Introduction<\/span><\/h3>\n<p data-start=\"173\" data-end=\"635\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Embassies, consulates, international organisations and other foreign representations operating in T\u00fcrkiye frequently employ locally recruited personnel to carry out administrative, technical, translation, communications, security, maintenance, driving, accounting and support functions. These employees may work within an international or diplomatic environment, but their employment relationships should not be treated as legally detached from the host country. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">As a general rule, Turkish nationals and third-country nationals lawfully residing and working in T\u00fcrkiye who are recruited locally by a foreign mission are subject to Turkish employment legislation. The Turkish Ministry of Foreign Affairs has expressly stated that locally employed personnel working for foreign missions accredited to T\u00fcrkiye are governed by Turkish labour law. The Ministry also expects missions to notify it of local appointments by providing the relevant employment contract and evidence of social security coverage, and to maintain an updated list of locally employed staff.<\/span><\/p>\n<p data-start=\"1273\" data-end=\"1770\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The diplomatic character of the employer nevertheless introduces legal issues that are not normally encountered in ordinary employment relationships. These include the correct identification of the employer, diplomatic and state immunity, service of legal documents, the enforcement of judgments, access to mission premises, confidentiality, national security, foreign-law clauses, privileges granted under host-country agreements and the distinction between sovereign and non-sovereign functions. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Local employment by an embassy is therefore neither an entirely ordinary private employment relationship nor an area in which the mission may simply rely on its international status. It requires the coordinated application of Turkish employment law, social security law, private international law, diplomatic law, data-protection rules and the specific international instruments applicable to the relevant mission or organisation. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This guide explains the principal legal issues that embassies, consulates, diplomatic missions, international organisations and locally recruited personnel should consider when establishing, managing or terminating an employment relationship in T\u00fcrkiye.<\/span><\/p>\n<h3 data-section-id=\"s7mj20\" data-start=\"2464\" data-end=\"2511\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2. Who Is Considered Locally Employed Staff?<\/span><\/h3>\n<p data-start=\"2513\" data-end=\"2698\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Locally employed staff are generally individuals recruited in T\u00fcrkiye to perform work for a foreign mission, consular post, international organisation or comparable representative body. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">They commonly include:<\/span><\/p>\n<ul data-start=\"2724\" data-end=\"3138\">\n<li data-section-id=\"uibuug\" data-start=\"2724\" data-end=\"2752\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">administrative assistants;<\/span><\/li>\n<li data-section-id=\"10oc4g6\" data-start=\"2753\" data-end=\"2784\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">translators and interpreters;<\/span><\/li>\n<li data-section-id=\"d1jur1\" data-start=\"2785\" data-end=\"2823\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">secretaries and reception personnel;<\/span><\/li>\n<li data-section-id=\"18rkgvz\" data-start=\"2824\" data-end=\"2856\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">accountants and finance staff;<\/span><\/li>\n<li data-section-id=\"p9rr1a\" data-start=\"2857\" data-end=\"2867\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">drivers;<\/span><\/li>\n<li data-section-id=\"19irp6s\" data-start=\"2868\" data-end=\"2906\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">maintenance and technical personnel;<\/span><\/li>\n<li data-section-id=\"m67rx3\" data-start=\"2907\" data-end=\"2937\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">local advisers and analysts;<\/span><\/li>\n<li data-section-id=\"u4j6ou\" data-start=\"2938\" data-end=\"2992\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">communications and information-technology personnel;<\/span><\/li>\n<li data-section-id=\"1sti6zq\" data-start=\"2993\" data-end=\"3029\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">security and access-control staff;<\/span><\/li>\n<li data-section-id=\"6341so\" data-start=\"3030\" data-end=\"3084\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">cleaners, gardeners and other support personnel; and<\/span><\/li>\n<li data-section-id=\"1dlojc7\" data-start=\"3085\" data-end=\"3138\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">cultural, commercial or public-relations employees.<\/span><\/li>\n<\/ul>\n<p data-start=\"3140\" data-end=\"3626\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For the purposes of the Turkish Ministry of Foreign Affairs\u2019 procedures, local staff may include Turkish nationals and third-country nationals holding a valid residence status. The Ministry requires diplomatic missions, consular posts and international organisations employing such personnel to provide the employment contract and documentation showing social security coverage. Missions are also expected to keep their local-staff records updated. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A locally recruited employee should be distinguished from:<\/span><\/p>\n<ul data-start=\"3688\" data-end=\"4211\">\n<li data-section-id=\"1ttla0n\" data-start=\"3688\" data-end=\"3737\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a diplomatic agent posted by the sending state;<\/span><\/li>\n<li data-section-id=\"1kwgmu3\" data-start=\"3738\" data-end=\"3759\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a consular officer;<\/span><\/li>\n<li data-section-id=\"1esp0hd\" data-start=\"3760\" data-end=\"3830\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a member of the administrative and technical staff sent from abroad;<\/span><\/li>\n<li data-section-id=\"34e5tb\" data-start=\"3831\" data-end=\"3898\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a member of the service staff enjoying recognised mission status;<\/span><\/li>\n<li data-section-id=\"1dglj5k\" data-start=\"3899\" data-end=\"3970\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a civil servant of the sending state temporarily assigned to T\u00fcrkiye;<\/span><\/li>\n<li data-section-id=\"19wo42j\" data-start=\"3971\" data-end=\"4040\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a secondee whose legal status is governed by a bilateral agreement;<\/span><\/li>\n<li data-section-id=\"1g6pzw1\" data-start=\"4041\" data-end=\"4121\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a private servant personally employed by a diplomatic or consular officer; and<\/span><\/li>\n<li data-section-id=\"1burz9\" data-start=\"4122\" data-end=\"4211\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">an independent contractor providing services through a separate commercial arrangement.<\/span><\/li>\n<\/ul>\n<p data-start=\"4213\" data-end=\"4483\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The employee\u2019s job title is not conclusive. The authorities and courts may examine the actual recruitment process, residence status, payroll arrangements, functions, reporting lines, workplace, social security registration and the degree of integration into the mission. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Calling an employee a \u201cconsultant,\u201d \u201c<em>freelancer<\/em>\u201d or \u201c<em>service provider<\/em>\u201d will not necessarily prevent the relationship from being classified as employment where the individual works personally, continuously and under the direction and control of the mission.<\/span><\/p>\n<h3 data-section-id=\"10628rq\" data-start=\"4748\" data-end=\"4785\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. Which Institutions Are Covered?<\/span><\/h3>\n<p data-start=\"4787\" data-end=\"4918\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The legal framework discussed in this guide is relevant not only to embassies. It may also apply, with necessary modifications, to:<\/span><\/p>\n<ul data-start=\"4920\" data-end=\"5364\">\n<li data-section-id=\"82j7qm\" data-start=\"4920\" data-end=\"4956\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">consulates and consulates general;<\/span><\/li>\n<li data-section-id=\"2rb5rv\" data-start=\"4957\" data-end=\"4985\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">permanent representations;<\/span><\/li>\n<li data-section-id=\"1dtuj1k\" data-start=\"4986\" data-end=\"5016\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">international organisations;<\/span><\/li>\n<li data-section-id=\"1k6ihet\" data-start=\"5017\" data-end=\"5043\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">United Nations agencies;<\/span><\/li>\n<li data-section-id=\"1nhtr6l\" data-start=\"5044\" data-end=\"5081\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">European and regional institutions;<\/span><\/li>\n<li data-section-id=\"dci77h\" data-start=\"5082\" data-end=\"5104\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">cultural institutes;<\/span><\/li>\n<li data-section-id=\"w4xx64\" data-start=\"5105\" data-end=\"5136\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">trade and investment offices;<\/span><\/li>\n<li data-section-id=\"j4h03v\" data-start=\"5137\" data-end=\"5180\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">defence, liaison and cooperation offices;<\/span><\/li>\n<li data-section-id=\"y5exsq\" data-start=\"5181\" data-end=\"5232\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">foreign-government agencies operating in T\u00fcrkiye;<\/span><\/li>\n<li data-section-id=\"7v3dtk\" data-start=\"5233\" data-end=\"5303\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">representative offices benefiting from privileges or immunities; and<\/span><\/li>\n<li data-section-id=\"1xfsil3\" data-start=\"5304\" data-end=\"5364\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">diplomatic residences employing staff through the mission.<\/span><\/li>\n<\/ul>\n<p data-start=\"5366\" data-end=\"5641\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The legal position of an international organisation may differ from that of a foreign state. Its privileges and immunities may arise from a founding treaty, headquarters agreement, host-country agreement, domestic implementing legislation or another international instrument.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Accordingly, the employment status of personnel working for an international organisation must be assessed against the particular legal regime applicable to that organisation. The rules governing one organisation should not automatically be applied to another.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Turkish Ministry of Foreign Affairs explains that the privileges and immunities applicable in T\u00fcrkiye derive from the <a href=\"https:\/\/legal.un.org\/ilc\/texts\/instruments\/english\/conventions\/9_1_1961.pdf\" target=\"_blank\" rel=\"noopener\">1961 Vienna Convention on Diplomatic Relations<\/a>, the 1<a href=\"https:\/\/www.bicakhukuk.com\/en\/buying-and-selling-diplomatic-vehicles-in-turkiye\/\" target=\"_blank\" rel=\"noopener\">963 Vienna Convention on Consular Relations, relevant United Nations conventions<\/a>, host-country agreements, Turkish law and the principle of reciprocity. It also notes that its diplomatic guide is intended as general guidance rather than a substitute for the governing legal instruments and circular notes.<\/span><\/p>\n<h3 data-section-id=\"hy1kb2\" data-start=\"6430\" data-end=\"6470\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. Does Turkish Employment Law Apply?<\/span><\/h3>\n<p data-start=\"6472\" data-end=\"6605\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The central principle is clear: locally recruited personnel working in T\u00fcrkiye will generally be protected by Turkish employment law.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In its circular note concerning local employment, the Turkish Ministry of Foreign Affairs stated that Turkish nationals and third-country nationals holding valid residence status who are employed by foreign missions accredited to T\u00fcrkiye are subject to Labour Law No. 4857. It further stated that administrative-technical and service staff may also fall within Turkish employment law unless otherwise provided by bilateral or multilateral agreements.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The practical consequence is that a mission employing local staff should normally consider, among other matters:<\/span><\/p>\n<ul data-start=\"7211\" data-end=\"7723\">\n<li data-section-id=\"1ir5x64\" data-start=\"7211\" data-end=\"7261\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the form and content of the employment contract;<\/span><\/li>\n<li data-section-id=\"18helmo\" data-start=\"7262\" data-end=\"7330\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the distinction between fixed-term and indefinite-term employment;<\/span><\/li>\n<li data-section-id=\"kn9641\" data-start=\"7331\" data-end=\"7360\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">working hours and overtime;<\/span><\/li>\n<li data-section-id=\"1qa3362\" data-start=\"7361\" data-end=\"7375\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">weekly rest;<\/span><\/li>\n<li data-section-id=\"1b8080d\" data-start=\"7376\" data-end=\"7396\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">annual paid leave;<\/span><\/li>\n<li data-section-id=\"cc0s7z\" data-start=\"7397\" data-end=\"7415\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">public holidays;<\/span><\/li>\n<li data-section-id=\"1p9xzk8\" data-start=\"7416\" data-end=\"7438\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">salary and benefits;<\/span><\/li>\n<li data-section-id=\"d7dgzn\" data-start=\"7439\" data-end=\"7480\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">equal treatment and non-discrimination;<\/span><\/li>\n<li data-section-id=\"mz6tdu\" data-start=\"7481\" data-end=\"7514\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">occupational health and safety;<\/span><\/li>\n<li data-section-id=\"oot6jh\" data-start=\"7515\" data-end=\"7539\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">disciplinary measures;<\/span><\/li>\n<li data-section-id=\"1ati249\" data-start=\"7540\" data-end=\"7565\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">termination procedures;<\/span><\/li>\n<li data-section-id=\"yoqt1b\" data-start=\"7566\" data-end=\"7583\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">notice periods;<\/span><\/li>\n<li data-section-id=\"bl170o\" data-start=\"7584\" data-end=\"7620\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">severance and notice compensation;<\/span><\/li>\n<li data-section-id=\"17s2uet\" data-start=\"7621\" data-end=\"7646\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">reinstatement exposure;<\/span><\/li>\n<li data-section-id=\"fodys7\" data-start=\"7647\" data-end=\"7673\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">mandatory mediation; and<\/span><\/li>\n<li data-section-id=\"1asz0ck\" data-start=\"7674\" data-end=\"7723\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">social security registration and contributions.<\/span><\/li>\n<\/ul>\n<p data-start=\"7725\" data-end=\"8021\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The application of Turkish labour law does not mean that diplomatic or international-law considerations become irrelevant. It means that the mission must examine those considerations alongside the employee\u2019s mandatory protections under the law of the place where the work is habitually performed.<\/span><\/p>\n<h3 data-section-id=\"15ehwll\" data-start=\"8028\" data-end=\"8066\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5. Identifying the Correct Employer<\/span><\/h3>\n<p data-start=\"8068\" data-end=\"8161\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">One of the first questions in any local employment arrangement is: who is the legal employer? <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Possible formulations include:<\/span><\/p>\n<ul data-start=\"8195\" data-end=\"8493\">\n<li data-section-id=\"1coc6ew\" data-start=\"8195\" data-end=\"8209\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the embassy;<\/span><\/li>\n<li data-section-id=\"13jt6ts\" data-start=\"8210\" data-end=\"8257\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the sending state acting through its embassy;<\/span><\/li>\n<li data-section-id=\"1vcfu78\" data-start=\"8258\" data-end=\"8282\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the consulate general;<\/span><\/li>\n<li data-section-id=\"tgzplz\" data-start=\"8283\" data-end=\"8344\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a ministry or governmental department of the sending state;<\/span><\/li>\n<li data-section-id=\"vtn378\" data-start=\"8345\" data-end=\"8377\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">an international organisation;<\/span><\/li>\n<li data-section-id=\"xm96q5\" data-start=\"8378\" data-end=\"8407\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a cultural or trade office;<\/span><\/li>\n<li data-section-id=\"8skdhb\" data-start=\"8408\" data-end=\"8443\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a separate local legal entity; or<\/span><\/li>\n<li data-section-id=\"1eh21is\" data-start=\"8444\" data-end=\"8493\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">an individual ambassador or diplomatic officer.<\/span><\/li>\n<\/ul>\n<p data-start=\"8495\" data-end=\"8765\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The employment contract should identify the employer accurately and consistently. The name used in the contract should correspond with payroll records, social security declarations, internal authorisations and communications with the Turkish Ministry of Foreign Affairs. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">An embassy is generally not a separate commercial company merely because it operates as an administrative unit. Drafting the contract in the name of an undefined \u201cEmbassy Office\u201d without identifying the state or public authority represented may later create difficulties concerning authority, service of process and responsibility for employment liabilities.<\/span><\/p>\n<p data-start=\"9127\" data-end=\"9340\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The signatory should also have appropriate authority. Ideally, the mission should retain an internal authorisation, delegation or other document showing that the person signing the agreement may bind the employer. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Where the employee works for several units &#8211; for example, the embassy, commercial section and ambassador\u2019s residence &#8211; the contract should specify whether there is a single employer, a principal employer with multiple workplaces or more than one employing entity.<\/span><\/p>\n<h3 data-section-id=\"1vfoe69\" data-start=\"9608\" data-end=\"9645\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">6. Recruitment and Equal Treatment<\/span><\/h3>\n<p data-start=\"9647\" data-end=\"9766\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Recruitment procedures should be organised in a manner that is transparent, documented and consistent with Turkish law.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A mission may reasonably require linguistic ability, security awareness, knowledge of international relations, cultural familiarity, confidentiality and suitability for work in a sensitive environment. The mission\u2019s internal responsibility to respond should not be confused with the procedural status of an individual before local authorities. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A failure to investigate or protect the employee may later become relevant to compensation, termination or discrimination claims.<\/span><\/p>\n<h3 data-section-id=\"1vvnx53\" data-start=\"30164\" data-end=\"30194\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">23. A rule may be important institutionally but may not automatically satisfy the legal test for dismissal without notice or severance. The Ministry of Labour confirms that recurring monetary and measurable benefits may be included when calculating severance pay, subject to the applicable statutory ceiling.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A broad release signed by the employee should not be relied upon without examining the mandatory conditions governing settlement, timing and payment.<\/span><\/p>\n<h3 data-section-id=\"75km00\" data-start=\"33374\" data-end=\"33401\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">26. It may not always be obvious whether only locally employed staff in one mission, all workplaces of the employer in T\u00fcrkiye or a broader organisational structure should be considered. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The mission should therefore assess reinstatement exposure before termination rather than only after a claim is filed.<\/span><\/p>\n<h3 data-section-id=\"8jsggw\" data-start=\"34329\" data-end=\"34355\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">27. Mandatory Mediation<\/span><\/h3>\n<p data-start=\"34357\" data-end=\"34486\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For many employment disputes, an application to mediation is a procedural prerequisite before court proceedings may be initiated.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This includes claims involving employee or employer receivables, compensation and reinstatement. Jurisdiction of Turkish Courts<\/span><\/h3>\n<p data-start=\"35490\" data-end=\"35617\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The involvement of a foreign state does not automatically deprive Turkish courts of jurisdiction over every employment dispute.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Turkish Ministry of Foreign Affairs\u2019 Diplomatic Portal states that employment relations between foreign missions and their locally employed personnel are governed by Turkish labour law and other relevant legislation. It further states that, in employment disputes concerning Turkish nationals or third-country nationals residing in T\u00fcrkiye, missions do not enjoy judicial immunity under Articles 44 and 49 of the Turkish Private International Law Act.<\/span><\/p>\n<p data-start=\"36116\" data-end=\"36331\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Article 44 contains a specific jurisdictional rule for individual employment disputes involving a foreign element. Article 49 reflects the restrictive approach to foreign-state immunity in private-law relationships.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Nevertheless, immunity remains a fact-sensitive issue. Courts may distinguish between:<\/span><\/p>\n<ul data-start=\"36421\" data-end=\"36535\">\n<li data-section-id=\"10xn0ee\" data-start=\"36421\" data-end=\"36471\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ordinary contractual or employment activity; and<\/span><\/li>\n<li data-section-id=\"tvn1u4\" data-start=\"36472\" data-end=\"36535\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">acts closely connected with sovereign governmental authority.<\/span><\/li>\n<\/ul>\n<p data-start=\"36537\" data-end=\"36670\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The employee\u2019s nationality, duties, recruitment method, access to state secrets, status and the relief requested may all be relevant.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A mission should therefore avoid two opposite assumptions:<\/span><\/p>\n<ol data-start=\"36732\" data-end=\"36865\">\n<li data-section-id=\"132uh06\" data-start=\"36732\" data-end=\"36801\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">that diplomatic immunity always prevents an employment claim; or<\/span><\/li>\n<li data-section-id=\"e0v5gr\" data-start=\"36802\" data-end=\"36865\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">that immunity can never apply in a local employment dispute.<\/span><\/li>\n<\/ol>\n<p data-start=\"36867\" data-end=\"36994\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The correct result depends on the applicable legislation, treaty framework, nature of the functions and particular proceedings.<\/span><\/p>\n<h3 data-section-id=\"1crmfmx\" data-start=\"37001\" data-end=\"37062\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">29. State Immunity and the Nature of the Employee\u2019s Duties<\/span><\/h3>\n<p data-start=\"37064\" data-end=\"37152\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Modern state-immunity law generally follows a restrictive rather than absolute approach.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Under this approach, a foreign state may retain immunity for sovereign acts but not necessarily for private, commercial or ordinary employment relationships. The distinction is often expressed through the concepts of:<\/span><\/p>\n<ul data-start=\"37373\" data-end=\"37520\">\n<li data-section-id=\"pkwv37\" data-start=\"37373\" data-end=\"37456\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong data-start=\"37375\" data-end=\"37396\">acta jure imperii<\/strong>: acts performed in the exercise of sovereign authority; and<\/span><\/li>\n<li data-section-id=\"atriad\" data-start=\"37457\" data-end=\"37520\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong data-start=\"37459\" data-end=\"37482\">acta jure gestionis<\/strong>: private or non-sovereign activities.<\/span><\/li>\n<\/ul>\n<p data-start=\"37522\" data-end=\"37638\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In employment disputes, the employee\u2019s actual duties may be more important than the formal identity of the employer.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Functions involving diplomatic policy, public authority, defence, national security, intelligence or core governmental decision-making may support a stronger immunity argument than routine administrative, technical or support work.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The European Court of Human Rights has examined restrictions on access to court in several embassy-employment cases. In <em data-start=\"37993\" data-end=\"38013\">Cudak v. Lithuania<\/em>, the dispute concerned a locally recruited embassy employee whose wrongful-dismissal action had been rejected on state-immunity grounds. The Court\u2019s case law recognises that state immunity may pursue a legitimate aim, but it also requires the restriction on access to a court to reflect generally recognised rules of international law and to remain proportionate. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The broader European jurisprudence demonstrates that courts should not grant immunity merely because the employer is an embassy. They should examine the employee\u2019s functions and the international-law basis for any restriction.<\/span><\/p>\n<h3 data-section-id=\"ne0ltx\" data-start=\"38652\" data-end=\"38712\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">30. Diplomatic Immunity Is Not the Same as State Immunity<\/span><\/h3>\n<p data-start=\"38714\" data-end=\"38771\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Several related but distinct concepts are often confused.<\/span><\/p>\n<p data-section-id=\"i9a7uk\" data-start=\"38773\" data-end=\"38796\"><strong><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Diplomatic immunity:\u00a0<\/span><\/strong><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Diplomatic immunity primarily protects diplomatic agents and mission functions under the Vienna Convention on Diplomatic Relations.<\/span><\/p>\n<p data-section-id=\"5m6gcn\" data-start=\"38931\" data-end=\"38949\"><strong><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">State immunity: <\/span><\/strong><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">State immunity concerns whether a foreign state may be sued before the courts of another state.<\/span><\/p>\n<p data-section-id=\"2n3yyq\" data-start=\"39048\" data-end=\"39077\"><strong><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Immunity from enforcement<\/span><\/strong><\/p>\n<p data-start=\"39079\" data-end=\"39215\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Even where a court may hear a claim and issue a judgment, separate restrictions may apply to enforcement against foreign-state property.<\/span><\/p>\n<p data-section-id=\"dlm0u4\" data-start=\"39217\" data-end=\"39254\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Inviolability of mission premises<\/strong>:\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Mission premises, archives and certain property enjoy special protection. A court\u2019s jurisdiction over an employment claim does not necessarily authorise enforcement officers to enter embassy premises or seize protected property.<\/span><\/p>\n<p data-start=\"39486\" data-end=\"39631\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">These distinctions are essential. The absence of jurisdictional immunity does not automatically mean that all forms of enforcement are available.<\/span><\/p>\n<h3 data-section-id=\"d5napv\" data-start=\"39638\" data-end=\"39671\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">31. Service of Legal Documents<\/span><\/h3>\n<p data-start=\"39673\" data-end=\"39776\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Service of court or mediation documents on a foreign mission may require special diplomatic procedures.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Turkish Ministry of Foreign Affairs states that service on missions should be conducted through the Ministry. It also emphasises that the Ministry does not interfere with the merits of the proceedings and recommends that foreign missions submit objections on time and follow the process directly or through legal counsel.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A mission should not ignore a document merely because it was not delivered in the same manner as an ordinary domestic corporate notice. It should promptly determine:<\/span><\/p>\n<ul data-start=\"40312\" data-end=\"40593\">\n<li data-section-id=\"157miwc\" data-start=\"40312\" data-end=\"40341\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the nature of the document;<\/span><\/li>\n<li data-section-id=\"5m74gu\" data-start=\"40342\" data-end=\"40375\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the date and method of service;<\/span><\/li>\n<li data-section-id=\"pmw8lf\" data-start=\"40376\" data-end=\"40400\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the response deadline;<\/span><\/li>\n<li data-section-id=\"ypzbdx\" data-start=\"40401\" data-end=\"40446\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether an immunity objection is available;<\/span><\/li>\n<li data-section-id=\"o332a8\" data-start=\"40447\" data-end=\"40491\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether local counsel should be appointed;<\/span><\/li>\n<li data-section-id=\"15q6f1h\" data-start=\"40492\" data-end=\"40539\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether mediation attendance is required; and<\/span><\/li>\n<li data-section-id=\"13grpfr\" data-start=\"40540\" data-end=\"40593\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">which internal authority must approve the response.<\/span><\/li>\n<\/ul>\n<p data-start=\"40595\" data-end=\"40641\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Delay may result in loss of procedural rights.<\/span><\/p>\n<h3 data-section-id=\"lvqdyx\" data-start=\"40648\" data-end=\"40679\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">32. Enforcement of Judgments<\/span><\/h3>\n<p data-start=\"40681\" data-end=\"40741\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Enforcement is often more complex than obtaining a judgment. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Foreign-state property used for diplomatic, consular, military or sovereign purposes may benefit from separate enforcement protections. Mission premises, archives, official bank accounts and property necessary for diplomatic functions may not be treated as ordinary commercial assets. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Accordingly, a claimant who succeeds on the merits may still face legal limitations in identifying assets that may lawfully be subject to enforcement. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Missions should not interpret this as permission to disregard judgments. Failure to comply may create additional legal, financial and diplomatic consequences. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The preferable approach is often to address enforceability during settlement discussions and agree on:<\/span><\/p>\n<ul data-start=\"41445\" data-end=\"41628\">\n<li data-section-id=\"qb8j9q\" data-start=\"41445\" data-end=\"41461\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">payment dates;<\/span><\/li>\n<li data-section-id=\"lrne1a\" data-start=\"41462\" data-end=\"41481\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">payment currency;<\/span><\/li>\n<li data-section-id=\"mm0i1j\" data-start=\"41482\" data-end=\"41497\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">bank details;<\/span><\/li>\n<li data-section-id=\"3rkaey\" data-start=\"41498\" data-end=\"41514\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">tax treatment;<\/span><\/li>\n<li data-section-id=\"1bmwfvj\" data-start=\"41515\" data-end=\"41541\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">consequences of default;<\/span><\/li>\n<li data-section-id=\"1mlv17p\" data-start=\"41542\" data-end=\"41560\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">confidentiality;<\/span><\/li>\n<li data-section-id=\"i5e6wg\" data-start=\"41561\" data-end=\"41594\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">return of mission property; and<\/span><\/li>\n<li data-section-id=\"wy22s8\" data-start=\"41595\" data-end=\"41628\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">closure of pending proceedings.<\/span><\/li>\n<\/ul>\n<h3 data-section-id=\"16kwuk2\" data-start=\"41635\" data-end=\"41655\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">33. Choice of Law<\/span><\/h3>\n<p data-start=\"41657\" data-end=\"41826\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A contract with a foreign mission may contain a clause referring to the law of the sending state. Such a clause must be reviewed under Turkish private international law. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The fact that the contract chooses foreign law does not automatically remove the employee\u2019s protection under mandatory rules connected with the habitual place of work. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye\u2019s Constitutional Court recently annulled part of Article 27 of the Private International Law Act concerning the effect of a choice-of-law clause in employment contracts. The Court reasoned that a choice made in an employment contract should not permit the employee to be deprived of more protective rules of a more closely connected legal system.<\/span><\/p>\n<p data-start=\"42393\" data-end=\"42774\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Constitutional Court has also emphasised that determining the more closely connected law may require consideration of factors such as the parties\u2019 nationalities, language and place of conclusion of the contract, workplace, social security system, residences and the country in which their social and legal relationships are concentrated.<\/span><\/p>\n<p data-start=\"42776\" data-end=\"42974\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For an employee recruited and working in T\u00fcrkiye, paid through a Turkish payroll and registered in the Turkish social security system, the connection with Turkish law will ordinarily be substantial. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A foreign-law clause should therefore not be inserted into a local employment agreement without a detailed conflicts-of-law assessment.<\/span><\/p>\n<h3 data-section-id=\"1v1hpxy\" data-start=\"43118\" data-end=\"43144\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">34. Arbitration Clauses<\/span><\/h3>\n<p data-start=\"43146\" data-end=\"43251\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">An embassy may consider including an arbitration clause, particularly where confidentiality is important.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">However, arbitration is not always appropriate or enforceable for every individual employment dispute. Questions may arise concerning:<\/span><\/p>\n<ul data-start=\"43389\" data-end=\"43574\">\n<li data-section-id=\"16ammmn\" data-start=\"43389\" data-end=\"43405\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">arbitrability;<\/span><\/li>\n<li data-section-id=\"fw9xof\" data-start=\"43406\" data-end=\"43425\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">employee consent;<\/span><\/li>\n<li data-section-id=\"rnml30\" data-start=\"43426\" data-end=\"43465\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">mandatory jurisdictional protections;<\/span><\/li>\n<li data-section-id=\"1bf61aj\" data-start=\"43466\" data-end=\"43474\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">costs;<\/span><\/li>\n<li data-section-id=\"yxskqp\" data-start=\"43475\" data-end=\"43486\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">language;<\/span><\/li>\n<li data-section-id=\"1p19ljy\" data-start=\"43487\" data-end=\"43495\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">venue;<\/span><\/li>\n<li data-section-id=\"5c7ya\" data-start=\"43496\" data-end=\"43513\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">interim relief;<\/span><\/li>\n<li data-section-id=\"plxbmk\" data-start=\"43514\" data-end=\"43532\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">enforcement; and<\/span><\/li>\n<li data-section-id=\"nwqtyd\" data-start=\"43533\" data-end=\"43574\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">compatibility with mandatory mediation.<\/span><\/li>\n<\/ul>\n<p data-start=\"43576\" data-end=\"43721\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A general arbitration clause copied from a commercial contract should not be inserted into an employment agreement without specific legal review. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For many local-employment matters, properly managed mediation followed, where necessary, by proceedings before the competent Turkish labour court may be more practical.\u00a0<\/span><\/p>\n<h3 data-section-id=\"134zasa\" data-start=\"43898\" data-end=\"43961\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">35. International Organisations and Internal Justice Systems<\/span><\/h3>\n<p data-start=\"43963\" data-end=\"44104\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Some international organisations have internal administrative tribunals, grievance mechanisms or staff rules that govern employment disputes.
