ITAR rejiminde \u201cde minimis\u201d istisnas\u0131 bulunmad\u0131\u011f\u0131ndan, ABD men\u015feli i\u00e7erik i\u00e7eren alternatif tedarik veya \u00fc\u00e7\u00fcnc\u00fc \u00fclke \u00fczerinden temin giri\u015fimleri de re-export iznine tabi kalmaktad\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uluslararas\u0131 hukukta bu t\u00fcr tek tarafl\u0131 yapt\u0131r\u0131mlar; egemenlik, yarg\u0131 yetkisinin d\u0131\u015fa te\u015fmili ve \u00e7ok tarafl\u0131 me\u015fruiyet ilkeleri ba\u011flam\u0131nda tart\u0131\u015fma konusu olmakla birlikte, pratikte ABD finans sistemine ve savunma teknolojisine eri\u015fim gerektiren durumlarda fiil\u00ee ba\u011flay\u0131c\u0131l\u0131k yaratmaktad\u0131r. font-size: 14pt;\">Bu yasak, yaln\u0131zca donan\u0131m\u0131 de\u011fil; teknik veriyi, teknik yard\u0131m\u0131 (TAA), \u00fcretim lisanslar\u0131n\u0131 (MLA) ve yeniden ihracat yetkilerini de kapsayacak \u015fekilde geni\u015f yorumlan\u0131r.<\/span><\/li>\n<\/ul>\n<h4 data-start=\"832\" data-end=\"895\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cDo\u011frudan\u2013Dolayl\u0131 Taraf\u201d ve \u201cFayda Sahibi\u201d Tart\u0131\u015fmas\u0131<\/span><\/h4>\n<ul>\n<li data-start=\"898\" data-end=\"1004\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">SSB\u2019ye Neden CAATSA Yapt\u0131r\u0131mlar\u0131 Uyguland\u0131?<\/span><\/h4>\n<p data-start=\"453\" data-end=\"864\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Savunma Sanayii Ba\u015fkanl\u0131\u011f\u0131\u2019na (SSB) uygulanan CAATSA yapt\u0131r\u0131mlar\u0131n\u0131n hukuki temeli, ABD yasalar\u0131nda yer alan \u201cCountering America\u2019s Adversaries Through Sanctions Act (CAATSA)\u201d ba\u015fl\u0131kl\u0131 d\u00fczenlemenin 231. maddesidir.
