Bu s\u00fcre\u00e7te i\u015fyerleri kiralama s\u00f6zle\u015fmelerine 1 Mart -30 Haziran aras\u0131nda tahliye ve fesih yasa\u011f\u0131 gelirken, konutlarda ise 31 Nisan\u2019a kadar icra davas\u0131 a\u00e7\u0131lmay\u0131 engellendi. \u00d6zellikle 1 May\u0131s\u2019tan sonra icra, 1 Temmuz\u2019dan itibaren ise tahliye ve uyarlama davalar\u0131nda b\u00fcy\u00fck art\u0131\u015f ya\u015fanmas\u0131 muhtemeldir.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Pandemi s\u00fcrecinden kaynaklanan hukuki sorunlar\u0131n ba\u015fl\u0131calar\u0131ndan birisi de kiraya veren-kirac\u0131 uyu\u015fmazl\u0131klar\u0131d\u0131r. Ba\u015fta i\u015fyerleri olmak \u00fczere t\u00fcm kira ili\u015fkilerinde hem taraflar\u0131n durumlar\u0131n\u0131n de\u011fi\u015fmesi hem de mecurun durumunun de\u011fi\u015fmesinden kaynakl\u0131 uyu\u015fmazl\u0131klar ortaya \u00e7\u0131km\u0131\u015ft\u0131r. Kamusal kararlarla AVM\u2019lerin, ula\u015f\u0131m ara\u00e7lar\u0131n\u0131n, baz\u0131 sekt\u00f6rlerin faaliyetleri tamamen durdurulmu\u015ftur. Di\u011fer bir\u00e7ok i\u015fyeri ise faaliyetleri herhangi bir kamusal kararla durdurulmamakla beraber soka\u011fa \u00e7\u0131kma yasaklar\u0131, bula\u015f riskleri, t\u00fcketici e\u011filimleri, m\u00fc\u015fteri azl\u0131\u011f\u0131 gibi nedenlerle i\u015f kayb\u0131na u\u011fram\u0131\u015flard\u0131r.\u00a0\u00a0 \u00a0<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Haziran sonras\u0131na \u00f6teleniyor<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kiras\u0131n\u0131 \u00f6demeyenlerin say\u0131s\u0131nda art\u0131\u015f dikkat \u00e7ekici noktada. Korona salg\u0131n\u0131 \u00f6ncesi konut ve i\u015fyeri kiralamalar\u0131nda \u00f6dememe oranlar\u0131n\u0131n icra dosyalar\u0131nda aras\u0131nda y\u00fczde 1-2 ilk bir orana sahip iken, salg\u0131n sebebiyle i\u015fyeri kirac\u0131lar\u0131n\u0131n genel olarak kira \u00f6demekten ka\u00e7\u0131nd\u0131\u011f\u0131 ve Haziran sonras\u0131na erteledi\u011fi g\u00f6r\u00fclmektedir. Kiralamalar konusunda d\u00fczenleme yap\u0131lmad\u0131\u011f\u0131 taktirde ise s\u00f6zle\u015fmelerine ili\u015fkin mal sahiplerinin icra davalar\u0131, kirac\u0131lar\u0131n ise uyarlama davalar\u0131n\u0131n yo\u011funla\u015fmas\u0131 beklenmektedir. Bu s\u00fcre\u00e7te; konut alanlarda fesihler, arsa kar\u015f\u0131l\u0131\u011f\u0131 i\u015flerde fesihler, konut teslim etme s\u00fcrelerinde uzamalar olabilir.\u00a0<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Biriken kira 12 taksitle al\u0131nmal\u0131<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcketiciyi Koruma Derne\u011fi (T\u00dcKODER) Ba\u015fkan\u0131 Aziz Ko\u00e7al, kira \u00f6demelerinde taraflar aras\u0131nda s\u0131k\u0131nt\u0131lar\u0131n ba\u015f g\u00f6stermeye ba\u015flad\u0131\u011f\u0131n\u0131 s\u00f6yledi. Ko\u00e7al, \u201c\u015eu anda bize en \u00e7ok sorulan soru kira oldu. Kira \u00f6demeleri konusunda koronavir\u00fcs ile m\u00fccadele bitene kadar \u00f6nerilerimiz; devletin, kirada oturan vatanda\u015flar\u0131m\u0131za kira yard\u0131m\u0131nda bulunmas\u0131. B\u00f6ylece vatanda\u015f\u0131 rahatlataca\u011f\u0131 gibi tek geliri kira olan baz\u0131 ev sahiplerini rahatlatm\u0131\u015f olacak\u201d dedi. Dr. Umut Yeniocak, \u015fu an en \u00e7ok talep edilen konunun \u201cKira S\u00f6zle\u015fmeleri\u201d oldu\u011funu ve en \u00e7ok kiralarla ilgili sorular ald\u0131\u011f\u0131n\u0131 belirtti. Kira \u00f6dememe durumunun ciddi oranda artt\u0131\u011f\u0131n\u0131 aktaran Ali G\u00fcven\u00e7 Kiraz da, burada mal sahibinin durumunun da \u00f6nemli oldu\u011funu belirterek, \u201cE\u011fer bu ki\u015fi AVM sahibiyse, yurt d\u0131\u015f\u0131ndan kredi ald\u0131ysa ve kira geliri ile \u00f6demelerini yap\u0131yorsa, yar\u0131 yar\u0131ya \u00f6deme \u015fekli uygulanmal\u0131. Ya da h\u00fck\u00fcmet bir oran belirler ve bir k\u0131sm\u0131n\u0131 kendisi kar\u015f\u0131lar. Hukuki m\u00fcessese olarak <strong>m\u00fccbir sebep<\/strong> hali, <strong>\u00f6ng\u00f6r\u00fclemeyen hal<\/strong>, <strong>a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc<\/strong>, <strong>d\u00fcr\u00fcstl\u00fck kurallar\u0131<\/strong> gibi ba\u015fl\u0131klar \u00e7er\u00e7evesinde de\u011ferlendirilebilecek olan uyu\u015fmazl\u0131klar i\u00e7in yarg\u0131sal makamlar\u0131n \u00e7\u00f6z\u00fcm noktas\u0131nda hem s\u00fcre hem de adillik anlam\u0131nda tam olarak haz\u0131r bulunduklar\u0131n\u0131 s\u00f6ylemek zordur. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Y\u00fczbinlerce uyu\u015fmazl\u0131k ger\u00e7e\u011fi \u00f6n\u00fcm\u00fczde olup, bu uyu\u015fmazl\u0131klara \u00e7\u00f6z\u00fcm \u00fcretmek bak\u0131m\u0131ndan elimizde iki ayr\u0131 hukuki yol bulunmaktad\u0131r. Bunlardan birisi <strong>dava yolu<\/strong>, ikincisi ise <strong>arabuluculuk yolu<\/strong>dur. Kira ili\u015fkilerinin yeniden d\u00fczenlenmesi ve uyu\u015fmazl\u0131klar\u0131n ortadan kald\u0131r\u0131lmas\u0131 bak\u0131m\u0131ndan bu iki yol aras\u0131nda bir kar\u015f\u0131la\u015ft\u0131rma yap\u0131ld\u0131\u011f\u0131nda;\u00a0 arabuluculuk yolunun bir\u00e7ok a\u00e7\u0131dan her iki taraf i\u00e7in de avantajl\u0131 oldu\u011fu s\u00f6ylenebilir.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Dava yoluyla k\u0131yasland\u0131\u011f\u0131nda arabuluculuk yolunun neden tercih edilmesi gerekti\u011fi Av. Arb. \u0130lhan Masarifo\u011flu taraf\u0131ndan maddeler halinde net bir \u015fekilde ortaya konulmu\u015ftur. \u015e\u00f6yleki;\u00a0\u00a0<\/span><\/p>\n<h3 style=\"text-align: justify;\">S\u00fcre Y\u00f6n\u00fcnden;<\/h3>\n<article class=\"recipe-article m-auto\">\n<div class=\"article-body\">\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uyarlama ya da kira bedelinin tespiti ad\u0131 alt\u0131nda a\u00e7\u0131lacak bir davada dava dilek\u00e7esinin d\u00fczenlenmesi, dava a\u00e7\u0131lmas\u0131, dilek\u00e7enin kar\u015f\u0131 yana tebli\u011fi, yasal cevap s\u00fcresinin beklenmesi, cevap verilmesi, cevab\u0131n tebli\u011fi, delillerin toplanmas\u0131, duru\u015fma g\u00fcn\u00fc tayini, duru\u015fma yap\u0131lmas\u0131, eksik delillerin toplanmas\u0131, ke\u015fif karar\u0131, bilirki\u015fi incelemesi, bilirki\u015fi raporu d\u00fczenlenmesi, taraflara tebli\u011fi, bilirki\u015fi raporuna itiraz edilmesi, itirazlar\u0131n de\u011ferlendirilmesi, gere\u011finde ek ya da yeni rapor al\u0131nmas\u0131, karar verilmesi, karar\u0131n yaz\u0131lmas\u0131, tebli\u011fi, icra takip i\u015flemlerinin ba\u015flamas\u0131, takibin kesinle\u015fmesi, \u00a0istinaf s\u00fcreci, tehir-i icra karar\u0131 gibi son derece uzun bir s\u00fcrecin sonras\u0131nda herhangi bir s\u0131ra d\u0131\u015f\u0131 durumla kar\u015f\u0131la\u015f\u0131lmasa dahi yakla\u015f\u0131k olarak en az 2 YIL s\u00fcrecek bir yarg\u0131lama yap\u0131lacakt\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira bedelinin ya da kira ili\u015fkisinin yeniden d\u00fczenlenmesi amac\u0131yla arabulucuya ba\u015fvurulmas\u0131, toplant\u0131 g\u00fcn\u00fcn\u00fcn belirlenmesi, davet yap\u0131lmas\u0131, ilk oturum, oturum ertelemeleri, son oturum, anla\u015fma tutana\u011f\u0131n\u0131n d\u00fczenlenmesi, imzalanmas\u0131 i\u015flemleri d\u00e2hil olmak \u00fczere arabuluculuk yoluyla uyu\u015fmazl\u0131\u011f\u0131n \u00e7\u00f6z\u00fcm\u00fc 1 G\u00dcN \u0130LA EN FAZLA 8 HAFTA i\u00e7erisinde sonlanm\u0131\u015f olacakt\u0131r.\u00a0<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00d6ng\u00f6r\u00fclebilirlik Y\u00f6n\u00fcnden;<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uzunca s\u00fcrecek bir yarg\u0131lamada delillerin tam ve yeterince toplanamamas\u0131, kaydi delillerle ger\u00e7ek durumun farkl\u0131l\u0131k i\u00e7ermesi, hakimden, bilirki\u015fiden, takdir haklar\u0131ndan kaynaklanan nedenlerle yarg\u0131lama sonucunda verilecek karar\u0131n hem davac\u0131 hem de daval\u0131 y\u00f6n\u00fcnden s\u00fcrpriz olmas\u0131 ya da tatmin edici olmamas\u0131 olas\u0131l\u0131\u011f\u0131 bulunmaktad\u0131r. Taraflardan birisi i\u00e7in y\u0131k\u0131c\u0131 ya da beklenenin \u00f6tesinde zarar verici sonu\u00e7lar\u0131 da olabilecek bulunan dava yolunda nihai karar\u0131n ne \u015fekilde olaca\u011f\u0131n\u0131 y\u00fczde y\u00fcz tahmin etmek m\u00fcmk\u00fcn bulunmamaktad\u0131r. \u00d6zellikle yarg\u0131laman\u0131n uzamas\u0131ndan kaynakl\u0131 olarak pandemi ko\u015fullar\u0131n\u0131n bulundu\u011fu bug\u00fcn ile ke\u015fif ve bilirki\u015fi incelemesinin yap\u0131ld\u0131\u011f\u0131 tahminen 6 ay ya da 1 y\u0131l sonraki durum b\u00fcy\u00fck \u00f6l\u00e7\u00fcde farkl\u0131 olaca\u011f\u0131ndan yarg\u0131lama sonucunu \u00f6ng\u00f6rmek olanaks\u0131zd\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Tamamen taraflar\u0131n inisiyatifinde y\u00fcr\u00fcyen bir s\u00fcre\u00e7 oldu\u011fundan hem arabuluculuk yolunun i\u015fleyi\u015fi hem de sonucu taraflar y\u00f6n\u00fcnden y\u00fczde y\u00fcz oran\u0131nda kesin ve \u00f6ng\u00f6r\u00fclebilir bulunmaktad\u0131r. Zaten taraflar\u0131n \u00f6ng\u00f6rmedi\u011fi bir gidi\u015fat s\u00f6z konusu oldu\u011funda her bir yan\u0131n anla\u015fma yapmama gibi bir hakk\u0131 bulundu\u011fundan \u00f6nlerinde \u00f6ng\u00f6r\u00fclemeyen bir tabloyla kar\u015f\u0131la\u015fmalar\u0131 m\u00fcmk\u00fcn bulunmamaktad\u0131r.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Masraflar Y\u00f6n\u00fcnden;<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Dava harc\u0131, ke\u015fif ve bilirki\u015fi incelemesi masraflar\u0131, posta masraflar\u0131, gider avanslar\u0131, icra har\u00e7lar\u0131, icra masraflar\u0131, avukatl\u0131k \u00fccretleri gibi t\u00fcm giderler g\u00f6z \u00f6n\u00fcne al\u0131nd\u0131\u011f\u0131nda neredeyse dava konusunun y\u00fczde yirmibe\u015fine varan ya da en d\u00fc\u015f\u00fck kira bedelinde dahi yakla\u015f\u0131k 5-10.000,00TL aras\u0131nda bir masraf \u00f6denmesi gerekmekte olup, bundan ka\u00e7\u0131nmak m\u00fcmk\u00fcn de\u011fildir.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hi\u00e7bir har\u00e7 \u00f6demeden sadece arabuluculuk \u00fccreti \u00f6denerek ya da vekil ile temsil yap\u0131l\u0131yor ise davaya nazaran daha makul bir vekalet \u00fccreti ile s\u00fcreci sonland\u0131rmak m\u00fcmk\u00fcnd\u00fcr.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130li\u015fkiyi \u00c7ok Y\u00f6nl\u00fc D\u00fczenlemek Y\u00f6n\u00fcnden;\u00a0<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Mahkeme \u00f6n\u00fcne sadece uyu\u015fmazl\u0131k konusu ile s\u0131n\u0131rl\u0131 konular getirilebilece\u011finden ve usul h\u00fck\u00fcmleri gere\u011fi hem taraflar\u0131n hem de mahkemenin bunlar\u0131n d\u0131\u015f\u0131na \u00e7\u0131kmas\u0131 m\u00fcmk\u00fcn bulunmad\u0131\u011f\u0131ndan \u00f6rne\u011fin sadece tahliye ya da sadece yeni kira bedeli belirleme konular\u0131nda karar verilebilecektir. Kira s\u00f6zle\u015fmesinin ya da genel olarak t\u00fcm kira ili\u015fkisinin ba\u015fka h\u00fck\u00fcmlerine genel olarak dokunulmayacak ve taraflar\u0131n y\u00fck\u00fcml\u00fcl\u00fckleri ilk anla\u015fmadaki gibi devam edecektir. Verilen kararla herhangi bir durum de\u011fi\u015fikli\u011fini i\u00e7ermeyen, esnek olmayan, dava tarihinden itibaren ge\u00e7erli olup bundan sonra hep b\u00f6yle devam edecek olan yeni bir ili\u015fki tesis edilecektir. Oysa pandemi s\u00fcrecinin etkileri aylar ya da y\u0131llar itibari ile ki\u015fi ya da sekt\u00f6r baz\u0131nda s\u0131k\u00e7a de\u011fi\u015fiklik g\u00f6sterebilecektir. \u00d6rne\u011fin; bir lokanta i\u00e7in pandemi d\u00f6nemi-normalle\u015fme d\u00f6nemi-normalle\u015fmenin ilk aylar\u0131-normalle\u015fmenin birinci y\u0131l\u0131 gibi d\u00f6nemlerde de\u011fi\u015fiklik g\u00f6steren ve ayr\u0131 ayr\u0131 d\u00fczenlenmesi gereken durumlar s\u00f6z konusudur. Mahkeme verece\u011fi karar ile \u00a0bunlar\u0131 hi\u00e7 g\u00f6zetmeksizin tek bir h\u00fck\u00fcm ve t\u00fcm zamanlarda uygulanacak bir karar olu\u015fturacakt\u0131r. \u00d6rne\u011fin; bu lokantan\u0131n kira bedelinin lokantan\u0131n kapal\u0131 oldu\u011fu d\u00f6nemde y\u00fczde yetmi\u015fbe\u015f; normalle\u015fme s\u00fcrecinin ilk aylar\u0131nda y\u00fczde elli; bir y\u0131l\u0131n sonunda \u00a0ise y\u00fczde on oran\u0131nda gerekirken mahkeme, usul h\u00fck\u00fcmleri gere\u011fi bir tek kira bedeli belirleyecek ve ekonominin ini\u015fli \u00e7\u0131k\u0131\u015fl\u0131 d\u00f6nemlerini g\u00f6z ard\u0131 ederek bir karar verecektir. Bu karar kimi zaman kiraya vereni kimi zaman kirac\u0131y\u0131 ve genellikle de her iki taraf\u0131 tatmin etmeyecektir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Taraflar var\u0131lacak anla\u015fma ile kira ili\u015fkisinin bundan sonraki \u015feklini hem konu hem de s\u00fcre y\u00f6n\u00fcnden s\u0131n\u0131rs\u0131zca d\u00fczenleyebilecekler, de\u011fi\u015fen durumlara g\u00f6re de yeniden arabuluculuk y\u00f6ntemi ile bir araya gelebileceklerdir. Dava yolundan farkl\u0131 olarak kira bedellerini aydan aya, y\u0131ldan y\u0131la veya herhangi bir zaman dilimine g\u00f6re belirleyebilecekleri gibi ciro \u00fczerinden belirleme, sekt\u00f6rel geli\u015fmelere g\u00f6re belirleme yollar\u0131na gidebileceklerdir. S\u0131n\u0131rs\u0131zca ve \u00f6zg\u00fcrce kira s\u00f6zle\u015fmesinin her bir maddesinde diledikleri de\u011fi\u015fikli\u011fi yapabileceklerdir. Kira ili\u015fkileri t\u00fcm hukuki ili\u015fkiler i\u00e7erisinde aile hukuku sonras\u0131nda en uzun s\u00fcren ili\u015fkilerdendir. Arabuluculuk y\u00f6nteminde bu ili\u015fkinin bozulmayaca\u011f\u0131 sonu\u00e7lar elde edilecektir.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Gizlilik Y\u00f6n\u00fcnden<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00fcnl\u00fck hayatta kiraya verenlerin genelde birden \u00e7ok kiralanan\u0131 oldu\u011fu ya da kirac\u0131lar\u0131n yine birden \u00e7ok yerde kirac\u0131 bulundu\u011fu bilinmektedir. \u00d6rne\u011fin; AVM\u2019lerde bir tek kiraya veren ama onlarca-y\u00fczlerce kirac\u0131 bulunmaktad\u0131r. Yine zincir ma\u011fazalarda onlarca kiraya veren ve bir tek kirac\u0131 bulunmaktad\u0131r. Her kira ili\u015fkisinin kendine \u00f6zg\u00fc \u00f6zellikleri bulunmaktad\u0131r. Kira ili\u015fkisinin ne zamandan beri devam etti\u011fi, kirac\u0131n\u0131n mecura bak\u0131m ve dekorasyonu, kira bedeli \u00f6demelerindeki d\u00fczenlili\u011fi, AVM kurallar\u0131na uyumu gibi say\u0131s\u0131z durum taraflar\u0131n birbirine bak\u0131\u015f\u0131n\u0131 etkilemektedir. Bu nedenle \u00f6rne\u011fin bir AVM\u2019de, bir ma\u011faza i\u00e7in metrekaresi 50 TL\u2019den kiraya verilen bir yer, bir ba\u015fka kirac\u0131ya 250 TL\u2019ye verilebilmektedir. Bu nedenle kiraya verenler s\u00f6zle\u015fmelere \u00f6zel h\u00fck\u00fcmler koyarak gizlilik kural\u0131 getirmekte, bir kirac\u0131n\u0131n \u00f6dedi\u011fi kira bedelini, di\u011fer bir kirac\u0131n\u0131n bilmemesini istemektedirler. \u00c7\u00fcnk\u00fc daha fazla kira \u00f6deyen kirac\u0131 di\u011fer bir kira s\u00f6zle\u015fmesini emsal g\u00f6stererek kendisine de kira indirimi yap\u0131lmas\u0131n\u0131 talep edebilmektedir. Dava yoluna gidildi\u011finde t\u00fcm bu bilgiler if\u015fa olmakta, alenile\u015fmekte, mahkeme kararlar\u0131 herkes taraf\u0131ndan bilinmekte ve \u00e7oklu kira ili\u015fkilerinde de\u011fi\u015fik taraflar aras\u0131nda kaos do\u011fmaktad\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Arabuluculuk s\u00fcreci gizli oldu\u011fundan, hem g\u00f6r\u00fc\u015fme i\u00e7erikleri hem de var\u0131lan anla\u015fma bir s\u0131r olarak taraflarda kald\u0131\u011f\u0131ndan \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin s\u00f6zle\u015fme h\u00fck\u00fcmlerinden ve \u00f6zellikle de kira bedelinden haberdar olmalar\u0131 m\u00fcmk\u00fcn bulunmamaktad\u0131r. B\u00f6ylelikle her bir kira ili\u015fkisi kendi mahremiyetini korumakta, iyi ya da k\u00f6t\u00fc y\u00f6nde emsal olarak kullan\u0131lmamaktad\u0131r.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sonu\u00e7lar\u0131 Y\u00f6n\u00fcnden;<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uzun s\u00fcre devam eden, karar\u0131n ne \u015fekilde \u00e7\u0131kaca\u011f\u0131 bilinmeyen ancak y\u00fcr\u00fcrl\u00fck tarihi dava tarihi olan yarg\u0131lamada, y\u0131llar sonra birikmi\u015f bir bor\u00e7 ya da birikmi\u015f bir iade ortaya \u00e7\u0131kabilmektedir. \u00d6rne\u011fin; kira bedelinin uyarlanmas\u0131 istendi\u011finde karar verilip, karar\u0131n kesinle\u015fmesi tarihine kadar mevcut haliyle kira bedellerinin \u00f6denmesine devam edilmektedir. B\u00f6ylelikle pandemi ko\u015fullar\u0131n\u0131n en a\u011f\u0131r oldu\u011fu, i\u015flerin en k\u00f6t\u00fc oldu\u011fu, \u00f6deme g\u00fc\u00e7l\u00fc\u011f\u00fcn\u00fcn en yo\u011fun oldu\u011fu d\u00f6nemde dava a\u00e7mak, davac\u0131n\u0131n sorununu \u00e7\u00f6zmemektedir. Davac\u0131 bir an \u00f6nce y\u00fck\u00fcml\u00fcl\u00fcklerinin azalt\u0131lmas\u0131n\u0131 ve ticari hayat\u0131n\u0131n s\u00fcrd\u00fcr\u00fclebilir hale gelmesini arzu etmektedir. Ancak bu konudaki ba\u015fvurusunun sonucunu almak i\u00e7in yakla\u015f\u0131k iki y\u0131l s\u00fcre ile beklemesi gerekmektedir. Bu nedenle dava a\u00e7mak onun derdine merhem olamamaktad\u0131r. Di\u011fer yanda ise kira bedellerini tahsil etmekle birlikte bir belirsizlik i\u00e7erisinde olan, ald\u0131\u011f\u0131 bedelleri iade edip etmeyece\u011fini ya da ne kadar iade edece\u011fini bilemeyen kiraya veren bulunmaktad\u0131r.
