Diplomatic vehicles may have been imported free of customs duties or acquired in T\u00fcrkiye under exemptions from Value Added Tax and Special Consumption Tax. They may also be registered in the name of a foreign mission, an international organisation, a diplomat, or a member of the administrative and technical staff. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Consequently, a sale cannot safely be treated as a straightforward agreement between a willing seller and buyer. Before the vehicle can be advertised, sold, delivered or registered in the purchaser\u2019s name, its diplomatic, customs, tax and registration status must be examined.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A properly managed transaction may require prior authorisation from the Turkish Ministry of Foreign Affairs, coordination with the customs administration, payment of applicable taxes and duties, cancellation of diplomatic registration, execution of the relevant transfer documents and completion of ordinary Turkish registration procedures.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This guide explains the principal legal and practical issues arising when embassies, consulates, international organisations, diplomatic personnel or prospective purchasers buy, sell or transfer diplomatic vehicles in T\u00fcrkiye.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">What Is a Diplomatic Vehicle?<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The expression \u201cdiplomatic vehicle\u201d may refer to several legally distinct categories. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A vehicle may belong to:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">an embassy or consulate and be used as an official service vehicle;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">an international organisation or its representation in T\u00fcrkiye;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a diplomatic or consular officer;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a member of the administrative and technical staff of a foreign mission; or<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">another person enjoying a recognised customs or tax exemption.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The legal position of the vehicle depends not only on its diplomatic registration plate but also on its ownership, the manner in which it entered T\u00fcrkiye, the exemption under which it was acquired and the status of its owner.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A vehicle imported into T\u00fcrkiye under a diplomatic exemption document may be subject to different rules from a vehicle purchased from the Turkish domestic market with VAT and Special Consumption Tax exemptions. Likewise, the rules applicable to an official mission vehicle may differ from those governing the privately owned vehicle of a diplomat.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Under the Turkish Ministry of Foreign Affairs\u2019 diplomatic guidance, imported diplomatic vehicles may generally be sold to persons who do not benefit from an exemption and transferred to persons who do benefit from an exemption. The applicable procedure, however, depends on the vehicle category, the owner\u2019s status, reciprocity and the required governmental approvals.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Why Diplomatic Vehicle Transactions Require Special Planning<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The transaction may involve several public and private institutions, including:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the Ministry of Foreign Affairs;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the competent customs administration;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">tax authorities;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">traffic registration authorities;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">notaries;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">insurance companies;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">technical inspection services; and<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">banks or authorised payment service providers.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The transaction may therefore fail or be significantly delayed if the seller advertises and accepts an offer before confirming whether the vehicle is legally eligible for sale. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A diplomatic seller should establish at an early stage:<\/span><\/p>\n<ul>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">who is recorded as the legal owner;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether the vehicle is an official or private vehicle;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether it was imported or purchased domestically;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">which tax or customs exemptions were applied;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether the vehicle is eligible for sale to an ordinary purchaser;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether a minimum period must have elapsed since its acquisition or importation;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">whether the Ministry of Foreign Affairs\u2019 prior permission is required;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">which taxes, duties and registration costs will become payable; and<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">when the diplomatic plates and registration documents must be surrendered.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">This preliminary legal assessment should be completed before the invitation for offers is issued. Otherwise, a mission may accept a bid for a vehicle that cannot yet be lawfully transferred to the intended purchaser.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Official Vehicles and Privately Owned Diplomatic Vehicles<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A distinction must be made between an official service vehicle belonging to a mission and a privately owned vehicle belonging to an individual diplomat or eligible staff member. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Foreign missions may import a reasonable number of service vehicles under diplomatic exemption arrangements, subject to the Ministry of Foreign Affairs\u2019 approval and the principle of reciprocity. Diplomatic mission members and eligible administrative and technical personnel may also import private vehicles or acquire certain vehicles domestically under exemption arrangements.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The conditions governing a later sale may vary. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">For example, the Ministry\u2019s published diplomatic guidance states that permission for the sale of certain private vehicles to persons who do not benefit from an exemption is generally granted after a specified period following importation. A reduced period may apply where the owner is leaving T\u00fcrkiye permanently, while additional restrictions may apply to a vehicle that was already more than three years old when purchased by its diplomatic owner. Service vehicles are subject to separate time and reciprocity conditions. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Accordingly, no general assumption should be made that every diplomatic vehicle can immediately be sold to a Turkish citizen or company.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Preliminary Legal Review Before Advertising the Vehicle<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Before inviting prospective buyers to submit offers, the seller should assemble and review the vehicle file.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The file will ordinarily include:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the diplomatic exemption or franchise document;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the original invoice or purchase document;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">customs import documentation, where applicable;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the traffic registration certificate;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the current compulsory insurance policy;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">technical inspection records;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">service and maintenance records;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the chassis and engine numbers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">any Ministry of Foreign Affairs correspondence;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">documentation relating to previous transfers or renewals; and<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">evidence of the owner\u2019s authority to sell.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The Ministry of Foreign Affairs requires sale permission applications to be submitted through a verbal note accompanied by documents including the relevant import exemption document, a recent insurance policy and a copy of the traffic licence. Sale authorisations are issued for a limited period and may, in certain circumstances, be extended once if an extension is requested before expiry.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The seller should also confirm whether the vehicle has passed the mandatory periodic technical inspection. According to the Ministry\u2019s guidance, technical inspection is compulsory, its fee is not covered by diplomatic exemption, and permissions concerning sale, transfer and re-export are issued only for vehicles that have cleared the required inspection.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Preparing an Invitation for Offers<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A diplomatic mission does not necessarily have to dispose of a vehicle through a public auction. Depending on its internal rules, the mission may choose to collect written offers through a structured bidding process.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A properly drafted invitation for offers should give potential purchasers sufficient information to assess the vehicle while preserving the mission\u2019s discretion and protecting it against avoidable disputes.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The notice should generally identify:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the make and model;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">model year;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">fuel type and engine information;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">mileage;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">colour;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ownership status;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">chassis or VIN information, where appropriate;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">general condition;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">available service history;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">inspection arrangements;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">deadline for submitting offers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">permitted submission methods;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">minimum or reserve price, if any;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">responsibility for taxes and registration expenses;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">payment requirements;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">any deposit requirement;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the seller\u2019s right to reject offers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the proposed completion timetable; and<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">contact details for enquiries and appointments.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">If the vehicle is intended to be sold in its existing condition, the seller may state that it is offered on an \u201cas is, where is\u201d basis. Such wording should not be used as a substitute for truthful disclosure. The seller should not conceal known material defects or provide inaccurate information concerning the vehicle\u2019s history, ownership, tax status or condition.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Legal Nature of the Invitation for Offers<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A key legal distinction must be maintained between an invitation to submit an offer and an offer that is itself capable of immediate acceptance.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A diplomatic vehicle sale announcement will ordinarily be framed as an invitation for prospective buyers to submit bids. In that structure:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the announcement invites offers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">each bidder submits an offer to purchase;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the seller evaluates the offers; and<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the transaction proceeds only when the seller accepts a selected offer in accordance with the announced conditions.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The publication of a vehicle description and deadline should therefore not automatically bind the mission to sell the vehicle to any person who responds. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The bidding conditions should expressly state whether:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the seller is bound to accept the highest bid;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the seller may reject any or all offers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">incomplete or conditional bids will be disregarded;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the process may be extended, cancelled or repeated;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">bidders may withdraw their offers;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">the winning offer remains subject to governmental permission; and<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">final transfer depends on payment of taxes and completion of registration procedures.<\/span><\/li>\n<\/ul>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Choosing the Bidding Method<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Diplomatic missions may adopt different methods for receiving offers. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Common methods include:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">sealed envelopes delivered by hand;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">registered postal submissions;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">email submissions to a designated address;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">submissions through an appointed legal adviser;<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a combination of physical and electronic delivery; or<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">a professionally managed auction or tender.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The chosen process should be clear, consistent and verifiable. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Where sealed envelopes are used, the notice should state how the envelope must be marked and where it must be delivered. The receiving officer should record the date and time of receipt without opening the bid before the deadline.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Where offers are accepted by email, access to the designated inbox should be limited. The mission should determine in advance which timestamp will govern, whether late messages caused by technical problems will be excluded and whether bidders will receive confirmation of receipt.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">An offer submitted by registered post may arrive after the deadline even though it was posted earlier.
