Din\u00ee inan\u00e7 ve duygular, \u00e7o\u011fu zaman rasyonel sorgulamaya tabi tutulmaks\u0131z\u0131n i\u00e7selle\u015ftirilen, bireyin irade yap\u0131s\u0131 \u00fczerinde derin ve kal\u0131c\u0131 etkiler do\u011furan bir mahiyet ta\u015f\u0131r. Bu \u00f6zellik, dini yaln\u0131zca bireysel vicdan alan\u0131na ait bir olgu olmaktan \u00e7\u0131kararak sosyal ili\u015fkilerin ve kamusal hayat\u0131n merkezine yerle\u015ftirmektedir. Ancak dinin bu g\u00fc\u00e7l\u00fc ve kapsay\u0131c\u0131 konumu, onu ayn\u0131 zamanda istismar ve manip\u00fclasyon bak\u0131m\u0131ndan son derece elveri\u015fli bir ara\u00e7 h\u00e2line de getirmektedir. Din\u00ee s\u00f6ylemle desteklenen vaatler, bireylerin ele\u015ftirel de\u011ferlendirme yetisini zay\u0131flatabilmekte; \u201c<em>Allah<\/em>\u201d, \u201c<em>dua<\/em>\u201d, \u201c<em>bereket<\/em>\u201d, \u201c<em>\u015fifa<\/em>\u201d, \u201c<em>keramet<\/em>\u201d, \u201c<em>hoca<\/em>\u201d, \u201c<em>mevlit<\/em>\u201d gibi kavramlar, g\u00fcven tesis eden semboller olarak kullan\u0131labilmektedir. Bu semboller arac\u0131l\u0131\u011f\u0131yla ger\u00e7ekle\u015ftirilen aldatma fiilleri, klasik doland\u0131r\u0131c\u0131l\u0131k y\u00f6ntemlerinden farkl\u0131 olarak yaln\u0131zca malvarl\u0131\u011f\u0131na de\u011fil, bireyin irade \u00f6zg\u00fcrl\u00fc\u011f\u00fcne ve inan\u00e7 d\u00fcnyas\u0131na da do\u011frudan m\u00fcdahale niteli\u011fi ta\u015f\u0131maktad\u0131r.<!--more--><\/span><\/p>\n<p data-start=\"1566\" data-end=\"2182\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye \u00f6zelinde bak\u0131ld\u0131\u011f\u0131nda, din\u00ee inan\u00e7lar\u0131n toplumsal ya\u015fam \u00fczerindeki yo\u011fun etkisi, bu t\u00fcr istismarlar\u0131n yayg\u0131nla\u015fmas\u0131na elveri\u015fli bir zemin olu\u015fturmaktad\u0131r. Yarg\u0131sal uygulamada s\u0131kl\u0131kla kar\u015f\u0131la\u015f\u0131lan \u201c<em>hocaya okutma<\/em>\u201d, \u201c<em>b\u00fcy\u00fc bozma<\/em>\u201d, \u201c<em>muska yazma<\/em>\u201d, \u201c<em>\u00e7ocu\u011fu iyile\u015ftirme<\/em>\u201d, \u201c<em>belay\u0131 defetme<\/em>\u201d, \u201c<em>manev\u00ee r\u00fctbe kazand\u0131rma<\/em>\u201d gibi s\u00f6ylemler, din\u00ee inan\u00e7 ve duygular\u0131n sistematik bi\u00e7imde aldatma arac\u0131 h\u00e2line getirildi\u011fini a\u00e7\u0131k\u00e7a g\u00f6stermektedir. Bu nedenle konu, yaln\u0131zca bireysel ma\u011fduriyetler ba\u011flam\u0131nda de\u011fil; toplumsal g\u00fcvenin korunmas\u0131, hukuki \u00f6ng\u00f6r\u00fclebilirlik ve hukuk devleti ilkesi bak\u0131m\u0131ndan da b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r.<\/span><\/p>\n<p data-start=\"2184\" data-end=\"2880\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu olgunun kavramsalla\u015ft\u0131r\u0131lmas\u0131 bak\u0131m\u0131ndan <a href=\"https:\/\/tr.wikipedia.org\/wiki\/Ya%C5%9Far_Nuri_%C3%96zt%C3%BCrk\" target=\"_blank\" rel=\"noopener\">Prof. Dr. Ya\u015far Nuri \u00d6zt\u00fcrk<\/a>\u2019\u00fcn geli\u015ftirdi\u011fi yakla\u015f\u0131m, T\u00fcrkiye\u2019deki tart\u0131\u015fmalar a\u00e7\u0131s\u0131ndan \u00f6zel bir yere sahiptir. \u00d6zt\u00fcrk, <em data-start=\"2349\" data-end=\"2369\">Allah ile Aldatmak<\/em> adl\u0131 eserinde bu olguyu, dinin \u00f6z\u00fcnden kopar\u0131larak \u00e7\u0131kar, tahakk\u00fcm ve s\u00f6m\u00fcr\u00fc arac\u0131 h\u00e2line getirilmesi olarak tan\u0131mlamaktad\u0131r. Ona g\u00f6re bu t\u00fcr bir aldatma bi\u00e7imi, bireyin kutsala duydu\u011fu g\u00fcvenin ara\u00e7salla\u015ft\u0131r\u0131lmas\u0131 yoluyla sorgulamay\u0131 g\u00fcnah sayan, itaati mutlakla\u015ft\u0131ran ve bu yolla ekonomik, siyasi veya cinsel menfaat sa\u011flayan \u00f6rg\u00fctl\u00fc bir zihniyet \u00fcretmektedir. Bu zihniyet, kendisini ele\u015ftiriden ve hukuki denetimden muaf k\u0131lan bir \u201c<em>tahakk\u00fcm teolojisi<\/em>\u201d in\u015fa ederek fiil\u00ee bir dokunulmazl\u0131k alan\u0131 yaratmaktad\u0131r.<\/span><\/p>\n<p data-start=\"2882\" data-end=\"3417\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza hukuku bak\u0131m\u0131ndan \u00f6zellikle vurgulanmas\u0131 gereken husus \u015fudur: Hukuk d\u00fczeni, dinin i\u00e7eri\u011fini, teolojik do\u011frulu\u011funu veya inan\u00e7 sistemlerinin hakikat de\u011ferini yarg\u0131lamaz. Ancak dinin, bireyin iradesini fesada u\u011fratacak bi\u00e7imde bir ara\u00e7 olarak kullan\u0131lmas\u0131n\u0131 do\u011frudan ilgi alan\u0131na al\u0131r. Bu y\u00f6n\u00fcyle din\u00ee istismar olgusu, bir inan\u00e7 ele\u015ftirisi de\u011fil; inanc\u0131n aldatma ve bask\u0131 arac\u0131 h\u00e2line getirilmesine ili\u015fkin fiil\u00ee davran\u0131\u015flar\u0131n hukuki de\u011ferlendirilmesidir. Bu ayr\u0131m, ceza hukukunun tarafs\u0131zl\u0131k ilkesinin de zorunlu bir sonucudur.<\/span><\/p>\n<p data-start=\"3419\" data-end=\"4057\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Sosyolojik a\u00e7\u0131dan bak\u0131ld\u0131\u011f\u0131nda, din\u00ee manip\u00fclasyon \u00f6zellikle kapal\u0131 veya yar\u0131 kapal\u0131 grup yap\u0131lar\u0131 i\u00e7inde daha yo\u011fun bi\u00e7imde ortaya \u00e7\u0131kmaktad\u0131r. Cemaat, tarikat veya benzeri yap\u0131lanmalar i\u00e7erisinde \u201c<em>hoca<\/em>\u201d, \u201c<em>\u015feyh<\/em>\u201d, \u201c<em>\u00e2lim<\/em>\u201d ya da \u201c<em>manev\u00ee rehber<\/em>\u201d s\u0131fatlar\u0131yla tesis edilen otorite ili\u015fkisi, fail ile ma\u011fdur aras\u0131nda yap\u0131sal bir g\u00fc\u00e7 asimetrisi yaratmaktad\u0131r. Bu asimetri, ma\u011fdurun sorgulama kapasitesini zay\u0131flatmakta ve itaat davran\u0131\u015f\u0131n\u0131 \u00f6zg\u00fcr iradeye dayal\u0131 bir tercih olmaktan \u00e7\u0131karmaktad\u0131r. Ceza hukuku bak\u0131m\u0131ndan belirleyici olan da, bu t\u00fcr ili\u015fkiler i\u00e7inde ma\u011fdurun g\u00f6r\u00fcn\u00fcrdeki r\u0131zas\u0131n\u0131n ger\u00e7ekte irade fesad\u0131 sonucu olu\u015fup olu\u015fmad\u0131\u011f\u0131d\u0131r.<\/span><\/p>\n<p data-start=\"4059\" data-end=\"4514\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrk Ceza Kanunu\u2019nun 158\/1-a maddesinde doland\u0131r\u0131c\u0131l\u0131k su\u00e7unun \u201c<em>din\u00ee inan\u00e7 ve duygular\u0131n istismar edilmesi suretiyle<\/em>\u201d i\u015flenmesi, su\u00e7un nitelikli h\u00e2li olarak d\u00fczenlenmi\u015ftir. Kanun koyucu bu h\u00fck\u00fcmle, din\u00ee s\u00f6ylemin aldat\u0131c\u0131l\u0131k kapasitesinin s\u0131radan yalanlardan daha yo\u011fun oldu\u011funu kabul etmi\u015f ve bu nedenle daha a\u011f\u0131r bir yapt\u0131r\u0131m \u00f6ng\u00f6rm\u00fc\u015ft\u00fcr. Bu yakla\u015f\u0131m, dinin birey ve toplum \u00fczerindeki g\u00fc\u00e7l\u00fc etkisini dikkate alan bilin\u00e7li bir normatif tercihin sonucudur.<\/span><\/p>\n<p data-start=\"4516\" data-end=\"5161\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Din\u00ee manip\u00fclasyonun ceza hukuku bak\u0131m\u0131ndan ta\u015f\u0131d\u0131\u011f\u0131 \u00f6nem, yaln\u0131zca malvarl\u0131\u011f\u0131na kar\u015f\u0131 i\u015flenen su\u00e7larla s\u0131n\u0131rl\u0131 de\u011fildir. Yarg\u0131sal uygulamada a\u00e7\u0131k\u00e7a g\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere, din\u00ee arg\u00fcmanlarla kurulan otorite ili\u015fkileri, beden dokunulmazl\u0131\u011f\u0131na ve cinsel \u00f6zg\u00fcrl\u00fc\u011fe kar\u015f\u0131 i\u015flenen su\u00e7larda da belirleyici bir rol oynayabilmektedir. Bu t\u00fcr durumlarda ma\u011fdurlar\u0131n cinsel davran\u0131\u015flara r\u0131za g\u00f6sterdi\u011fi iddias\u0131 g\u00fcndeme gelmekte; ancak bu r\u0131zan\u0131n hukuken ge\u00e7erli olup olmad\u0131\u011f\u0131 ciddi tart\u0131\u015fmalara konu olmaktad\u0131r. Bu y\u00f6n\u00fcyle din\u00ee inan\u00e7 ve duygular\u0131n istismar\u0131, klasik doland\u0131r\u0131c\u0131l\u0131k anlay\u0131\u015f\u0131n\u0131 a\u015fan, \u00e7ok katmanl\u0131 ve karma\u015f\u0131k bir su\u00e7 fenomeni niteli\u011fi kazanmaktad\u0131r.<\/span><\/p>\n<p data-start=\"5163\" data-end=\"5771\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u00e7al\u0131\u015fman\u0131n temel amac\u0131, din\u00ee inan\u00e7 ve duygular\u0131n istismar\u0131 olgusunu ceza hukuku perspektifinden ele almak ve bu olgunun <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">T\u00fcrk Ceza Kanunu<\/a>\u2019ndaki normatif kar\u015f\u0131l\u0131\u011f\u0131n\u0131 ortaya koymakt\u0131r. \u00d6zellikle <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">TCK<\/a> m.158\/1-a kapsam\u0131nda d\u00fczenlenen din\u00ee inan\u00e7 ve duygular\u0131n istismar\u0131 suretiyle doland\u0131r\u0131c\u0131l\u0131k su\u00e7unun unsurlar\u0131, uygulama s\u0131n\u0131rlar\u0131 ve yarg\u0131sal yorumlar\u0131 ayr\u0131nt\u0131l\u0131 bi\u00e7imde incelenecektir. Bu kapsamda doland\u0131r\u0131c\u0131l\u0131k su\u00e7unda hile kavram\u0131n\u0131n din\u00ee s\u00f6ylemle nas\u0131l yo\u011funla\u015ft\u0131\u011f\u0131, din\u00ee manip\u00fclasyonun irade fesad\u0131 yaratma kapasitesi ve \u201c<em>g\u00f6r\u00fcn\u00fc\u015fte r\u0131za<\/em>\u201d ile \u201c<em>hukuken ge\u00e7erli r\u0131za<\/em>\u201d aras\u0131ndaki ayr\u0131m \u00fczerinde durulacakt\u0131r.<\/span><\/p>\n<p data-start=\"5773\" data-end=\"6315\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00c7al\u0131\u015fma, esas itibar\u0131yla normatif ve i\u00e7tihadi analiz y\u00f6ntemine dayanmaktad\u0131r. <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">TCK<\/a> h\u00fck\u00fcmleri madde gerek\u00e7eleriyle birlikte de\u011ferlendirilmi\u015f; Yarg\u0131tay Ceza Genel Kurulu ile ilgili Ceza Dairelerinin konuya ili\u015fkin kararlar\u0131 sistematik bi\u00e7imde analiz edilmi\u015ftir. Bunun yan\u0131nda ceza hukuku doktrini, din ve hukuk sosyolojisi literat\u00fcr\u00fc, <a href=\"https:\/\/tr.wikipedia.org\/wiki\/Ya%C5%9Far_Nuri_%C3%96zt%C3%BCrk\" target=\"_blank\" rel=\"noopener\">Ya\u015far Nuri \u00d6zt\u00fcrk<\/a>\u2019\u00fcn \u00e7al\u0131\u015fmalar\u0131 ve uluslararas\u0131 literat\u00fcrde yer alan \u201c<em>spiritual fraud<\/em>\u201d, \u201c<em>religious manipulation<\/em>\u201d ve \u201c<em>coercive persuasion<\/em>\u201d ba\u015fl\u0131kl\u0131 \u00e7al\u0131\u015fmalar yard\u0131mc\u0131 kaynak olarak kullan\u0131lm\u0131\u015ft\u0131r.<\/span><\/p>\n<p data-start=\"6372\" data-end=\"6983\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yukar\u0131da \u00e7izilen kavramsal ve toplumsal \u00e7er\u00e7eve, din\u00ee inan\u00e7 ve duygular\u0131n istismar\u0131n\u0131n neden ceza hukukunun m\u00fcdahalesini gerektiren bir olgu oldu\u011funu ortaya koymaktad\u0131r. Bu noktada art\u0131k, normatif d\u00fczleme ge\u00e7ilmesi ve ceza hukukunun din\u00ee inan\u00e7 ve duygulara hangi s\u0131n\u0131rlar i\u00e7inde koruma sa\u011flad\u0131\u011f\u0131n\u0131n, hangi h\u00e2llerde bu alan\u0131n yasal m\u00fcdahaleye a\u00e7\u0131ld\u0131\u011f\u0131n\u0131n sistematik bi\u00e7imde incelenmesi gerekmektedir. Bu nedenle \u00e7al\u0131\u015fman\u0131n birinci b\u00f6l\u00fcm\u00fcnde, din\u00ee inan\u00e7 ve duygular\u0131n ceza hukuku bak\u0131m\u0131ndan korunma alan\u0131, laiklik ilkesi, hukuki de\u011fer kavram\u0131 ve ceza hukukunun tarafs\u0131zl\u0131k s\u0131n\u0131rlar\u0131 \u00e7er\u00e7evesinde ele al\u0131nacakt\u0131r.<\/span><\/p>\n<h3 data-start=\"6372\" data-end=\"6983\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Din\u00ee \u0130nan\u00e7 ve Duygular\u0131n Ceza Hukuku Bak\u0131m\u0131ndan Korunma Alan\u0131<\/span><\/h3>\n<h4 data-start=\"307\" data-end=\"372\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza Hukukunun Din Alan\u0131na Yakla\u015f\u0131m\u0131 ve Tarafs\u0131zl\u0131k \u0130lkesi<\/span><\/h4>\n<p data-start=\"374\" data-end=\"926\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza hukukunun din alan\u0131na yakla\u015f\u0131m\u0131, laik hukuk devletinin temel ilkeleri \u00e7er\u00e7evesinde \u015fekillenmektedir. Laiklik ilkesi, devletin din kar\u015f\u0131s\u0131nda tarafs\u0131zl\u0131\u011f\u0131n\u0131 ifade ederken, ceza hukukunun bu tarafs\u0131zl\u0131\u011f\u0131 somut normlara ve uygulamaya yans\u0131tmas\u0131n\u0131 da zorunlu k\u0131lar. Bu ba\u011flamda ceza hukuku, din\u00ee inan\u00e7lar\u0131n do\u011frulu\u011fu, yanl\u0131\u015fl\u0131\u011f\u0131 veya teolojik i\u00e7eri\u011fi hakk\u0131nda herhangi bir de\u011ferlendirme yapmaz; yapmamas\u0131 da gerekir. Hukukun ilgi alan\u0131, inan\u00e7lar\u0131n kendisi de\u011fil, bu inan\u00e7lar\u0131n bireylerin hukuki de\u011ferlerini ihlal edecek bi\u00e7imde ara\u00e7salla\u015ft\u0131r\u0131lmas\u0131d\u0131r. Bu nedenle ceza hukukunda din, ne mutlak bir dokunulmazl\u0131k alan\u0131 ne de s\u0131n\u0131rs\u0131z bir serbestlik sahas\u0131d\u0131r. Din\u00ee inan\u00e7 ve duygular, bireyin d\u00fc\u015f\u00fcnce, vicdan ve din \u00f6zg\u00fcrl\u00fc\u011f\u00fc kapsam\u0131nda korunurken; bu alan\u0131n, ba\u015fkalar\u0131n\u0131n malvarl\u0131\u011f\u0131na, beden dokunulmazl\u0131\u011f\u0131na, cinsel \u00f6zg\u00fcrl\u00fc\u011f\u00fcne veya irade serbestisine y\u00f6nelik ihlallerin arac\u0131 h\u00e2line gelmesi durumunda ceza hukukunun m\u00fcdahalesi ka\u00e7\u0131n\u0131lmaz h\u00e2le gelir. Bu m\u00fcdahale, dinin kendisine de\u011fil, din\u00ee s\u00f6ylemin hukuka ayk\u0131r\u0131 fiillerde kullan\u0131lmas\u0131na y\u00f6neliktir.<\/span><\/p>\n<p data-start=\"1428\" data-end=\"1828\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu ayr\u0131m, ceza hukukunun me\u015fruiyet s\u0131n\u0131rlar\u0131n\u0131 belirleyen temel e\u015fiktir. Aksi h\u00e2lde ya din\u00ee alan mutlak bir dokunulmazl\u0131k z\u0131rh\u0131 kazanacak ya da hukuk, inan\u00e7 alan\u0131na m\u00fcdahale eden bask\u0131c\u0131 bir ayg\u0131ta d\u00f6n\u00fc\u015fecektir. <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">TCK<\/a>\u2019n\u0131n din\u00ee inan\u00e7 ve duygular\u0131n istismar\u0131 suretiyle doland\u0131r\u0131c\u0131l\u0131\u011f\u0131 nitelikli su\u00e7 h\u00e2li olarak d\u00fczenlemesi, bu hassas dengeyi g\u00f6zeten bilin\u00e7li bir normatif tercihin sonucudur.<\/span><\/p>\n<h4 data-start=\"1830\" data-end=\"1879\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hukuki De\u011fer Olarak Din\u00ee \u0130nan\u00e7 ve Duygular<\/span><\/h4>\n<p data-start=\"1881\" data-end=\"2218\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ceza hukukunda bir fiilin su\u00e7 olarak tan\u0131mlanabilmesi i\u00e7in, korunmaya de\u011fer bir hukuki menfaati ihlal etmesi gerekir. Ma\u011fdur, hem ekonomik zarara u\u011framakta hem de kutsal de\u011ferlerinin ara\u00e7salla\u015ft\u0131r\u0131lmas\u0131 nedeniyle derin bir hayal k\u0131r\u0131kl\u0131\u011f\u0131 ya\u015famaktad\u0131r.<\/span><\/p>\n<p data-start=\"6367\" data-end=\"6631\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu y\u00f6n\u00fcyle s\u00f6z konusu su\u00e7 tipi, klasik doland\u0131r\u0131c\u0131l\u0131ktan daha y\u00fcksek bir kriminolojik tehlikelilik arz eder. Bu noktadan sonra yap\u0131lmas\u0131 gereken, din\u00ee manip\u00fclasyonun ma\u011fdur iradesi \u00fczerindeki etkisini daha yak\u0131ndan incelemek ve \u00f6zellikle irade fesad\u0131, hileyle \u015fekillenen r\u0131za ve ceza hukuku bak\u0131m\u0131ndan r\u0131zan\u0131n s\u0131n\u0131rlar\u0131 konular\u0131n\u0131 derinle\u015ftirmektir. Ma\u011fdur paras\u0131n\u0131 vermekte, alt\u0131n\u0131n\u0131 teslim etmekte veya belirli davran\u0131\u015flarda bulunmakta; ancak bu tasarruf, din\u00ee telkinle \u015fekillenmi\u015f bir yan\u0131lg\u0131n\u0131n \u00fcr\u00fcn\u00fcd\u00fcr. \u0130\u015fte bu noktada doktrinde ve Yarg\u0131tay i\u00e7tihatlar\u0131nda \u201c<em>g\u00f6r\u00fcn\u00fc\u015fte r\u0131za<\/em>\u201d kavram\u0131 devreye girmektedir. Bu nedenle <a href=\"https:\/\/www.mevzuat.gov.tr\/mevzuat?MevzuatNo=5237&amp;MevzuatTur=1&amp;MevzuatTertip=5\" target=\"_blank\" rel=\"noopener\">TCK<\/a>\u2019n\u0131n 158\/1-a maddesinde yer alan d\u00fczenlemenin daha iyi anla\u015f\u0131labilmesi i\u00e7in kar\u015f\u0131la\u015ft\u0131rmal\u0131 ve uluslararas\u0131 hukuk perspektifi ka\u00e7\u0131n\u0131lmazd\u0131r.<\/span><\/p>\n<p data-start=\"699\" data-end=\"1020\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kar\u015f\u0131la\u015ft\u0131rmal\u0131 inceleme, yaln\u0131zca normatif benzerlikleri de\u011fil; hukuk sistemlerinin din &#8211; hukuk &#8211; \u00f6zg\u00fcr irade ili\u015fkisini nas\u0131l kurduklar\u0131n\u0131 da ortaya koymaktad\u0131r.
