The organisation enables law enforcement agencies from its 194 member states to share data on crimes and criminals and issue arrest warrants.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Being the largest global police organization with 194 member countries, <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> has a vital role in connecting police organizations to fight international crime worldwide. The primary functions of <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> include issuing Red Notices and diffusion communications among member police organizations. On average, <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> issues more than 10,000 Red Notices and more than 100,000 wanted-person alerts every year.\u00a0<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">INTERPOL National Central Bureau (NCB)<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Each of our member countries hosts an <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> National Central Bureau (NCB). This connects their national law enforcement with other countries and with the General Secretariat via Interpol secure global police communications network called I-24\/7.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">NCBs are at the heart of <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> and how <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> works. They seek the information needed from other NCBs to help investigate crime or criminals in their own country, and they share criminal data and intelligence to assist another country.\u00a0\u00a0\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">As part of their role in global investigations, NCBs work with:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Law enforcement agencies in their own country<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Other NCBs and Sub-Bureaus around the World<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The General Secretariat\u2019s offices worldwide<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">NCBs contribute national crime data to \u0130nterpol global\u00a0<a href=\"https:\/\/www.interpol.int\/How-we-work\/Databases\">databases<\/a>, in accordance with their respective national laws, and cooperate on cross-border investigations, operations and arrests.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Functions<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Interpol concentrates on three broad categories of international criminal activity:\u00a0terrorism\u00a0and crimes against people and property, including crimes against children, trafficking in human beings, illegal immigration, automobile theft, and art theft; economic, financial, and computer crimes, including banking fraud,\u00a0money laundering, corruption, and\u00a0counterfeiting; and illegal drugs and criminal organizations, including\u00a0organized crime.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In contrast to the image occasionally conveyed on television and in the movies, Interpol agents do not make arrests, a practice that would unacceptably infringe on the national\u00a0sovereignty\u00a0of member countries. Instead, the organization, at the request of NCBs, sends out \u201cred notices,\u201d based on warrants issued by member countries, calling for the\u00a0arrest\u00a0and\u00a0extradition\u00a0of specific individuals.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Red Notice<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Red Notices are issued where a country seeks the location and arrest of wanted individuals with a view to their extradition. As such, an <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> Red Notice can severely inhibit a person\u2019s liberty, ability to travel and to conduct business. It can have devastating consequences for a person\u2019s reputation and can also lead to the closure of bank accounts.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Whilst some Red Notices will be published on the <a href=\"https:\/\/www.interpol.int\/\">INTERPOL<\/a> website, often a person will be unaware that a notice has been issued. A Red Notice may lead to arrest regardless of whether there is an extradition arrangement in place between countries. Even where an extradition request has been defeated, it is likely that a Red Notice will remain live.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u201cColoured\u201d notices<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Interpol also issues other \u201ccoloured\u201d notices: yellow to help locate missing persons, blue to collect information on illegal activities or on an individual\u2019s identity, black to request information needed to identify a body, green to warn agencies about criminals from one country who may commit additional offenses in other countries, and orange to warn law-enforcement agencies of dangers from bombs and other weapons.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Susceptibity to political abuse by autocratic governments<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Red Notices can result from politically motivated criminal proceedings or can arise out of civil disputes. We regularly advise professionals who face the issue of a Red Notice in the context of hostile civil litigation and where the threat of criminal prosecution is a recognised tactic.\u00a0<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">While INTERPOL\u2019s involvement is necessary for law enforcement at the international level, the organization has been susceptible to political abuse by autocratic governments. Countries known to be human-rights abusers and intolerant of political criticism have misused INTERPOL to track down political dissidents in other countries and persecute them in their homeland. Moreover, the unlawful use of INTERPOL leads to detrimental consequences for the suspects who are not prosecuted in a fair trial.\u00a0 Any person named in a Red Notice, for example, could be subject to arrest and imprisonment, cancellation of a visa, deportation, being barred from accessing financial systems, and a tarnished reputation for being accused\u2014most likely in public\u2014of being an international criminal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Article 3 of the\u00a0<a href=\"https:\/\/www.jus.uio.no\/english\/services\/library\/treaties\/14\/14-02\/interpol-constitution.xml\">INTERPOL Constitution<\/a>\u00a0states: \u201c<em>It is strictly forbidden for the Organization to undertake any intervention or activities of a political, military, religious or racial character.<\/em>\u201d Autocratic countries have been violating INTERPOL\u2019s rules and misusing the organization, which is supposed to focus on non-political crimes, such as drug trafficking and violent offenses.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">How is a red notice issued in Turkey?<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The red notice is not the only type of notice that Interpol issues for international cooperation. It also has blue, green, black, yellow and orange notices and the &#8220;UNSC Special Notice.&#8221;<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Every type of notice has a different meaning but they all allow the countries to share their warnings and requests for information globally.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The red notice is a request for the &#8220;<em>arrest and extradition of criminals<\/em>.&#8221; Its legal basis can be an arrest warrant issued by courts or a court ruling.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In Turkey, the court ruling or the request of the prosecutor&#8217;s office is forwarded to the Ministry of Justice. If the ministry&#8217;s General Directorate of International Law and Foreign Relations deems it appropriate, it sends the request to the Interpol Department of the General Directorate of Security, which then sends it to the Interpol General Secretariat.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Interpol regulations<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Notices from countries are only issued if they comply with Interpol&#8217;s regulations and meet all legal requirements.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">But most member states see the red notice as a valid request for temporary arrest. Since the red notice has no power of sanction, the person concerned can&#8217;t be extradited solely on the basis of this request. Extradition proceedings must be made in the country where the extradition request is made. The person should stand an &#8220;extradition trial&#8221; in the country that receives the request.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">If the court decides that there is no legal problem within the framework of the national legislation regarding the extradition of the person, it can issue an extradition order. The person whose extradition is requested can appeal an extradition order.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">&#8220;Diffusions&#8221;<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Lately, Interpol carefully scrutinizes the red notice requests by Turkey and does not accept requests that it considers to be &#8220;political.&#8221; Diffusions, or less formal notices, can be applied when a red notice request is rejected.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">An Interpol diffusion is an informal alert circulated by any Interpol member state to notify law enforcement authorities about a person wanted for criminal activities. Although it contains information similar to the Interpol red notice, a\u00a0diffusion notice Interpol\u00a0is more of an informal alert used to arrest and extradite a person wanted for crimes. Unlike other notices, a diffusion is not published on the Interpol website. Instead, the country seeking help circulates it through Interpol channels.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">How Interpol Diffusions and Notices Work?<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Every member country has its own NCB (National Central Bureau) responsible for sending notice requests to Interpol\u2019s General Secretariat. Before the General Secretariat publishes any Interpol notice or Interpol diffusion request, the request must be reviewed by the Commission for the Control of Interpol\u2019s Files (CCF) to ensure it conforms to Interpol rules and regulations. <strong>The CCF<\/strong> is an independent body responsible for reviewing data processed through Interpol\u2019s Information System, including diffusions and notices.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Typically, diffusions are circulated directly by the NCB to member countries or international entities of their choice. Just like\u00a0Interpol red diffusion, diffusions are sent via Interpol\u2019s secure information system and recorded in Interpol databases. The requests usually contain the following details;<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">A person\u2019s identity: This includes their physical description, identification documents, fingerprints, photographs, and any other relevant information.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Judicial information: This includes details of the offense, the law covering the crime, the court sentence, and judicial reference to the arrest warrant.<\/span><\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Apart from member countries, International entities like the UN, the International Criminal Court, and International Criminal Tribunals can use Interpol international alerts to locate fugitives wanted for committing crimes within their jurisdictions. These may be war crimes, genocide, and crimes against humanity.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">How to Know if You Are Subject to a Diffusion or a Red Notice?<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">It\u2019s usually difficult to know if your information is on Interpol\u2019s alert list.\u00a0However, you may find out using the following steps:<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Check your name on the \u2018Interpol\u2019s wanted persons\u2019 list: One downside of checking your name on the Interpol website is that the list only features selected types of red notices. Additionally, the organization publishes other types of alerts on a restricted network, making them visible to law enforcement agencies only.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ask the Police or Judicial authorities: Local judicial authorities or the police may be able to help you find out if you are subject to diffusion or red notice. However, there is no formal way for this process since the police may be barred from consulting Interpol records and disclosing the information to the public.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Requesting the information from CCF: You can also request the CCF for access to your file. <strong>The process can be challenging and requires the help of an experienced lawyer<\/strong>. <strong>Not only can the lawyer help you gain access to your file, but also challenge the information<\/strong>. Note that the process may take some time since the CCF must consult with the NCB of the involved country. However, the CCF doesn\u2019t necessarily have to get approval from the NCB if you have enough proof that your information is featured on Interpol\u2019s files.<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">How to Request for the Removal or Deletion of a Diffusion or a Red Notice?<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The CCF rejects any notice request that violates Interpol\u2019s Constitution. Diffusions and red notices must meet admissibility requirements according to CCF regulations. This allows you to request a correction or deletion of diffusions and Interpol red notices issued against you if you believe they are illegal. Here is the process representing a notice removal.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Request the judicial authorities of the country that sent the diffusion or red Notice to delete the information. This process requires the help of an experienced lawyer since it is usually challenging.<\/span><\/p>\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Request national authorities in your country to ask Interpol to delete your information from its databases. <strong>Again you need the help of a qualified lawyer to do so<\/strong>.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Request the CCF to recommend the removal of your information from Interpol databases. This request must meet the admissibility requirements.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Contact the CCF and request to recommend the deletion of your information. This request must comply with the admissibility requirements according to the Rules on the Processing of Data (RPD).<\/span><\/li>\n<\/ul>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Admissibility Requirements for Diffusion and Red Notice Removal Requests<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Admissibility requirements give you the legal basis for challenging Interpol\u2019s red notices and diffusions.
