Yarg\u0131 Paketi\u2019nin yaln\u0131zca teknik bir usul reformu olman\u0131n \u00f6tesinde, yarg\u0131ya duyulan g\u00fcvenin yeniden tesis edilmesi, yarg\u0131lamalar\u0131n h\u0131zland\u0131r\u0131lmas\u0131 ve sistem \u00fczerindeki yakla\u015f\u0131k 12,5 milyon dosya y\u00fck\u00fcn\u00fcn azalt\u0131lmas\u0131 gibi daha geni\u015f bir politika \u00e7er\u00e7evesine oturtuldu\u011funu g\u00f6stermektedir. Yarg\u0131 Paketi\u2019ni do\u011fru okumak i\u00e7in, \u00f6ncelikle bu paketin ne olmad\u0131\u011f\u0131 hususunun netle\u015ftirilmesi gerekir. Kamuoyunda s\u0131k\u00e7a dile getirilen beklentilerin aksine, bu paket ceza hukukuna, infaz rejimine, tutukluluk s\u00fcrelerine veya genel af benzeri d\u00fczenlemelere y\u00f6nelik de\u011fildir. Buna kar\u015f\u0131l\u0131k, hukuk yarg\u0131lamalar\u0131nda ya\u015fanan gecikmeler; m\u00fclkiyet hakk\u0131 ihlalleri, icra s\u00fcre\u00e7lerinin etkisizli\u011fi ve tebligat kaynakl\u0131 usul sorunlar\u0131, yap\u0131sal niteliklerine ra\u011fmen ayn\u0131 \u00f6l\u00e7\u00fcde reform g\u00fcndemine ta\u015f\u0131nmam\u0131\u015ft\u0131r. 12. Birincisi, yarg\u0131laman\u0131n y\u00f6netimidir. Hukuk yarg\u0131lamalar\u0131nda s\u00fcrecin uzamas\u0131na neden olan usul\u00ee al\u0131\u015fkanl\u0131klar, dosya y\u00f6netimi sorunlar\u0131 ve tebligat pratikleri, yaln\u0131zca bireysel h\u00e2kim tercihlerine b\u0131rak\u0131lamayacak kadar sistematik bir sorun alan\u0131 olu\u015fturmaktad\u0131r. \u0130kincisi, haklar\u0131n yarg\u0131lama s\u00fcresince korunmas\u0131d\u0131r. M\u00fclkiyet hakk\u0131 ba\u015fta olmak \u00fczere, bir\u00e7ok temel hak, davan\u0131n sonunda verilen karar kadar, dava s\u00fcresince maruz kal\u0131nan gecikmelerden de etkilenmektedir. \u00dc\u00e7\u00fcnc\u00fcs\u00fc ise, hukuk uygulay\u0131c\u0131lar\u0131n\u0131n rol\u00fcn\u00fcn g\u00fc\u00e7lendirilmesidir. Avukatlar\u0131n bilgi ve belgeye etkin eri\u015fimi ile noterlik sisteminin i\u015fleyi\u015fi, adil yarg\u0131lanma hakk\u0131n\u0131n pratikte hayata ge\u00e7irilmesi bak\u0131m\u0131ndan kritik \u00f6neme sahiptir.<\/span><\/p>\n<p data-start=\"3595\" data-end=\"4019\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u00e7er\u00e7evede 12. Yarg\u0131 Paketi, ceza adaletine ili\u015fkin toplumsal tart\u0131\u015fmalardan bilin\u00e7li bi\u00e7imde uzak durarak, daha teknik ancak uzun vadede daha kal\u0131c\u0131 etkiler do\u011furabilecek bir alana odaklanmaktad\u0131r. Yaz\u0131n\u0131n ilerleyen b\u00f6l\u00fcmlerinde, bu reform mant\u0131\u011f\u0131n\u0131n hukuk yarg\u0131lamalar\u0131n\u0131n s\u00fcresi, m\u00fclkiyet hakk\u0131, tebligat sistemi, avukatl\u0131k mesle\u011fi ve icra hukuku \u00fczerindeki muhtemel etkileri ayr\u0131nt\u0131l\u0131 bi\u00e7imde ele al\u0131nacakt\u0131r.<\/span><\/p>\n<p data-start=\"3595\" data-end=\"4019\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kamuoyunda s\u0131kl\u0131kla dile getirilen \u201c<em>yarg\u0131 g\u00fc\u00e7l\u00fcden yanad\u0131r<\/em>\u201d alg\u0131s\u0131, her ne kadar normatif d\u00fczeyde kabul edilebilir olmasa da, yarg\u0131 sistemine duyulan g\u00fcven bak\u0131m\u0131ndan dikkate al\u0131nmas\u0131 gereken sosyolojik bir olgudur. Yarg\u0131 mensuplar\u0131n\u0131n kararlar\u0131n\u0131 dosyadaki deliller \u00fczerinden verdi\u011fi ger\u00e7e\u011fi ile kamuoyundaki alg\u0131 aras\u0131ndaki bu ayr\u0131\u015fma, reform ihtiyac\u0131n\u0131n yaln\u0131zca mevzuat de\u011fi\u015fikli\u011fi ile s\u0131n\u0131rl\u0131 olmad\u0131\u011f\u0131n\u0131 g\u00f6stermektedir.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u00e7er\u00e7evede 12. Yarg\u0131 Paketi, yaln\u0131zca yarg\u0131lamalar\u0131n h\u0131zland\u0131r\u0131lmas\u0131n\u0131 de\u011fil; ayn\u0131 zamanda \u015feffafl\u0131k, \u00f6ng\u00f6r\u00fclebilirlik ve e\u015fitlik ilkeleri \u00fczerinden yarg\u0131ya duyulan g\u00fcvenin g\u00fc\u00e7lendirilmesini de hedefleyen bir ara\u00e7 olarak de\u011ferlendirilmelidir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. Hukuk Yarg\u0131lamalar\u0131n\u0131n Makul S\u00fcrede Tamamlanmas\u0131<\/span><\/h3>\n<p data-start=\"390\" data-end=\"1014\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hukuk yarg\u0131lamalar\u0131n\u0131n makul s\u00fcrede tamamlanmas\u0131, adil yarg\u0131lanma hakk\u0131n\u0131n asli unsurlar\u0131ndan biridir. Yarg\u0131laman\u0131n sonunda verilen karar\u0131n hukuka uygun olmas\u0131 kadar, bu karar\u0131n ne kadar s\u00fcrede verildi\u011fi de bireylerin temel hak ve \u00f6zg\u00fcrl\u00fckleri bak\u0131m\u0131ndan belirleyici bir rol oynamaktad\u0131r. T\u00fcrkiye\u2019de hukuk yarg\u0131lamalar\u0131na ili\u015fkin en temel yap\u0131sal sorunlardan biri, davalar\u0131n uzun y\u0131llara yay\u0131lan bir zaman dilimi i\u00e7inde sonu\u00e7lanmas\u0131d\u0131r. Bu durum, yaln\u0131zca yarg\u0131 sistemine duyulan g\u00fcveni zedelemekle kalmamakta; m\u00fclkiyet hakk\u0131, s\u00f6zle\u015fme serbestisi ve ekonomik hayat\u0131n istikrar\u0131 \u00fczerinde de do\u011frudan etkiler do\u011furmaktad\u0131r.<\/span><\/p>\n<h4 data-start=\"1016\" data-end=\"1070\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.1. Mevcut Uygulamada Yarg\u0131lamay\u0131 Uzatan Fakt\u00f6rler<\/span><\/h4>\n<p data-start=\"1072\" data-end=\"1689\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hukuk yarg\u0131lamalar\u0131n\u0131n uzamas\u0131na yol a\u00e7an nedenler, m\u00fcnferit uygulama hatalar\u0131ndan ziyade sistematik ve tekrar eden sorun alanlar\u0131 etraf\u0131nda toplanmaktad\u0131r. Tebligat i\u015flemlerindeki gecikmeler ve usuls\u00fczl\u00fck iddialar\u0131, duru\u015fmalar aras\u0131nda uzun zaman aral\u0131klar\u0131n\u0131n olu\u015fmas\u0131, bilirki\u015fi raporlar\u0131n\u0131n ge\u00e7 haz\u0131rlanmas\u0131 veya yetersiz raporlar nedeniyle ek rapor talepleri, ke\u015fif s\u00fcre\u00e7lerinin gere\u011finden fazla uzamas\u0131 ve dosya y\u00f6netimine ili\u015fkin kurumsal eksiklikler bu sorunlar\u0131n ba\u015f\u0131nda gelmektedir. Bu fakt\u00f6rler, \u00e7o\u011fu zaman tek ba\u015f\u0131na de\u011fil, birbirini besleyen bir zincir h\u00e2linde yarg\u0131laman\u0131n b\u00fct\u00fcn\u00fcn\u00fc yava\u015flatmaktad\u0131r. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Buna ek olarak, usul hukukunun taraflara tan\u0131d\u0131\u011f\u0131 baz\u0131 imk\u00e2nlar\u0131n, hakk\u0131n k\u00f6t\u00fcye kullan\u0131lmas\u0131 niteli\u011fine varan bi\u00e7imde yarg\u0131lamay\u0131 uzatacak \u015fekilde i\u015fletilmesi de uygulamada s\u0131k\u00e7a kar\u015f\u0131la\u015f\u0131lan bir durumdur. Mevcut sistemde, yarg\u0131laman\u0131n makul s\u00fcrede tamamlanmas\u0131n\u0131 g\u00fcvence alt\u0131na alan normatif hedefler bulunmakla birlikte, bu hedefleri etkin bi\u00e7imde hayata ge\u00e7irecek yap\u0131sal ara\u00e7lar\u0131n yeterince geli\u015ftirilemedi\u011fi g\u00f6r\u00fclmektedir.<\/span><\/p>\n<h4 data-start=\"2125\" data-end=\"2173\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3.2. Makul S\u00fcre \u0130hlallerinin Yap\u0131sal Niteli\u011fi<\/span><\/h4>\n<p data-start=\"2175\" data-end=\"2560\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hukuk yarg\u0131lamalar\u0131ndaki gecikmeler, bireysel hatalarla a\u00e7\u0131klanamayacak \u00f6l\u00e7\u00fcde yayg\u0131n ve s\u00fcreklidir. Bu durum, makul s\u00fcre ihlallerinin yap\u0131sal bir sorun niteli\u011fi ta\u015f\u0131d\u0131\u011f\u0131n\u0131 g\u00f6stermektedir. Yarg\u0131laman\u0131n uzun s\u00fcrmesi, yaln\u0131zca davan\u0131n taraflar\u0131n\u0131 de\u011fil; ayn\u0131 zamanda yarg\u0131 sisteminin b\u00fct\u00fcn\u00fc \u00fczerinde bir y\u00fck olu\u015fturmakta ve yeni davalar\u0131n da daha yava\u015f ilerlemesine neden olmaktad\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Makul s\u00fcrede yarg\u0131lanma hakk\u0131n\u0131n ihlali, \u00e7o\u011fu zaman karar\u0131n i\u00e7eri\u011finden ba\u011f\u0131ms\u0131z olarak, ba\u015fl\u0131 ba\u015f\u0131na bir hak ihlali sonucunu do\u011furmaktad\u0131r. \u00d6zellikle ekonomik de\u011feri y\u00fcksek uyu\u015fmazl\u0131klarda veya m\u00fclkiyet hakk\u0131n\u0131 do\u011frudan etkileyen davalarda, yarg\u0131laman\u0131n uzamas\u0131 fiilen telafisi g\u00fc\u00e7 veya imk\u00e2ns\u0131z sonu\u00e7lar yaratabilmektedir. Bu nedenle makul s\u00fcre meselesi, yaln\u0131zca usule ili\u015fkin bir teknik sorun de\u011fil; haklar\u0131n etkin korunmas\u0131yla do\u011frudan ba\u011flant\u0131l\u0131 anayasal bir mesele olarak ele al\u0131nmal\u0131d\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">12. Yarg\u0131 Paketi kapsam\u0131nda tart\u0131\u015f\u0131lan bir di\u011fer mekanizma ise \u201c<em>atlamal\u0131 temyiz<\/em>\u201d sistemidir. Bu sistem, baz\u0131 dosyalar\u0131n hem istinaf hem de temyiz incelemesinden ge\u00e7mesi yerine do\u011frudan \u00fcst inceleme mercisine ta\u015f\u0131nmas\u0131n\u0131 \u00f6ng\u00f6rmektedir. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu yakla\u015f\u0131m, yarg\u0131lama s\u00fcrelerini \u00f6nemli \u00f6l\u00e7\u00fcde k\u0131saltma potansiyeline sahip olmakla birlikte, \u00e7ok dereceli yarg\u0131lama sisteminin sa\u011flad\u0131\u011f\u0131 denetim g\u00fcvencelerinin zay\u0131flamas\u0131 riskini de beraberinde getirmektedir. Bu nedenle d\u00fczenlemenin kapsam\u0131 ve uygulanma ko\u015fullar\u0131 b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r.<\/span><\/p>\n<h3 data-start=\"3063\" data-end=\"3104\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. Reformdan Beklenen Genel Yakla\u015f\u0131m<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">12. Yarg\u0131 Paketi \u00e7er\u00e7evesinde hukuk yarg\u0131lamalar\u0131n\u0131n makul s\u00fcrede tamamlanmas\u0131na ili\u015fkin beklenti, tek tek usul h\u00fck\u00fcmlerinin de\u011fi\u015ftirilmesinden ziyade, yarg\u0131laman\u0131n b\u00fct\u00fcn\u00fcne y\u00f6nelik bir y\u00f6netim anlay\u0131\u015f\u0131n\u0131n geli\u015ftirilmesidir. Reformdan beklenen temel y\u00f6nelim, yarg\u0131lamay\u0131 uzatan yap\u0131sal fakt\u00f6rlerin tespiti ve bu fakt\u00f6rlere kar\u015f\u0131 \u00f6nleyici ve h\u0131zland\u0131r\u0131c\u0131 mekanizmalar\u0131n kurulmas\u0131d\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kapsamda, tebligat s\u00fcre\u00e7lerinin sadele\u015ftirilmesi ve dijitalle\u015ftirilmesi, dosya y\u00f6netiminin daha etkin h\u00e2le getirilmesi, yarg\u0131lamay\u0131 gereksiz yere uzatan usul\u00ee i\u015flemlerin s\u0131n\u0131rland\u0131r\u0131lmas\u0131 ve yarg\u0131laman\u0131n makul s\u00fcrede tamamlanmas\u0131n\u0131 esas alan bir yakla\u015f\u0131m\u0131n kurumsalla\u015ft\u0131r\u0131lmas\u0131 \u00f6nem ta\u015f\u0131maktad\u0131r. Ancak bu t\u00fcr d\u00fczenlemelerin, hak arama \u00f6zg\u00fcrl\u00fc\u011f\u00fcn\u00fc ve savunma hakk\u0131n\u0131 zedelemeyecek bir denge i\u00e7inde hayata ge\u00e7irilmesi gerekmektedir.<\/span><\/p>\n<p data-start=\"2903\" data-end=\"3262\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kapsamda g\u00fcndeme gelen bir di\u011fer \u00f6nemli reform alan\u0131, \u00e7eki\u015fmeli bo\u015fanma davalar\u0131nda arabuluculuk mekanizmas\u0131n\u0131n uygulanmas\u0131d\u0131r.
