Later documented internationally by <a href=\"https:\/\/www.newtactics.org\/tactics\/using-videotaped-prosecution-police-officers-human-rights-violations-educational-tool\/\" target=\"_blank\" rel=\"noopener\">New Tactics in Human Rights<\/a>, the initiative offers enduring lessons about professional education, institutional culture and the challenge of turning legal standards into everyday practice.<\/em><\/span><\/p>\n<h3 data-section-id=\"1de5j1p\" data-start=\"704\" data-end=\"755\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">1. Introduction: Changing Laws, Changing Behaviour<\/span><\/h3>\n<p data-start=\"757\" data-end=\"1113\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Legal reform and institutional change do not necessarily move at the same pace. A state may strengthen procedural safeguards, revise legislation and embrace international human rights standards, yet still face a more difficult question: <strong data-start=\"994\" data-end=\"1113\">how can those standards be translated into the everyday decisions of professionals entrusted with public authority?\u00a0<\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The challenge is particularly acute in law enforcement (<a href=\"https:\/\/www.egm.gov.tr\/\" target=\"_blank\" rel=\"noopener\">The police<\/a>, <a href=\"https:\/\/www.jandarma.gov.tr\/\" target=\"_blank\" rel=\"noopener\">The Gendarmerie<\/a>, <a href=\"https:\/\/www.sg.gov.tr\/\" target=\"_blank\" rel=\"noopener\">The Coast Guard<\/a>\u00a0 and <a href=\"https:\/\/muhafaza.ticaret.gov.tr\/\" target=\"_blank\" rel=\"noopener\">Custom Control Officers<\/a>) Academy. Law enforcement officers operate where the coercive powers of the state come into direct contact with individual liberty. <a href=\"https:\/\/www.bicakhukuk.com\/en\/detention-and-custody-of-suspects-in-turkey\/\" target=\"_blank\" rel=\"noopener\">Arrest<\/a>, <a href=\"https:\/\/www.bicakhukuk.com\/en\/detention-and-custody-of-suspects-in-turkey\/\" target=\"_blank\" rel=\"noopener\">detention<\/a>, questioning, searches and the <a href=\"https:\/\/www.bicakhukuk.com\/en\/works\/evidence-digital-forensic\/\" target=\"_blank\" rel=\"noopener\">collection of evidence<\/a> are not merely technical stages of <a href=\"https:\/\/www.bicakhukuk.com\/en\/works\/iinvestigation-police-prosecutor\/\" target=\"_blank\" rel=\"noopener\">criminal investigation<\/a>. They are also moments in which guarantees such as the right to remain silent, access to legal counsel, protection against ill-treatment and the presumption of innocence must become operational realities.<\/span><\/p>\n<p data-start=\"1620\" data-end=\"2239\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Against this background, <a href=\"https:\/\/www.bicakhukuk.com\/en\/team\/attorneys-2\/prof-dr-vahit-bicak\/\" target=\"_blank\" rel=\"noopener\">Prof. Dr. Vahit B\u0131\u00e7ak<\/a> developed an experimental training method at the Turkish Police Academy in the mid-1990s. The initiative emerged during a period when T\u00fcrkiye\u2019s efforts to improve its human rights record and align domestic practice with European standards were matters of significant institutional and public concern. The problem B\u0131\u00e7ak identified, however, went beyond legislative reform. Some future police officers appeared to regard safeguards for suspects as constraints on effective crime control rather than integral elements of lawful policing.\u00a0<\/span><\/p>\n<p data-start=\"1620\" data-end=\"2239\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">His response was deliberately practical. Instead of relying exclusively on lectures and legal texts, he brought the consequences of rights violations into the classroom. Real court proceedings involving police officers prosecuted in connection with such violations were recorded and edited into a 90-minute teaching film. The footage formed part of a year-long educational process accompanied by anonymous questionnaires designed to compare students\u2019 attitudes before and after the training.<\/span><\/p>\n<p data-start=\"2810\" data-end=\"3177\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The premise was simple but ambitious: professional education should do more than tell future officers what the law requires. It should help them understand <strong data-start=\"2966\" data-end=\"3177\">why procedural protections matter, what may follow when public authority is exercised unlawfully and why the rights of a suspect are ultimately rights that anyone &#8211; including a police officer &#8211; may one day need. <\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Almost three decades later, the premise remains relevant beyond its original setting. It raises a question that continues to confront law-enforcement agencies and other institutions: <strong data-start=\"3362\" data-end=\"3485\">can professional education move beyond transmitting rules and influence attitudes, judgement and institutional culture?<\/strong><\/span><\/p>\n<h3 data-section-id=\"1fossya\" data-start=\"3487\" data-end=\"3537\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2. Human Rights Are Not \u201cOther People\u2019s Rights\u201d<\/span><\/h3>\n<p data-start=\"3539\" data-end=\"3709\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">At the conceptual heart of B\u0131\u00e7ak\u2019s approach was a deceptively simple proposition: <strong data-start=\"3621\" data-end=\"3709\">human rights are not the rights of \u201c<em>other people<\/em>\u201d; they are the rights of all of us.\u00a0<\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The difficulty he encountered was not simply a lack of knowledge about human rights instruments or criminal procedure. It concerned how those rights were perceived. Some police candidates appeared to regard them primarily as protections afforded to the people whom police investigated and, consequently, as external restrictions on the ability of law enforcement to combat crime.<\/span><\/p>\n<p data-start=\"4092\" data-end=\"4485\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The assumptions recorded in the project included the belief that respect for human rights could weaken the operational capacity of security forces; that policing resembled a \u201c<em>war<\/em>\u201d against crime in which restrictions on methods were counterproductive; and that coercion against those regarded as criminals could be accepted as part of ordinary police work. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">B\u0131\u00e7ak\u2019s approach sought to reverse that perspective.\u00a0<\/span><\/p>\n<p data-start=\"4541\" data-end=\"4949\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Police officers do not stand outside the human rights system. They are themselves rights-holders. Their families, colleagues and communities benefit from the same protections as everyone else. At the same time, because officers exercise coercive powers on behalf of the state, they carry a particular responsibility to ensure that those who come within their authority can enjoy those guarantees in practice.<\/span><\/p>\n<p data-start=\"4951\" data-end=\"5566\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The distinction between a <strong data-start=\"4977\" data-end=\"4988\">suspect, accused<\/strong> and a <strong data-start=\"4995\" data-end=\"5017\">convicted offender<\/strong> was therefore fundamental. The project challenged the assumption that contact with the criminal justice system justified treating a person as already guilty. B\u0131\u00e7ak used contemporary Turkish criminal-justice figures to illustrate that many people could become suspects without ultimately being convicted. Those figures belong to their historical context, but the principle they were intended to demonstrate remains fundamental: <strong data-start=\"5445\" data-end=\"5528\">being suspected or accused of an offence does not extinguish a person\u2019s rights.<\/strong><\/span><\/p>\n<p data-start=\"5568\" data-end=\"6195\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This perspective also reframed the teaching of criminal procedure. The right to silence, access to counsel, notification of detention, medical examination and the opportunity to present exculpatory evidence need not be understood as concessions made to an adversary. They are safeguards built into the justice system because the coercive power of the state can affect anyone. The questionnaire developed for the project tested students\u2019 attitudes toward these and other concrete protections, linking the broader language of human rights directly to the mechanics of criminal investigation.<\/span><\/p>\n<p data-start=\"6197\" data-end=\"6505\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The educational objective therefore went beyond compliance with a catalogue of rules. It sought a change in professional perspective: <strong data-start=\"6331\" data-end=\"6505\">from seeing suspects\u2019 rights as limitations imposed upon policing to understanding them as part of the rule-of-law framework within which legitimate policing takes place.\u00a0<\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In this sense, the tactic rested on a dual conception of the police officer: <strong data-start=\"6584\" data-end=\"6651\">both a bearer of rights and a guardian of the rights of others.<\/strong> Once those roles are understood together, respect for procedural protections no longer needs to be framed as being in tension with effective law enforcement. It becomes part of what distinguishes the lawful exercise of public authority from its abuse.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. Challenging Misconceptions About Policing and Suspects\u2019 Rights<\/span><\/h3>\n<p data-start=\"107\" data-end=\"394\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The tactic did not emerge from an assumption that future police officers simply needed more information about human rights. It addressed a more difficult educational problem: <strong data-start=\"282\" data-end=\"394\">how to challenge entrenched perceptions about crime control, police authority and the status of the suspect.\u00a0<\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Through sustained interaction with his students, <a href=\"https:\/\/www.bicakhukuk.com\/en\/team\/attorneys-2\/prof-dr-vahit-bicak\/\" target=\"_blank\" rel=\"noopener\">Prof. Dr. Vahit B\u0131\u00e7ak<\/a> identified recurring assumptions that made the internalisation of rights-based standards more difficult. These included the belief that respect for individual rights could restrict effective crime control; that policing resembled a \u201c<em>war<\/em>\u201d against crime in which legal constraints weakened those expected to conduct that fight; and that police dealt essentially with criminals, making coercion or pressure against suspects appear compatible with ordinary police work.<\/span><\/p>\n<p data-start=\"972\" data-end=\"1504\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">These perceptions revealed a problem deeper than unfamiliarity with legal doctrine. If a person under investigation is already mentally classified as a criminal, procedural protections can appear unnecessary or even obstructive. The educational challenge was therefore to reconnect police powers with a foundational principle of criminal justice: <strong data-start=\"1319\" data-end=\"1504\">a suspect is not synonymous with a convicted offender, and investigative authority must operate within legal safeguards precisely because guilt has yet to be judicially established.<\/strong><\/span><\/p>\n<p data-start=\"1506\" data-end=\"2041\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">B\u0131\u00e7ak also observed doubts about accountability itself. The project materials record perceptions that the sanctions attached to rights violations were insufficiently understood, that existing sanctions might not operate effectively in practice and that officials who exceeded their authority were not necessarily thought to suffer adverse consequences. Such attitudes reinforced the need for a method capable of demonstrating that the limits placed on public authority were not merely theoretical. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The response was not to replace conventional legal education, but to make it more concrete.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.1. From General Principles to Procedural Safeguards<\/span><\/h4>\n<p data-start=\"2190\" data-end=\"2555\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A defining feature of the initiative was the translation of broad principles into specific decisions that police officers might face during an investigation. The questionnaire administered at the beginning and end of the academic year addressed ten practical safeguards concerning the treatment of suspects and accused persons. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Students were asked, for example, whether a suspect should be informed of the <strong data-start=\"2635\" data-end=\"2661\">right to remain silent<\/strong> and the <strong data-start=\"2670\" data-end=\"2696\">right to legal counsel<\/strong> before questioning. Other questions concerned notifying a relative of the place of detention, communicating the reasons for arrest or custody, allowing the presentation of exculpatory evidence and providing access to medical examination capable of identifying possible ill-treatment. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The questionnaire also examined the practical relationship between lawyer and suspect: confidential consultation with counsel, the lawyer\u2019s presence when a statement was taken, access to legal assistance during questioning and counsel\u2019s participation in the statement record.<\/span><\/p>\n<p data-start=\"3335\" data-end=\"3639\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The significance of these questions lies in their practical orientation. Students were not simply being asked whether they endorsed \u201c<em>human rights<\/em>\u201d in the abstract. Their attitudes were tested against <strong data-start=\"3535\" data-end=\"3638\">the procedural mechanisms through which those rights become effective during criminal investigation<\/strong>.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This practical focus was reinforced by the wider curriculum. Although Human Rights had been taught as a separate subject at the Faculty since 1992, the tactic was also integrated into <strong data-start=\"3825\" data-end=\"3868\">Criminal Law and Criminal Procedure Law<\/strong>, with the relevant courses extending throughout the academic year.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Human rights were therefore not presented as an ethical layer imposed upon police work from outside the criminal justice system. They were connected directly to the legal framework governing investigative powers.<\/span><\/p>\n<h4 data-section-id=\"1srju0t\" data-start=\"4189\" data-end=\"4221\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.2. Reframing Effective Policing<\/span><\/h4>\n<p data-start=\"4223\" data-end=\"4356\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">At the heart of the experiment was a reconsideration of the supposed tension between individual rights and effective law enforcement.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The misconception identified in the project presented a binary choice: <strong data-start=\"4429\" data-end=\"4493\">either protect individual rights or fight crime effectively.<\/strong> B\u0131\u00e7ak\u2019s approach challenged that premise. Rights-compliant investigation was not presented as an alternative to effective policing, but as the framework within which legitimate investigative authority should operate.<\/span><\/p>\n<p data-start=\"4712\" data-end=\"4872\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For future officers, understanding this required more than memorising prohibited conduct. It required reconsidering what lawful and professional policing meant. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yet conventional classroom discussion had limits. Students could understand the applicable rules intellectually while continuing to regard personal accountability as remote. The project therefore confronted another important assumption: <strong data-start=\"5111\" data-end=\"5256\">the possibility that police officers themselves might become suspects or defendants had largely been excluded from the students\u2019 perspective. <\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Students expressed an interest in observing court proceedings, but routinely taking groups of police candidates into courtrooms was technically difficult. That practical constraint produced the idea that would become the tactic\u2019s defining feature: <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong data-start=\"5507\" data-end=\"5622\" data-is-last-node=\"\">if the students could not readily be taken to the courtroom, the courtroom could be brought into the classroom.<\/strong><\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. Bringing the Courtroom into the Classroom<\/span><\/h3>\n<p data-start=\"87\" data-end=\"484\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The defining feature of the tactic emerged from a practical educational problem. Students wanted greater exposure to judicial proceedings, yet routinely taking groups of police candidates into courtrooms was neither straightforward nor sustainable. The alternative was conceptually simple: <strong data-start=\"377\" data-end=\"484\">if the students could not be taken to the courtroom, the courtroom could be brought into the classroom.\u00a0<\/strong><\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This transformed the initiative from conventional instruction in human rights and criminal procedure into a form of experiential learning. Instead of encountering accountability only through legislation, textbooks or hypothetical cases, students would see actual police officers appearing before a court in proceedings concerning alleged human rights violations.<\/span><\/p>\n<h4 data-section-id=\"1wg65ly\" data-start=\"850\" data-end=\"899\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.1. Turning Real Proceedings into a Teaching Tool<\/span><\/h4>\n<p data-start=\"901\" data-end=\"1324\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">With the cooperation of the Turkish Police Academy\u2019s television unit, Akademi TV, proceedings involving police officers prosecuted in connection with human rights violations were recorded. The project materials place the filming in <strong data-start=\"1133\" data-end=\"1150\">1995 and 1996<\/strong>, with the relevant trial extending over approximately one year. The resulting material amounted to ten videotapes of courtroom footage. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The recordings alone, however, did not constitute an effective teaching resource. Complete proceedings were too extensive for classroom use and contained substantially more material than the educational objective required. B\u0131\u00e7ak reviewed the footage and identified the portions most relevant to the training. The ten tapes were then condensed into an approximately <strong data-start=\"1691\" data-end=\"1709\">90-minute film<\/strong>, with the editing process taking about a week.<\/span><\/p>\n<p data-start=\"1796\" data-end=\"2295\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The significance of the exercise lay less in the technology than in what the footage made visible. A proposition such as <em data-start=\"1917\" data-end=\"1991\">\u201ca police officer who violates human rights may face legal consequences\u201d<\/em> can remain abstract when communicated in a lecture. A real courtroom proceeding changes its character. Students could see members of the profession they were preparing to enter occupying the position of defendants and observe allegations concerning police authority being subjected to judicial scrutiny.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The relationship between law and consequence became tangible: <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong data-start=\"2360\" data-end=\"2446\">legal norm \u2192 professional conduct \u2192 judicial scrutiny \u2192 individual accountability.<\/strong><\/span><\/p>\n<h4 data-section-id=\"cl5prp\" data-start=\"2448\" data-end=\"2490\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.2. An Approach Shaped Through Interaction<\/span><\/h4>\n<p data-start=\"2492\" data-end=\"2848\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The tactic was not designed as a fully formed institutional programme and then imposed upon students. B\u0131\u00e7ak\u2019s account describes an approach that evolved through years of interaction with those he taught. This experience helped identify recurring misconceptions, sources of resistance and the forms of teaching capable of engaging students more effectively. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The detailed project materials reinforce this bottom-up character. Students encouraged greater use of visual material; the institutional environment afforded the instructor flexibility in selecting teaching methods; B\u0131\u00e7ak identified the proceedings to be recorded and requested the assistance of Akademi TV; and he subsequently reviewed the footage to determine what should be retained for classroom use. <\/span><\/p>\n<p data-start=\"2492\" data-end=\"2848\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The methodology therefore developed through a combination of <strong data-start=\"3355\" data-end=\"3447\">classroom observation, student engagement, academic initiative and institutional support<\/strong>. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This feature is significant because educational innovation does not always originate in a large reform programme. It can begin with an educator identifying a recurring practical problem, testing a different method and refining it through experience.<\/span><\/p>\n<h4 data-section-id=\"1mztgl4\" data-start=\"3701\" data-end=\"3742\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.3. Innovation Without a Dedicated Budget<\/span><\/h4>\n<p data-start=\"3744\" data-end=\"4224\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The project was also modest in material terms. The dossier records that there was <strong data-start=\"3826\" data-end=\"3849\">no dedicated budget<\/strong> for developing the tactic. The recording and preparation of the video and the development of the questionnaire did not depend on a specially funded programme. Existing personnel and technical resources were used, while classrooms already equipped with televisions and video players enabled the material to be incorporated into teaching.<\/span><\/p>\n<p data-start=\"4226\" data-end=\"4453\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The project materials identify four characteristics that contributed to support for the initiative: it was considered <strong data-start=\"4344\" data-end=\"4414\">original, beneficial, relatively easy to implement and inexpensive<\/strong>.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The broader lesson is not that institutional innovation should be inexpensive, but that its value need not depend upon technological or financial complexity. Here, the principal innovation lay in <strong data-start=\"4651\" data-end=\"4743\">how existing resources were combined to address a clearly identified educational problem<\/strong>.<\/span><\/p>\n<h4 data-section-id=\"19c6b4c\" data-start=\"4746\" data-end=\"4779\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.4. Making Accountability Visible<\/span><\/h4>\n<p data-start=\"4781\" data-end=\"5050\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The footage also addressed perceptions that sanctions for rights violations were remote or ineffective. Seeing police officers subjected to judicial proceedings made accountability visible in a way that a description of criminal liability could not necessarily achieve. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yet the objective was not simply to deter future officers through the prospect of prosecution. If deterrence had been the sole purpose, the lesson could have ended with the legal consequences displayed on screen. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">B\u0131\u00e7ak\u2019s method went further.
