fmelerinde yer alan kira bedelinin belirlenmesine y\u00f6nelik d\u00fczenlemeler, y\u00fcr\u00fcrl\u00fc\u011f\u00fc ertelenen h\u00fckm\u00fcn\u00a0 y\u00fcr\u00fcrl\u00fc\u011fe girmesiyle h\u00fck\u00fcmde yer alan s\u0131n\u0131rlamalara tabi hale gelecektir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Muacceliyet kay\u0131tlar\u0131 ve cezai \u015fartlar<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131ya, kira bedeli ve yan giderler d\u0131\u015f\u0131nda ba\u015fka bir \u00f6deme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc getirilemez. \u00d6zellikle, kira bedelinin zaman\u0131nda \u00f6denmemesi h\u00e2linde ceza<b>\u00a0<\/b>ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin anla\u015fmalar ge\u00e7ersizdir(BK md 346). Kira bedelinin zaman\u0131nda \u00f6denmemesi h\u00e2linde ceza ko\u015fulu \u00f6denece\u011fine veya sonraki kira bedellerinin muaccel olaca\u011f\u0131na ili\u015fkin kay\u0131tlar ge\u00e7ersiz say\u0131lm\u0131\u015ft\u0131r. Bu nedenle, taraflar\u0131n\u0131n tacir veya t\u00fczel ki\u015fi oldu\u011fu i\u015fyeri kiralar\u0131na ili\u015fkin s\u00f6zle\u015fmelerde yer alan muacceliyet kay\u0131tlar\u0131 ve cezai \u015fartlar, bu h\u00fckm\u00fcnde yer alan s\u0131n\u0131rlamalara tabi hale gelecektir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Dava yoluyla kira s\u00f6zle\u015fmesinin sona erdirilmesine ili\u015fkin h\u00fck\u00fcmler, kirac\u0131 aleyhine de\u011fi\u015ftirilemez.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Y\u00fcr\u00fcrl\u00fck<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131s\u0131 tacir veya t\u00fczel ki\u015fi olan i\u015fyeri kiralar\u0131nda, TBK\u2019n\u0131n kira s\u00f6zle\u015fmesine ili\u015fkin birtak\u0131m h\u00fck\u00fcmlerinin y\u00fcr\u00fcrl\u00fc\u011f\u00fc TBK ge\u00e7ici madde 2 h\u00fckm\u00fcyle 1 Temmuz 2020 tarihine kadar ertelenmi\u015fti. Y\u00fcr\u00fcrl\u00fc\u011f\u00fc 8 y\u0131l s\u00fcreyle ertelenen h\u00fck\u00fcmler 1 Temmuz 2020 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe girecektir. An\u0131lan h\u00fck\u00fcmlerin y\u00fcr\u00fcrl\u00fc\u011fe girmesi gerek 1 Temmuz 2020 tarihinde sonra akdedilecek gerekse 1 temmuz 2020 tarihinden \u00f6nce akdedilmi\u015f i\u015fyeri kira s\u00f6zle\u015fmelerinde \u00f6nemli de\u011fi\u015fiklikler meydana getirecektir.
