Konut fiyatlar\u0131ndaki h\u0131zl\u0131 art\u0131\u015f, y\u00fcksek enflasyon, kredi maliyetlerinin y\u00fckselmesi, deprem sonras\u0131 ya\u015fanan arz sorunlar\u0131, b\u00fcy\u00fck\u015fehirlerde yo\u011funla\u015fan i\u00e7 g\u00f6\u00e7 ve artan n\u00fcfus bask\u0131s\u0131, kira ili\u015fkilerini hem bireysel d\u00fczeyde hem de makro \u00f6l\u00e7ekte bir \u201c<em>hukuki problem alan\u0131<\/em>\u201d h\u00e2line getirmi\u015ftir.\u00a0Bug\u00fcn T\u00fcrkiye\u2019de milyonlarca ki\u015fi s\u00fcrekli kirac\u0131 olarak ya\u015fam\u0131n\u0131 s\u00fcrd\u00fcrmekte, y\u00fcz binlerce i\u015fletme kira ile tuttuklar\u0131 i\u015fyerlerinde faaliyette bulunmaktad\u0131r. Bu tablo, kira hukukunu; yaln\u0131zca \u201c<em>m\u00fclk sahibi &#8211; kirac\u0131<\/em>\u201d \u00e7at\u0131\u015fmas\u0131n\u0131n teknik bir alt dal\u0131 olmaktan \u00e7\u0131kar\u0131p, bar\u0131nma hakk\u0131, ticaret \u00f6zg\u00fcrl\u00fc\u011f\u00fc, yat\u0131r\u0131m g\u00fcvenli\u011fi ve sosyal adalet gibi temel kavramlarla ili\u015fkili bir alan h\u00e2line getirmektedir. Bu yaz\u0131da T\u00fcrkiye\u2019de konut ve ticari kiralama ili\u015fkilerinin olgusal boyutu, piyasa dinamikleri, hukuki \u00e7er\u00e7eve, g\u00fcncel geli\u015fmeler ve uygulamada ortaya \u00e7\u0131kan temel uyu\u015fmazl\u0131k t\u00fcrleri, B\u0131\u00e7ak Hukuk B\u00fcrosu\u2019nun pratik deneyimiyle uyumlu bir perspektiften ele al\u0131nmaktad\u0131r.<!--more--><\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Olgusal \u00c7er\u00e7eve: T\u00fcrkiye\u2019de Konut Kiralama Ger\u00e7e\u011fi<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kirac\u0131l\u0131k Oran\u0131ndaki Y\u00fckseli\u015f ve De\u011fi\u015fen Toplumsal Yap\u0131: T\u00fcrkiye\u2019de uzun y\u0131llar \u201cev sahibi olmak\u201d temel bir sosyal hedef olarak g\u00f6r\u00fcld\u00fc. Ancak son on\u2013on be\u015f y\u0131lda ekonomik \u015fartlar bu idealin ger\u00e7ekle\u015fmesini zorla\u015ft\u0131rd\u0131. TU\u0130K verileri, toplam hane say\u0131s\u0131n\u0131n 26 milyonu a\u015ft\u0131\u011f\u0131n\u0131, kirada oturan hane oran\u0131n\u0131n ise yakla\u015f\u0131k y\u00fczde 28\u2019e y\u00fckseldi\u011fini ortaya koymaktad\u0131r. Bu oran, kabaca 7 milyondan fazla hanenin kirac\u0131 stat\u00fcs\u00fcnde oldu\u011fu anlam\u0131na gelir. Ev sahipli\u011fi oran\u0131n\u0131n d\u00fc\u015fmesi, kirac\u0131l\u0131\u011f\u0131n ge\u00e7ici bir \u201c<em>hayat evresi<\/em>\u201d olmaktan \u00e7\u0131k\u0131p, geni\u015f kitleler i\u00e7in kal\u0131c\u0131 bir ya\u015fam bi\u00e7imi h\u00e2line geldi\u011fini g\u00f6stermektedir. \u00d6zellikle gen\u00e7 profesyoneller, \u00f6\u011frenciler, yeni evlenen \u00e7iftler ve b\u00fcy\u00fck \u015fehirlere g\u00f6\u00e7 eden kesimler i\u00e7in kirac\u0131l\u0131k art\u0131k uzun vadeli bir konut edinme stratejisi olarak kar\u015f\u0131m\u0131za \u00e7\u0131kmaktad\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira Fiyatlar\u0131nda S\u0131\u00e7rama ve Bar\u0131nma Krizi: Konut kiralar\u0131nda ya\u015fanan art\u0131\u015f, T\u00fcrkiye\u2019nin en tart\u0131\u015fmal\u0131 ekonomik ba\u015fl\u0131klar\u0131ndan biridir. B\u00fcy\u00fck\u015fehirlerde son be\u015f y\u0131lda kira bedellerinin bir\u00e7ok b\u00f6lgede birka\u00e7 kat\u0131na \u00e7\u0131kt\u0131\u011f\u0131; \u00f6zellikle deprem sonras\u0131 g\u00f6\u00e7 alan illerde kiralar\u0131n k\u0131sa s\u00fcre i\u00e7inde ola\u011fan\u00fcst\u00fc seviyelere ula\u015ft\u0131\u011f\u0131 g\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Kira bedellerinin artmas\u0131, yaln\u0131zca kirac\u0131lar a\u00e7\u0131s\u0131ndan b\u00fct\u00e7e bask\u0131s\u0131 yaratmamakta; ayn\u0131 zamanda aile i\u00e7i ya\u015fam bi\u00e7imini, \u015fehir se\u00e7imlerini, i\u015f &#8211; konut mesafesini ve \u00e7ocuklar\u0131n e\u011fitim olanaklar\u0131n\u0131 da do\u011frudan etkilemektedir. \u201c<em>Bar\u0131nma krizi<\/em>\u201d kavram\u0131, bu nedenle salt ekonomik de\u011fil, ayn\u0131 zamanda sosyal ve hukuki bir nitelik kazanm\u0131\u015ft\u0131r.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bireysel M\u00fclkiyetin Hakimiyeti: Par\u00e7al\u0131 Piyasa Yap\u0131s\u0131: T\u00fcrkiye konut kiralama piyasas\u0131n\u0131n belirgin \u00f6zelliklerinden biri, m\u00fclk sahipli\u011finin b\u00fcy\u00fck \u00f6l\u00e7\u00fcde bireysel yat\u0131r\u0131mc\u0131larda toplanm\u0131\u015f olmas\u0131d\u0131r. Birikimini konutta de\u011ferlendiren \u00e7ok say\u0131da ki\u015fi, 1 &#8211; 2 dairelik portf\u00f6ylerle konut kiralama faaliyetine girmektedir. Bu durum, kurumsal konut kiralama \u015firketlerinin ve fonlar\u0131n a\u011f\u0131rl\u0131kta oldu\u011fu, standardize edilmi\u015f kiralama modellerine sahip Bat\u0131 \u00fclkelerinden farkl\u0131 bir yap\u0131 ortaya koyar. Par\u00e7al\u0131 m\u00fclkiyet ve bireysel davran\u0131\u015f \u00e7e\u015fitlili\u011fi, kira s\u00f6zle\u015fmelerinin niteli\u011fine, uyarlama tart\u0131\u015fmalar\u0131na, tahliye taleplerine ve uyu\u015fmazl\u0131klar\u0131n \u00e7\u00f6z\u00fcm bi\u00e7imlerine do\u011frudan yans\u0131maktad\u0131r. Piyasan\u0131n bu da\u011f\u0131n\u0131k yap\u0131s\u0131, teknik hukuki bilgiye duyulan ihtiyac\u0131 da art\u0131rmaktad\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ticari Kiralamalar: B\u00fcy\u00fcyen Bir Pazar, Artan Hukuki Riskler<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ticari Gayrimenkul Piyasas\u0131n\u0131n Ekonomik A\u011f\u0131rl\u0131\u011f\u0131: Konut kiralamalar\u0131n\u0131n yan\u0131 s\u0131ra, T\u00fcrkiye\u2019de ticari kiralama piyasas\u0131 da son derece b\u00fcy\u00fck bir ekonomik hacme sahiptir. Uluslararas\u0131 raporlara g\u00f6re T\u00fcrkiye\u2019nin ticari gayrimenkul pazar\u0131n\u0131n de\u011feri onlarca milyar dolar seviyesindedir ve \u00f6n\u00fcm\u00fczdeki y\u0131llarda \u00f6zellikle lojistik ve perakende sekt\u00f6rlerinde b\u00fcy\u00fcme potansiyeli ta\u015f\u0131maktad\u0131r. \u0130stanbul, Ankara, \u0130zmir gibi b\u00fcy\u00fck \u015fehirler; hem yerli hem yabanc\u0131 yat\u0131r\u0131mc\u0131lar i\u00e7in b\u00f6lgesel bir merkez niteli\u011findedir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ofis ve Perakende Alanlar\u0131nda Y\u00fcksek Kira D\u00fczeyleri: \u0130stanbul\u2019un finans ve i\u015f merkezleri konumundaki b\u00f6lgelerinde A s\u0131n\u0131f\u0131 ofislerin metrekare kira bedelleri, pek \u00e7ok Do\u011fu Avrupa ve b\u00f6lgesel rakip \u015fehirle kar\u015f\u0131la\u015ft\u0131r\u0131labilir d\u00fczeye ula\u015fm\u0131\u015ft\u0131r. Benzer \u015fekilde, l\u00fcks perakende segmentinde belli caddelerdeki ma\u011faza kiralar\u0131, k\u00fcresel \u00f6l\u00e7ekte dikkat \u00e7eken seviyelerdedir. Bu kira d\u00fczeyleri, yat\u0131r\u0131mc\u0131lar a\u00e7\u0131s\u0131ndan cazip bir getiri potansiyeli sunarken, kirac\u0131 konumundaki \u015firketler i\u00e7in \u00f6nemli bir maliyet kalemi olu\u015fturmaktad\u0131r. Pandemi sonras\u0131 hibrit \u00e7al\u0131\u015fma modelleri, e-ticaretin y\u00fckseli\u015fi ve al\u0131\u015fveri\u015f al\u0131\u015fkanl\u0131klar\u0131ndaki de\u011fi\u015fim de ticari kiralamalarda yeni bir denge aray\u0131\u015f\u0131n\u0131 beraberinde getirmi\u015ftir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">GYO\u2019lar, Fonlar ve Kurumsal Akt\u00f6rler: Ticari kira piyasas\u0131nda gayrimenkul yat\u0131r\u0131m ortakl\u0131klar\u0131 (GYO\u2019lar), emeklilik fonlar\u0131, sigorta \u015firketleri ve uluslararas\u0131 gayrimenkul fonlar\u0131 gibi akt\u00f6rler \u00f6nemli rol oynamaktad\u0131r. Bu akt\u00f6rler, geni\u015f portf\u00f6ylere sahip olup, kira gelirlerine dayal\u0131 yat\u0131r\u0131m modelleri geli\u015ftirirler. Kurumsal yat\u0131r\u0131mc\u0131lar\u0131n h\u00e2kim oldu\u011fu bu alanda kira s\u00f6zle\u015fmeleri \u00e7ok daha ayr\u0131nt\u0131l\u0131, profesyonel ve uzun vadeli \u00e7er\u00e7evelerle kaleme al\u0131n\u0131r. Ciroya endeksli kira modelleri, kira serbestisi ve fesih \u015fartlar\u0131 gibi h\u00fck\u00fcmler, ticari kiralamalar\u0131, konut kira s\u00f6zle\u015fmelerinden ciddi bi\u00e7imde ay\u0131r\u0131r. Bu s\u00f6zle\u015fmelerin m\u00fczakeresi ve uygulanmas\u0131, ba\u015fl\u0131 ba\u015f\u0131na uzmanl\u0131k gerektiren bir aland\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yasal \u00c7er\u00e7eve: Kira \u0130li\u015fkilerinin Dayand\u0131\u011f\u0131 Temel Normlar<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrk Bor\u00e7lar Kanunu (TBK), kira s\u00f6zle\u015fmesini \u201c<em>kiraya verenin, kiralanan\u0131 kullanma veya kullanma ve yararlanma hakk\u0131n\u0131 kirac\u0131ya b\u0131rakmay\u0131, kirac\u0131n\u0131n da bunun kar\u015f\u0131l\u0131\u011f\u0131nda kira bedeli \u00f6demeyi \u00fcstlendi\u011fi s\u00f6zle\u015fme<\/em>\u201d olarak tan\u0131mlar. TBK\u2019da \u00f6nce t\u00fcm kira ili\u015fkileri i\u00e7in ge\u00e7erli genel h\u00fck\u00fcmler; ard\u0131ndan konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131na \u00f6zg\u00fc h\u00fck\u00fcmler yer al\u0131r. Genel h\u00fck\u00fcmler; kira bedelinin \u00f6denmesi, temerr\u00fct, kiralanan\u0131n teslimi, ay\u0131plar, bak\u0131m ve onar\u0131m, yan giderler, s\u00f6zle\u015fmenin sona ermesi gibi temel alanlar\u0131 d\u00fczenler. Bu h\u00fck\u00fcmler, hem konut hem ticari kiralamalar i\u00e7in \u00e7er\u00e7eve niteli\u011findedir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">TBK\u2019da konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131 i\u00e7in kirac\u0131y\u0131 koruyan bir yakla\u015f\u0131m benimsenmi\u015ftir. S\u00f6zle\u015fmenin belirli veya belirsiz s\u00fcreli olmas\u0131na g\u00f6re uzama s\u00fcreleri, kiraya verenin fesih imk\u00e2nlar\u0131, tahliye sebepleri, kira art\u0131\u015f oran\u0131na getirilen s\u0131n\u0131rlamalar, depozito uygulamas\u0131 gibi hususlar kirac\u0131 lehine s\u0131n\u0131rlay\u0131c\u0131 kurallarla \u00e7er\u00e7evelendirilmi\u015ftir. Kira art\u0131\u015f\u0131nda, normal ko\u015fullarda, 12 ayl\u0131k T\u00dcFE ortalamas\u0131n\u0131 a\u015famayacak bir \u00fcst s\u0131n\u0131r s\u00f6z konusudur. Bir d\u00f6nem uygulanan y\u00fczde 25 tavan oran\u0131, konut kiralar\u0131nda ge\u00e7ici bir m\u00fcdahaleydi ve s\u00fcresi dolmu\u015ftur. Bununla birlikte, s\u00f6zle\u015fmenin s\u00fcresi ve niteli\u011fi dikkate al\u0131narak kira tespit davalar\u0131 yoluyla mahkeme denetimi her zaman s\u00f6z konusu olabilir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ticari kiralamalarda taraflar genellikle tacir olup, s\u00f6zle\u015fme serbestisinin daha geni\u015f yorumland\u0131\u011f\u0131 bir alan s\u00f6z konusudur. Yine de TBK\u2019n\u0131n konut ve \u00e7at\u0131l\u0131 i\u015fyeri kiralar\u0131na ili\u015fkin baz\u0131 koruyucu h\u00fck\u00fcmleri, i\u015fyeri kirac\u0131s\u0131 lehine de uygulan\u0131r. \u00d6zellikle k\u00fc\u00e7\u00fck esnaf ve KOB\u0130\u2019ler a\u00e7\u0131s\u0131ndan bu koruma hayati niteliktedir. 2018 sonras\u0131 d\u00f6vizle kira yasa\u011f\u0131 ve istisnalar\u0131, ticari kiralamalarda en \u00f6nemli g\u00fcncel konulardan biri olmu\u015ftur. D\u00f6vizle belirlenen kira bedellerinin T\u00fcrk Liras\u0131na \u00e7evrilmesi, baz\u0131 sekt\u00f6rler i\u00e7in getirilen istisnalar ve bu s\u00fcre\u00e7te ortaya \u00e7\u0131kan uyarlama davalar\u0131, kira hukukunun ticari hayatla kesi\u015fti\u011fi kritik alanlardan biridir.<\/span><\/p>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ekonomik \u015fartlardaki radikal de\u011fi\u015fiklikler, kira bedelinin taraflardan biri i\u00e7in d\u00fcr\u00fcstl\u00fck kural\u0131na g\u00f6re katlan\u0131lamayacak h\u00e2le gelmesine yol a\u00e7abilir. TBK m. 138\u2019de d\u00fczenlenen \u201c<em>a\u015f\u0131r\u0131 ifa g\u00fc\u00e7l\u00fc\u011f\u00fc<\/em>\u201d kurumu, bu gibi durumlarda s\u00f6zle\u015fmenin uyarlanmas\u0131n\u0131 talep etme imk\u00e2n\u0131 tan\u0131r.\u00a0\u00d6zellikle y\u00fcksek enflasyon d\u00f6nemlerinde ya da d\u00f6viz kurlar\u0131nda ani ve \u00f6ng\u00f6r\u00fclemez hareketlerin ya\u015fand\u0131\u011f\u0131 s\u00fcre\u00e7lerde, hem kirac\u0131lar hem kiraya verenler s\u00f6zle\u015fmelerinin \u201cekonomik dengesinin bozuldu\u011fu\u201d iddias\u0131yla uyarlama davas\u0131 a\u00e7abilmektedir. Mahkemeler de bu davalarda taraflar\u0131n menfaat dengesini g\u00f6zeten ve somut olay\u0131n ko\u015fullar\u0131na g\u00f6re de\u011fi\u015fen kararlar vermektedir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00fcncel Geli\u015fmeler ve Uygulamada Kar\u015f\u0131la\u015f\u0131lan Temel Uyu\u015fmazl\u0131klar<\/span><\/h3>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira Art\u0131\u015f Oranlar\u0131 ve Kira Tespit Davalar\u0131<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Son y\u0131llar\u0131n en \u00f6nemli tart\u0131\u015fma ba\u015fl\u0131klar\u0131ndan biri, kira art\u0131\u015f oranlar\u0131d\u0131r. T\u00dcFE ortalamas\u0131, kira art\u0131\u015f\u0131nda \u00fcst s\u0131n\u0131r olmakla birlikte, eski tarihli s\u00f6zle\u015fmelerde kira bedelinin piyasan\u0131n \u00e7ok gerisinde kald\u0131\u011f\u0131 iddias\u0131yla kira tespit davas\u0131 a\u00e7\u0131lmas\u0131 olduk\u00e7a yayg\u0131nd\u0131r.\u00a0Mahkemeler kira tespitinde; emsal kiralar, b\u00f6lgedeki genel piyasa \u015fartlar\u0131, kiralanan\u0131n \u00f6zellikleri ve s\u00f6zle\u015fme ge\u00e7mi\u015fini dikkate alarak \u201chakkaniyete uygun\u201d bir kira bedeli belirlemeye \u00e7al\u0131\u015f\u0131r. Bu s\u00fcre\u00e7te bilirki\u015fi incelemeleri ve emsal ara\u015ft\u0131rmalar\u0131 \u00f6nemli rol oynar.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Tahliye Talepleri ve \u0130htiya\u00e7 Sebebiyle Tahliye<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Konut ve i\u015fyeri kiralar\u0131nda tahliye davalar\u0131, kira hukukunun en hassas alanlar\u0131ndan biridir. Kiraya veren, kiralanan\u0131 kendisi, e\u015fi, altsoyu veya \u00fcstsoyu i\u00e7in kullanma ihtiyac\u0131 do\u011fdu\u011funda ya da yeniden in\u015fa\u2013imar gibi zorunlu sebeplerle tahliye talebinde bulunabilmektedir. Tahliye davalar\u0131nda mahkemeler, ger\u00e7ekten samimi bir ihtiya\u00e7 olup olmad\u0131\u011f\u0131n\u0131 ve bu ihtiyac\u0131n ba\u015fka yollarla kar\u015f\u0131lan\u0131p kar\u015f\u0131lanamayaca\u011f\u0131n\u0131 titizlikle incelemektedir. Kira hukuku uygulamas\u0131nda k\u00f6t\u00fcye kullan\u0131m ihtimalleri ve \u201cformal gerek\u00e7eli tahliye\u201d giri\u015fimleri sebebiyle bu alan, yo\u011fun bir yarg\u0131sal denetime tabidir.<\/span><\/p>\n<h4><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Zorunlu Arabuluculuk ve Uyu\u015fmazl\u0131k \u00c7\u00f6z\u00fcm\u00fc<\/span><\/h4>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Kira ili\u015fkilerinden do\u011fan uyu\u015fmazl\u0131klarda zorunlu arabuluculuk uygulanmas\u0131, hem konut hem ticari kiralamalarda \u00f6nemli bir d\u00f6n\u00fcm noktas\u0131 olmu\u015ftur. Art\u0131k kira tespiti, tahliye, alacak, uyarlama ve benzeri konularda dava a\u00e7\u0131lmadan \u00f6nce arabuluculuk s\u00fcrecine ba\u015fvurmak zorunludur. Bu s\u00fcre\u00e7, taraflara daha d\u00fc\u015f\u00fck maliyetli ve daha h\u0131zl\u0131 bir \u00e7\u00f6z\u00fcm imk\u00e2n\u0131 sunabilir.
