Giri\u015f<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Birle\u015fmi\u015f Milletler \u0130klim De\u011fi\u015fikli\u011fi \u00c7er\u00e7eve S\u00f6zle\u015fmesi (<a href=\"https:\/\/unfccc.int\/process-and-meetings\/united-nations-framework-convention-on-climate-change\" target=\"_blank\" rel=\"noopener\">United Nations Framework Convention on Climate Change<\/a> &#8211; UNFCCC) kapsam\u0131nda d\u00fczenlenen Taraflar Konferans\u0131 (<a href=\"https:\/\/unfccc.int\/process\/bodies\/supreme-bodies\/conference-of-the-parties-cop\" target=\"_blank\" rel=\"noopener\">Conference of the Parties<\/a> &#8211; COP) toplant\u0131lar\u0131, g\u00fcn\u00fcm\u00fczde yaln\u0131zca \u00e7evre politikalar\u0131n\u0131n de\u011fil; uluslararas\u0131 ticaretin, enerji g\u00fcvenli\u011finin, yat\u0131r\u0131m rejimlerinin, teknoloji transferinin ve k\u00fcresel diplomasinin de \u015fekillendi\u011fi en \u00f6nemli platformlardan biri h\u00e2line gelmi\u015ftir. \u00d6zellikle Paris Anla\u015fmas\u0131 sonras\u0131nda iklim de\u011fi\u015fikli\u011fiyle m\u00fccadele, devletlerin yaln\u0131zca \u00e7evresel de\u011fil ayn\u0131 zamanda ekonomik, siyasi ve jeostratejik politikalar\u0131n\u0131n merkezine yerle\u015fmi\u015ftir. Bu \u00e7er\u00e7evede T\u00fcrkiye\u2019nin 2026 y\u0131l\u0131nda ger\u00e7ekle\u015ftirilecek <a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">COP31<\/a>\u2019e ev sahipli\u011fi yapacak olmas\u0131, \u00fclkenin uluslararas\u0131 g\u00f6r\u00fcn\u00fcrl\u00fc\u011f\u00fc ve k\u00fcresel iklim diplomasisindeki rol\u00fc bak\u0131m\u0131ndan tarihsel bir geli\u015fme niteli\u011fi ta\u015f\u0131maktad\u0131r.<\/span><!--more--><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">UNFCCC taraf\u0131ndan yap\u0131lan a\u00e7\u0131klamalara g\u00f6re <a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">COP31 Zirvesi<\/a>, 9-20 Kas\u0131m 2026 tarihleri aras\u0131nda Antalya\u2019da ger\u00e7ekle\u015ftirilecektir. T\u00fcrkiye\u2019nin ev sahipli\u011fi, uzun y\u0131llard\u0131r s\u00fcrd\u00fcrd\u00fc\u011f\u00fc uluslararas\u0131 diplomatik giri\u015fimlerin ve iklim m\u00fczakerelerinde daha g\u00f6r\u00fcn\u00fcr bir akt\u00f6r olma aray\u0131\u015f\u0131n\u0131n sonucu olarak de\u011ferlendirilmektedir. Antalya\u2019n\u0131n se\u00e7ilmesi ise yaln\u0131zca turistik kapasiteyle de\u011fil; lojistik altyap\u0131, uluslararas\u0131 kongre deneyimi, ula\u015f\u0131m a\u011flar\u0131 ve g\u00fcvenlik organizasyonu bak\u0131m\u0131ndan da stratejik bir tercihi ifade etmektedir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP31\u2019in T\u00fcrkiye a\u00e7\u0131s\u0131ndan \u00f6nemini art\u0131ran geli\u015fmelerden biri de<a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2026\/05\/20260522-1.htm\" target=\"_blank\" rel=\"noopener\"> 22 May\u0131s 2026 tarihli Resm\u00ee Gazete<\/a>\u2019de yay\u0131mlanan 7579 say\u0131l\u0131 \u201cT<a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2026\/05\/20260522-1.htm\" target=\"_blank\" rel=\"noopener\">apu Kanunu ile Baz\u0131 Kanunlarda ve 375 Say\u0131l\u0131 Kanun H\u00fckm\u00fcnde Kararnamede De\u011fi\u015fiklik Yap\u0131lmas\u0131na Dair Kanun<\/a>\u201d ile getirilen yeni d\u00fczenlemelerdir. S\u00f6z konusu d\u00fczenleme kapsam\u0131nda 2872 say\u0131l\u0131 \u00c7evre Kanunu\u2019na eklenen Ge\u00e7ici Madde 5 ile COP31 organizasyonuna ili\u015fkin \u00f6nemli vergi, g\u00fcmr\u00fck ve mali muafiyetler tan\u0131nm\u0131\u015ft\u0131r.\u00a0 <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu geli\u015fme, T\u00fcrkiye\u2019nin COP31\u2019i yaln\u0131zca diplomatik bir etkinlik olarak de\u011fil; ayn\u0131 zamanda ekonomik, mali ve y\u00f6netsel a\u00e7\u0131dan \u00f6zel bir uluslararas\u0131 organizasyon stat\u00fcs\u00fcnde ele ald\u0131\u011f\u0131n\u0131 g\u00f6stermektedir. Ger\u00e7ekten de b\u00fcy\u00fck \u00f6l\u00e7ekli k\u00fcresel organizasyonlarda devletlerin organizasyon s\u00fcre\u00e7lerini kolayla\u015ft\u0131rmak amac\u0131yla \u00f6zel hukuk rejimleri olu\u015fturdu\u011fu g\u00f6r\u00fclmektedir. Olimpiyat oyunlar\u0131, EXPO fuarlar\u0131 ve D\u00fcnya Kupas\u0131 gibi mega etkinliklerde de benzer vergi ve g\u00fcmr\u00fck muafiyetleri uygulanmaktad\u0131r. <a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">COP31<\/a> i\u00e7in getirilen d\u00fczenlemeler de bu yakla\u015f\u0131m\u0131n bir uzant\u0131s\u0131 niteli\u011findedir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2. COP Sistemi ve K\u00fcresel \u0130klim Y\u00f6neti\u015fimi<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP sistemi ilk olarak 1992 Rio Zirvesi sonras\u0131nda kabul edilen Birle\u015fmi\u015f Milletler \u0130klim De\u011fi\u015fikli\u011fi \u00c7er\u00e7eve S\u00f6zle\u015fmesi ile ortaya \u00e7\u0131km\u0131\u015ft\u0131r. UNFCCC\u2019nin temel amac\u0131, atmosferdeki sera gaz\u0131 yo\u011funlu\u011funu iklim sistemi \u00fczerinde tehlikeli insan etkisini \u00f6nleyecek seviyede sabitlemektir (<a href=\"https:\/\/unfccc.int\/resource\/docs\/convkp\/conveng.pdf\" target=\"_blank\" rel=\"noopener\">UNFCCC Convention Text<\/a>, 1992). Taraflar Konferans\u0131 toplant\u0131lar\u0131 ise bu hedef do\u011frultusunda taraf devletlerin y\u00fck\u00fcml\u00fcl\u00fcklerini, azalt\u0131m hedeflerini ve finansman mekanizmalar\u0131n\u0131 m\u00fczakere ettikleri temel karar organ\u0131 i\u015flevini g\u00f6rmektedir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2.1. Kyoto Protokol\u00fc ve Paris Anla\u015fmas\u0131\u2019n\u0131n Etkisi<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP toplant\u0131lar\u0131n\u0131n \u00f6nemi \u00f6zellikle <a href=\"https:\/\/iklim.gov.tr\/kyoto-protokolu-i-35\" target=\"_blank\" rel=\"noopener\">Kyoto Protokol\u00fc<\/a> ve <a href=\"https:\/\/iklim.gov.tr\/paris-anlasmasi-i-34\" target=\"_blank\" rel=\"noopener\">Paris Anla\u015fmas\u0131<\/a> sonras\u0131nda daha da artm\u0131\u015ft\u0131r. Kyoto Protokol\u00fc ile geli\u015fmi\u015f \u00fclkeler a\u00e7\u0131s\u0131ndan ba\u011flay\u0131c\u0131 emisyon azalt\u0131m y\u00fck\u00fcml\u00fcl\u00fckleri \u00f6ng\u00f6r\u00fclm\u00fc\u015f; Paris Anla\u015fmas\u0131 ile ise k\u00fcresel s\u0131cakl\u0131k art\u0131\u015f\u0131n\u0131n sanayi \u00f6ncesi d\u00f6neme g\u00f6re 1,5\u00b0C ile s\u0131n\u0131rland\u0131r\u0131lmas\u0131 hedeflenmi\u015ftir (<a href=\"https:\/\/unfccc.int\/process-and-meetings\/the-paris-agreement\" target=\"_blank\" rel=\"noopener\">Paris Agreement<\/a>, 2015). Bununla birlikte Paris Anla\u015fmas\u0131\u2019n\u0131n en dikkat \u00e7ekici y\u00f6nlerinden biri, iklim de\u011fi\u015fikli\u011fiyle m\u00fccadeleyi yaln\u0131zca devlet politikas\u0131 olmaktan \u00e7\u0131kararak \u00f6zel sekt\u00f6r, finans kurulu\u015flar\u0131 ve uluslararas\u0131 yat\u0131r\u0131m sisteminin de merkezine yerle\u015ftirmesidir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2.2. \u0130klim Diplomasisinin Yeni Merkezi<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bug\u00fcn COP toplant\u0131lar\u0131 yaln\u0131zca \u00e7evresel konular\u0131n de\u011fil; karbon piyasalar\u0131n\u0131n, ye\u015fil finansman\u0131n, enerji d\u00f6n\u00fc\u015f\u00fcm\u00fcn\u00fcn, s\u00fcrd\u00fcr\u00fclebilir yat\u0131r\u0131m modellerinin ve uluslararas\u0131 ticaret d\u00fczenlemelerinin tart\u0131\u015f\u0131ld\u0131\u011f\u0131 platformlara d\u00f6n\u00fc\u015fm\u00fc\u015ft\u00fcr. Avrupa Birli\u011fi\u2019nin Karbon S\u0131n\u0131rda D\u00fczenleme Mekanizmas\u0131 (<a href=\"https:\/\/taxation-customs.ec.europa.eu\/carbon-border-adjustment-mechanism_en\" target=\"_blank\" rel=\"noopener\">CBAM<\/a>) gibi uygulamalar\u0131, iklim politikalar\u0131n\u0131n art\u0131k do\u011frudan ticaret hukuku ve rekabet politikalar\u0131yla i\u00e7 i\u00e7e ge\u00e7ti\u011fini g\u00f6stermektedir. Bu nedenle <a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">COP31 Antalya Zirvesi<\/a>\u2019nin T\u00fcrkiye a\u00e7\u0131s\u0131ndan yaln\u0131zca sembolik bir diplomatik ba\u015far\u0131 olarak de\u011fil; ayn\u0131 zamanda ekonomik ve hukuki d\u00f6n\u00fc\u015f\u00fcm s\u00fcrecinin par\u00e7as\u0131 olarak de\u011ferlendirilmesi gerekir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2.3. T\u00fcrkiye\u2019nin COP31 S\u00fcrecindeki Jeopolitik ve Diplomatik Konumu<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye\u2019nin COP31\u2019e ev sahipli\u011fi yapmas\u0131, ayn\u0131 zamanda \u00fclkenin jeopolitik konumuyla da yak\u0131ndan ili\u015fkilidir. T\u00fcrkiye; Avrupa, Orta Do\u011fu, Kafkasya, Afrika ve Asya aras\u0131nda k\u00f6pr\u00fc konumunda bulunan bir \u00fclke olarak enerji g\u00fcvenli\u011fi, g\u00f6\u00e7 hareketleri ve ticaret yollar\u0131 bak\u0131m\u0131ndan kritik bir stratejik role sahiptir. \u00d6zellikle enerji koridorlar\u0131 \u00fczerindeki konumu nedeniyle iklim politikalar\u0131 ve enerji d\u00f6n\u00fc\u015f\u00fcm\u00fc tart\u0131\u015fmalar\u0131nda daha aktif rol alma potansiyeline sahiptir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2.4. \u201cRoad to Antalya\u201d S\u00fcreci<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">UNFCCC taraf\u0131ndan kullan\u0131lan \u201c<a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">Road to Antalya<\/a>\u201d ifadesi de bu s\u00fcrecin yaln\u0131zca teknik bir haz\u0131rl\u0131k de\u011fil; k\u00fcresel iklim diplomasisinin yeni bir a\u015famas\u0131 olarak g\u00f6r\u00fcld\u00fc\u011f\u00fcn\u00fc ortaya koymaktad\u0131r . <a href=\"https:\/\/unfccc.int\/cop31\/the-road-to-antalya\" target=\"_blank\" rel=\"noopener\">COP31<\/a>\u2019in, COP30 sonras\u0131 d\u00f6nemde \u201cuygulama ve finansman\u201d odakl\u0131 bir konferans olmas\u0131 beklenmektedir. \u00d6zellikle geli\u015fmekte olan \u00fclkelerin iklim finansman\u0131 talepleri, kay\u0131p ve zarar fonu, enerji d\u00f6n\u00fc\u015f\u00fcm maliyetleri ve fosil yak\u0131ttan \u00e7\u0131k\u0131\u015f politikalar\u0131 Antalya\u2019daki m\u00fczakerelerin merkezinde yer alacakt\u0131r.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2.5. T\u00fcrkiye\u2019nin \u0130klim Diplomasisindeki Pozisyonu<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye\u2019nin bu s\u00fcre\u00e7te nas\u0131l bir pozisyon alaca\u011f\u0131 \u00f6nemlidir. T\u00fcrkiye bir taraftan geli\u015fmekte olan \u00fclke stat\u00fcs\u00fcn\u00fcn sa\u011flad\u0131\u011f\u0131 finansal avantajlardan yararlanmak istemekte; di\u011fer taraftan Avrupa ile ekonomik entegrasyonunu koruyabilmek amac\u0131yla ye\u015fil d\u00f6n\u00fc\u015f\u00fcm politikalar\u0131n\u0131 h\u0131zland\u0131rmaktad\u0131r. Bu durum, T\u00fcrkiye\u2019nin iklim diplomasisinde hibrit bir pozisyon benimsemesine yol a\u00e7maktad\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. COP31 \u0130\u00e7in Getirilen Yeni Yasal D\u00fczenlemeler<\/span><\/h3>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.1. 22 May\u0131s 2026 Tarihli Kanun De\u011fi\u015fikli\u011fi<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP31 kapsam\u0131nda yap\u0131lan yasal d\u00fczenlemelerin ilk \u00f6nemli boyutu damga vergisi istisnas\u0131d\u0131r. <a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2026\/05\/20260522-1.htm\" target=\"_blank\" rel=\"noopener\">22 May\u0131s 2026 tarihli ve 33261 say\u0131l\u0131 Resm\u00ee Gazete<\/a>\u2019de yay\u0131mlanan <a href=\"https:\/\/www.resmigazete.gov.tr\/eskiler\/2026\/05\/20260522-1.htm\" target=\"_blank\" rel=\"noopener\">7579 say\u0131l\u0131 Kanun ile 2872 say\u0131l\u0131 \u00c7evre Kanunu\u2019na Ge\u00e7ici Madde 5<\/a> eklenmi\u015ftir. Bu d\u00fczenleme ile COP31 organizasyonuna y\u00f6nelik \u00e7ok kapsaml\u0131 mali ve g\u00fcmr\u00fck kolayl\u0131klar\u0131 sa\u011flanm\u0131\u015ft\u0131r.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.2. Damga Vergisi \u0130stisnas\u0131 ve Hukuki Sonu\u00e7lar\u0131<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ge\u00e7ici Madde 5\u2019e g\u00f6re, \u0130klim De\u011fi\u015fikli\u011fi Ba\u015fkanl\u0131\u011f\u0131 veya Ba\u015fkanl\u0131k\u00e7a yetkilendirilen y\u00fcklenicilerin COP31 organizasyonu kapsam\u0131nda ger\u00e7ekle\u015ftirece\u011fi her t\u00fcrl\u00fc mal ve hizmet al\u0131m\u0131, kiralama ve ihale i\u015flemleriyle ilgili d\u00fczenlenen k\u00e2\u011f\u0131tlar damga vergisinden istisna tutulmu\u015ftur. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Damga vergisi, T\u00fcrk vergi sisteminde \u00f6zellikle s\u00f6zle\u015fmeler, ihale belgeleri ve ticari i\u015flemler \u00fczerinde mali y\u00fck olu\u015fturan \u00f6nemli bir vergi t\u00fcr\u00fcd\u00fcr. B\u00fcy\u00fck \u00f6l\u00e7ekli uluslararas\u0131 organizasyonlarda yo\u011fun s\u00f6zle\u015fme trafi\u011fi ve y\u00fcksek hacimli al\u0131mlar d\u00fc\u015f\u00fcn\u00fcld\u00fc\u011f\u00fcnde bu istisnan\u0131n organizasyon maliyetlerini azaltmay\u0131 ama\u00e7lad\u0131\u011f\u0131 a\u00e7\u0131kt\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bununla birlikte bu t\u00fcr muafiyetlerin kamu maliyesi ve kamu ihale hukuku a\u00e7\u0131s\u0131ndan dikkatle de\u011ferlendirilmesi gerekir. \u00d6zellikle \u201cyetkilendirilen y\u00fckleniciler\u201d kavram\u0131n\u0131n kapsam\u0131 \u00f6nem ta\u015f\u0131maktad\u0131r. Bu ifadenin hangi \u015firketleri veya organizasyonlar\u0131 kapsad\u0131\u011f\u0131, y\u00fcklenicilerin se\u00e7ilme usulleri ve denetim mekanizmalar\u0131 ilerleyen s\u00fcre\u00e7te hukuki tart\u0131\u015fmalara konu olabilir. B\u00fcy\u00fck kamu organizasyonlar\u0131nda \u015feffafl\u0131k, hesap verebilirlik ve rekabet ilkeleri, kamu kaynaklar\u0131n\u0131n etkin kullan\u0131m\u0131 a\u00e7\u0131s\u0131ndan temel \u00f6neme sahiptir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.3. G\u00fcmr\u00fck ve \u0130thalat Muafiyetleri<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00fczenlemenin ikinci \u00f6nemli boyutu ise g\u00fcmr\u00fck ve ithalat muafiyetleridir. Ge\u00e7ici Madde 5 uyar\u0131nca COP31 kapsam\u0131nda kullan\u0131lmak \u00fczere ithal edilecek veya ge\u00e7ici ithal edilecek e\u015fya; g\u00fcmr\u00fck vergileri ile ithalatta al\u0131nan her t\u00fcrl\u00fc vergi, resim, har\u00e7 ve fondan istisna tutulmu\u015ftur. Ayr\u0131ca bu e\u015fyalar bak\u0131m\u0131ndan lisans, izin veya uygunluk belgesi aranmayaca\u011f\u0131 belirtilmi\u015ftir. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu d\u00fczenleme, klasik g\u00fcmr\u00fck hukuku bak\u0131m\u0131ndan ola\u011fan\u00fcst\u00fc nitelikte bir \u00f6zel rejim olu\u015fturmaktad\u0131r. Normal ko\u015fullarda ithalat i\u015flemlerinde \u00e7ok say\u0131da teknik mevzuat, uygunluk de\u011ferlendirmesi ve idari izin prosed\u00fcr\u00fc uygulanmaktad\u0131r. Ancak COP31 gibi b\u00fcy\u00fck uluslararas\u0131 organizasyonlarda lojistik s\u00fcre\u00e7lerin h\u0131zland\u0131r\u0131lmas\u0131 amac\u0131yla devletler \u00f6zel muafiyet mekanizmalar\u0131 geli\u015ftirmektedir. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Benzer uygulamalara Olimpiyat oyunlar\u0131nda, EXPO fuarlar\u0131nda ve FIFA D\u00fcnya Kupas\u0131 organizasyonlar\u0131nda da rastlanmaktad\u0131r. \u00d6zellikle ge\u00e7ici ithalat rejimi kapsam\u0131nda teknik ekipmanlar\u0131n, yay\u0131n ara\u00e7lar\u0131n\u0131n, konferans sistemlerinin ve ileti\u015fim altyap\u0131s\u0131n\u0131n h\u0131zl\u0131 bi\u00e7imde \u00fclkeye sokulabilmesi organizasyonun ba\u015far\u0131s\u0131 a\u00e7\u0131s\u0131ndan kritik \u00f6neme sahiptir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.4. G\u00fcvenlik ve Denetim Boyutu<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bununla birlikte lisans ve uygunluk belgesi muafiyetlerinin g\u00fcvenlik ve denetim a\u00e7\u0131s\u0131ndan dikkatli uygulanmas\u0131 gerekir. \u00d6zellikle y\u00fcksek teknoloji \u00fcr\u00fcnleri, haberle\u015fme sistemleri ve enerji ekipmanlar\u0131 bak\u0131m\u0131ndan ulusal g\u00fcvenlik ve teknik standartlar\u0131n korunmas\u0131 \u00f6nem ta\u015f\u0131maktad\u0131r. Kurumlar Vergisi Stopaj Muafiyeti<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">D\u00fczenlemenin \u00fc\u00e7\u00fcnc\u00fc \u00f6nemli boyutu ise kurumlar vergisi stopaj\u0131na ili\u015fkin istisnad\u0131r. Ge\u00e7ici Madde 5\u2019e g\u00f6re, i\u015fyeri ve <strong>kanuni merkezi T\u00fcrkiye\u2019de bulunmayan yabanc\u0131 \u015firketlerden<\/strong> m\u00fcnhas\u0131ran COP31 kapsam\u0131nda al\u0131nan hizmetlere ili\u015fkin \u00f6demeler \u00fczerinden kurumlar vergisi kesintisi yap\u0131lmayacakt\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu d\u00fczenleme \u00f6zellikle uluslararas\u0131 organizasyon \u015firketleri, yabanc\u0131 teknoloji sa\u011flay\u0131c\u0131lar\u0131, medya kurulu\u015flar\u0131 ve lojistik firmalar\u0131 bak\u0131m\u0131ndan \u00f6nemli bir mali avantaj sa\u011flamaktad\u0131r. B\u00fcy\u00fck konferans organizasyonlar\u0131nda \u00e7ok say\u0131da uluslararas\u0131 \u015firketin hizmet sundu\u011fu dikkate al\u0131nd\u0131\u011f\u0131nda, stopaj y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fcn kald\u0131r\u0131lmas\u0131 yabanc\u0131 \u015firketlerin T\u00fcrkiye\u2019de faaliyet g\u00f6stermesini kolayla\u015ft\u0131racakt\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uluslararas\u0131 vergi hukuku bak\u0131m\u0131ndan bu t\u00fcr muafiyetler \u00e7ifte vergilendirmeyi \u00f6nleme anla\u015fmalar\u0131yla da ili\u015fkilidir. Ancak COP31 d\u00fczenlemesi do\u011frudan ulusal mevzuat d\u00fczeyinde genel bir muafiyet getirdi\u011fi i\u00e7in uygulamada \u00f6nemli kolayl\u0131k sa\u011flayacakt\u0131r. \u00d6zellikle k\u0131sa s\u00fcreli hizmet sunumlar\u0131nda vergi prosed\u00fcrlerinin azalt\u0131lmas\u0131 organizasyonel verimlilik bak\u0131m\u0131ndan \u00f6nemlidir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. COP31\u2019in T\u00fcrkiye Ekonomisine Olas\u0131 Etkileri<\/span><\/h3>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.1. Konferans ve Turizm Ekonomisi<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP31\u2019in ekonomik etkileri olduk\u00e7a kapsaml\u0131 olacakt\u0131r. Antalya\u2019n\u0131n milyonlarca dolarl\u0131k konferans ekonomisi yaratmas\u0131 beklenmektedir. Otelcilik, turizm, ula\u015f\u0131m, g\u00fcvenlik, lojistik ve teknoloji sekt\u00f6rleri bu s\u00fcre\u00e7ten do\u011frudan etkilenecektir. On binlerce kat\u0131l\u0131mc\u0131n\u0131n beklendi\u011fi zirve, T\u00fcrkiye\u2019nin kongre turizmi kapasitesini uluslararas\u0131 \u00f6l\u00e7ekte sergileme f\u0131rsat\u0131 sunacakt\u0131r.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4.2. Yabanc\u0131 Yat\u0131r\u0131m ve Finansman Boyutu<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bunun yan\u0131nda COP31\u2019in T\u00fcrkiye\u2019nin uluslararas\u0131 yat\u0131r\u0131m g\u00f6r\u00fcn\u00fcrl\u00fc\u011f\u00fcn\u00fc art\u0131rma potansiyeli bulunmaktad\u0131r. \u0130klim zirveleri art\u0131k yaln\u0131zca devlet temsilcilerinin kat\u0131ld\u0131\u011f\u0131 diplomatik toplant\u0131lar de\u011fil; ayn\u0131 zamanda b\u00fcy\u00fck yat\u0131r\u0131m fonlar\u0131n\u0131n, enerji \u015firketlerinin, teknoloji firmalar\u0131n\u0131n ve uluslararas\u0131 finans kurulu\u015flar\u0131n\u0131n bulu\u015fma platformlar\u0131d\u0131r. Bu nedenle COP31 s\u00fcreci T\u00fcrkiye a\u00e7\u0131s\u0131ndan ye\u015fil yat\u0131r\u0131m \u00e7ekme f\u0131rsat\u0131 da yaratabilir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5. T\u00fcrkiye\u2019nin \u0130klim Politikalar\u0131 A\u00e7\u0131s\u0131ndan COP31<\/span><\/h3>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5.1. Net S\u0131f\u0131r Hedefleri ve Ye\u015fil D\u00f6n\u00fc\u015f\u00fcm<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00c7evre ve iklim politikalar\u0131 bak\u0131m\u0131ndan COP31, T\u00fcrkiye\u2019nin kendi iklim hedeflerini yeniden \u015fekillendirmesi a\u00e7\u0131s\u0131ndan da \u00f6nemli olacakt\u0131r. T\u00fcrkiye 2053 net s\u0131f\u0131r emisyon hedefini a\u00e7\u0131klam\u0131\u015f olmakla birlikte, enerji d\u00f6n\u00fc\u015f\u00fcm\u00fc ve karbon azalt\u0131m\u0131 bak\u0131m\u0131ndan h\u00e2len \u00f6nemli zorluklarla kar\u015f\u0131 kar\u015f\u0131yad\u0131r. \u00d6zellikle k\u00f6m\u00fcr ba\u011f\u0131ml\u0131l\u0131\u011f\u0131, sanayi emisyonlar\u0131 ve ula\u015f\u0131m sekt\u00f6r\u00fc kaynakl\u0131 karbon sal\u0131m\u0131 temel tart\u0131\u015fma alanlar\u0131d\u0131r.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5..2. Avrupa Ye\u015fil Mutabakat\u0131\u2019n\u0131n Etkisi<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Avrupa Birli\u011fi ile ekonomik ili\u015fkiler dikkate al\u0131nd\u0131\u011f\u0131nda ye\u015fil d\u00f6n\u00fc\u015f\u00fcm art\u0131k yaln\u0131zca \u00e7evresel bir tercih de\u011fil; ekonomik zorunluluk h\u00e2line gelmi\u015ftir. Karbon S\u0131n\u0131rda D\u00fczenleme Mekanizmas\u0131 gibi uygulamalar, T\u00fcrk ihracat\u00e7\u0131lar a\u00e7\u0131s\u0131ndan yeni uyum y\u00fck\u00fcml\u00fcl\u00fckleri do\u011furmaktad\u0131r. Bu nedenle COP31\u2019in T\u00fcrkiye\u2019de iklim hukuku ve uyum politikalar\u0131n\u0131n geli\u015fimini h\u0131zland\u0131rmas\u0131 muhtemeldir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">6. COP S\u00fcre\u00e7lerine Y\u00f6nelik Ele\u015ftiriler ve Tart\u0131\u015fmalar<\/span><\/h3>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">6.1. COP Zirvelerinin Etkinli\u011fi Tart\u0131\u015fmas\u0131<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP s\u00fcre\u00e7lerine y\u00f6nelik ele\u015ftiriler de bulunmaktad\u0131r. Bir\u00e7ok akademisyen ve \u00e7evre \u00f6rg\u00fct\u00fc, COP toplant\u0131lar\u0131n\u0131n somut sonu\u00e7 \u00fcretmekte yetersiz kald\u0131\u011f\u0131n\u0131 savunmaktad\u0131r. \u00d6zellikle fosil yak\u0131t kullan\u0131m\u0131n\u0131n azalt\u0131lmas\u0131 konusunda devletler aras\u0131nda ciddi g\u00f6r\u00fc\u015f ayr\u0131l\u0131klar\u0131 bulunmaktad\u0131r. Geli\u015fmi\u015f \u00fclkeler ile geli\u015fmekte olan \u00fclkeler aras\u0131ndaki finansman tart\u0131\u015fmalar\u0131 da m\u00fczakerelerin en sorunlu alanlar\u0131ndan biridir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">6.2. Ba\u011flay\u0131c\u0131l\u0131k Sorunu<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ayr\u0131ca COP toplant\u0131lar\u0131n\u0131n b\u00fcy\u00fck \u00f6l\u00e7\u00fcde \u201c<em>soft law<\/em>\u201d karakteri ta\u015f\u0131mas\u0131, ba\u011flay\u0131c\u0131 yapt\u0131r\u0131m mekanizmalar\u0131n\u0131n s\u0131n\u0131rl\u0131 olmas\u0131 nedeniyle ele\u015ftirilmektedir. Paris Anla\u015fmas\u0131 kapsam\u0131nda devletlerin sundu\u011fu ulusal katk\u0131 beyanlar\u0131n\u0131n (NDC) b\u00fcy\u00fck \u00f6l\u00e7\u00fcde g\u00f6n\u00fcll\u00fcl\u00fck esas\u0131na dayanmas\u0131, uygulamada \u00f6nemli sorunlar yaratmaktad\u0131r.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">6.3. T\u00fcrkiye A\u00e7\u0131s\u0131ndan Olas\u0131 Tart\u0131\u015fmalar<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye a\u00e7\u0131s\u0131ndan da baz\u0131 tart\u0131\u015fmalar g\u00fcndeme gelebilir. \u00d6zellikle enerji politikalar\u0131, k\u00f6m\u00fcr yat\u0131r\u0131mlar\u0131 ve fosil yak\u0131t ba\u011f\u0131ml\u0131l\u0131\u011f\u0131 ba\u011flam\u0131nda T\u00fcrkiye\u2019nin iklim politikalar\u0131n\u0131n yeterlili\u011fi tart\u0131\u015f\u0131lmaktad\u0131r. COP31 s\u00fcrecinin bu tart\u0131\u015fmalar\u0131 daha g\u00f6r\u00fcn\u00fcr h\u00e2le getirmesi muhtemeldir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>7. Sonu\u00e7<\/strong><\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">COP31 Antalya Zirvesi, T\u00fcrkiye a\u00e7\u0131s\u0131ndan yaln\u0131zca uluslararas\u0131 bir konferans organizasyonu de\u011fildir. Bu zirve; \u00e7evre hukuku, uluslararas\u0131 diplomasi, ticaret politikalar\u0131, yat\u0131r\u0131m rejimleri, enerji d\u00f6n\u00fc\u015f\u00fcm\u00fc ve kamu maliyesi bak\u0131m\u0131ndan \u00e7ok boyutlu etkiler do\u011furabilecek tarihsel bir geli\u015fmedir. 22 May\u0131s 2026 tarihli yasal d\u00fczenleme ise devletin bu organizasyona stratejik \u00f6nem atfetti\u011fini a\u00e7\u0131k bi\u00e7imde g\u00f6stermektedir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Getirilen damga vergisi, g\u00fcmr\u00fck ve kurumlar vergisi muafiyetleri; organizasyon s\u00fcre\u00e7lerini kolayla\u015ft\u0131rmay\u0131, uluslararas\u0131 kat\u0131l\u0131m\u0131 art\u0131rmay\u0131 ve lojistik altyap\u0131y\u0131 h\u0131zland\u0131rmay\u0131 ama\u00e7lamaktad\u0131r.
