font-size: 14pt;\">M\u00fcteahhit, s\u00f6zle\u015fmede belirtilen kalite ve standartlara uygun in\u015faat yapmazsa, arsa sahibi buna itiraz edebilir ve zarar\u0131n\u0131 talep edebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Eksik veya kalitesiz i\u015f\u00e7ilik, malzeme kullan\u0131m\u0131nda standartlara uygunluk sa\u011flanmamas\u0131 gibi sorunlar, m\u00fcteahhitin hukuki sorumlulu\u011funu do\u011furabilir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">3. <strong>Ba\u011f\u0131ms\u0131z B\u00f6l\u00fcmlerin Teslim Edilmemesi veya Eksik Teslim Edilmesi<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">M\u00fcteahhit, arsa sahibine s\u00f6zle\u015fme kapsam\u0131nda vaat etti\u011fi ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmleri teslim etmezse veya eksik teslim ederse, bu durum s\u00f6zle\u015fmenin ihlali anlam\u0131na gelir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Arsa sahibinin hak etti\u011fi daire veya d\u00fckkanlar\u0131 alamamas\u0131, m\u00fcteahhitin mali problemler ya\u015famas\u0131 veya projeden \u00e7ekilmesi gibi durumlar ortaya \u00e7\u0131kabilir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">4. <strong>Tapu ve \u0130mar Sorunlar\u0131<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">M\u00fcteahhit, in\u015faat a\u015famas\u0131nda gerekli imar izinlerini alamaz veya projeyi yasal s\u0131n\u0131rlar\u0131n d\u0131\u015f\u0131nda ger\u00e7ekle\u015ftirirse, in\u015faat\u0131n tamamlanmas\u0131 ve tapular\u0131n teslim edilmesi m\u00fcmk\u00fcn olmayabilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130mar d\u00fczenlemelerine uygun olmayan in\u015faatlar, yap\u0131 kullan\u0131m izninin (iskan) al\u0131nmas\u0131n\u0131 zorla\u015ft\u0131rabilir veya engelleyebilir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">5. <strong>M\u00fcteahhidin \u0130flas Etmesi veya Projeyi Tamamlayamamas\u0131<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">M\u00fcteahhidin iflas etmesi durumunda, in\u015faat yar\u0131m kalabilir ve arsa sahibi hem m\u00fclkiyet kayb\u0131 hem de maddi zararla kar\u015f\u0131 kar\u015f\u0131ya kalabilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu durumda, arsa sahibi yeni bir m\u00fcteahhit ile anla\u015fmak veya in\u015faat\u0131 kendi imkanlar\u0131yla tamamlamak zorunda kalabilir, bu da ek maliyet ve zaman kayb\u0131 anlam\u0131na gelir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">S\u00f6zle\u015fmede yer alan maddelerin belirsiz olmas\u0131, taraflar aras\u0131nda uyu\u015fmazl\u0131klara yol a\u00e7abilir. \u00d6zellikle, teslim edilecek ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin net \u015fekilde belirlenmemesi veya in\u015faat s\u00fcresi ve ceza \u015fartlar\u0131 gibi konular\u0131n a\u00e7\u0131k\u00e7a ifade edilmemesi, anla\u015fmazl\u0131klar\u0131n temelini olu\u015fturur.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Anla\u015fmazl\u0131klar hukuki s\u00fcre\u00e7lere ta\u015f\u0131nabilir ve taraflar aras\u0131nda uzun s\u00fcreli davalara yol a\u00e7abilir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">7. <strong>Vergi ve Har\u00e7 Sorunlar\u0131<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmeleri kapsam\u0131nda m\u00fcteahhit ve arsa sahibi aras\u0131nda yap\u0131lan ta\u015f\u0131nmaz devirleri, vergisel y\u00fck\u00fcml\u00fcl\u00fckler do\u011furur. Bu vergilerin veya har\u00e7lar\u0131n eksik ya da hatal\u0131 beyan edilmesi durumunda, taraflar mali cezalarla kar\u015f\u0131la\u015fabilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Vergisel d\u00fczenlemelere uygun hareket edilmemesi, in\u015faat s\u00fcrecinde veya sonras\u0131nda mali sorunlara yol a\u00e7abilir.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">8. <strong>S\u00f6zle\u015fmenin Ge\u00e7ersiz veya H\u00fck\u00fcms\u00fcz Olmas\u0131<\/strong><\/span><\/h3>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kat kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin eksik veya hatal\u0131 d\u00fczenlenmesi, s\u00f6zle\u015fmenin ge\u00e7ersiz veya h\u00fck\u00fcms\u00fcz say\u0131lmas\u0131na neden olabilir.
