ABD Hukuk\u00ee \u00c7er\u00e7evesi ve T\u00fcrkiye A\u00e7\u0131s\u0131ndan Temel D\u00fczenlemeler<\/span><\/h3>\n<p data-start=\"1932\" data-end=\"2337\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA, ABD\u2019nin d\u0131\u015f politika ve g\u00fcvenlik stratejisinin bir par\u00e7as\u0131 olarak haz\u0131rlanm\u0131\u015f; \u00f6zellikle Rusya, \u0130ran ve Kuzey Kore gibi \u00fclkelere yapt\u0131r\u0131m\u0131 ama\u00e7layan bir yasal mekanizmad\u0131r. Ancak 231. madde, bu \u00fc\u00e7 \u00fclke ile savunma, istihbarat veya a\u011f\u0131r silah sistemleri alan\u0131nda \u201c<em>\u00f6nemli i\u015flem<\/em>\u201d yapan \u00fc\u00e7\u00fcnc\u00fc \u00fclke ve kurumlar\u0131 do\u011frudan hedef alabilecek \u015fekilde tasarlanm\u0131\u015ft\u0131r.\u00a0<\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye ise 2019 y\u0131l\u0131nda Rusya\u2019dan sat\u0131n ald\u0131\u011f\u0131 S-400 hava savunma sistemleri nedeniyle bu kapsama d\u00e2hil edilmi\u015f; 14 Aral\u0131k 2020\u2019de Savunma Sanayii Ba\u015fkanl\u0131\u011f\u0131 (SSB) ve baz\u0131 \u00fcst d\u00fczey yetkililer yapt\u0131r\u0131m listesine al\u0131nm\u0131\u015ft\u0131r.<\/span><\/p>\n<p data-start=\"2605\" data-end=\"3053\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA yapt\u0131r\u0131mlar\u0131, bir yandan ABD\u2019nin ihracat lisans\u0131 yasa\u011f\u0131, kredi ve finansman k\u0131s\u0131tlamas\u0131, kredi\/ithalat bankac\u0131l\u0131\u011f\u0131 yasa\u011f\u0131, ihracat-ithalat finansman deste\u011fi kesintisi gibi ekonomik tedbirleri kapsarken; di\u011fer yandan devlet ve \u015firket d\u00fczeyinde \u201c<em>itibar kayb\u0131, finansal izolasyon, i\u015f birli\u011fi yasaklar\u0131, ihracat engelleri, tedarik zinciri k\u0131r\u0131lganl\u0131\u011f\u0131<\/em>\u201d gibi uzun vadeli stratejik riskler de yaratmaktad\u0131r. <\/span><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu \u00e7er\u00e7evede CAATSA, basit bir ekonomik yapt\u0131r\u0131m yasas\u0131ndan \u00f6te, uluslararas\u0131 savunma sistemleri ve d\u0131\u015f politika dengeleri ile i\u00e7 i\u00e7e ge\u00e7mi\u015f \u00e7ok katmanl\u0131 bir kontrol mekanizmas\u0131 olarak de\u011ferlendirilmektedir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">On \u0130ki Adet Farkl\u0131 Yapt\u0131r\u0131m<\/span><\/h3>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yapt\u0131r\u0131mlar\u0131n neler olabilece\u011fi ise, CAATSA Yasas\u0131n\u0131n 235. maddesinde 12 adet farkl\u0131 yapt\u0131r\u0131m olarak d\u00fczenlenmi\u015ftir. Bunlar;<\/span><\/p>\n<ul>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>ABD \u0130hracat-\u0130thalat Bankas\u0131\u2019n\u0131n Deste\u011finin Kesilmesi<\/strong>: ABD Ba\u015fkan\u0131, yapt\u0131r\u0131m uygulanan ki\u015filere y\u00f6nelik olarak ABD \u0130hracat-\u0130thalat Bankas\u0131\u2019na, bu ki\u015filerin mal ve hizmet ihracat\u0131 ile ilgili hi\u00e7bir garanti, sigorta, kredi art\u0131rma, kredi art\u0131r\u0131ma kat\u0131l\u0131m taleplerine onay vermemesi y\u00f6n\u00fcnde talimat verebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>\u0130hracat Yapt\u0131r\u0131m\u0131<\/strong>: ABD Ba\u015fkan\u0131, yapt\u0131r\u0131m uygulanan ki\u015finin herhangi bir mal veya teknoloji ihracat\u0131na y\u00f6nelik olarak, ABD H\u00fck\u00fcmeti\u2019nin \u00f6nc\u00fcl incelemesinin ve onay\u0131n\u0131n zorunlu oldu\u011fu hallerde, ABD H\u00fck\u00fcmeti\u2019ne, s\u00f6z konusu ki\u015finin ihracat faaliyetlerine ili\u015fkin herhangi bir lisans, izin veya yetki vermemesi y\u00f6n\u00fcnde talimat verebilir. Bu talimat, \u0130hracat Y\u00f6netim Kanunu (the Export Administration Act of 1979), Silah \u0130hracat\u0131 Denetim Kanunu (the Arms Export Control Act) ve Atomik Enerji Kanunu (Atomic Energy Act of 1954) kapsam\u0131ndaki ABD H\u00fck\u00fcmeti\u2019nin lisans, izin veya yetki sa\u011flama kararlar\u0131na da uygulanabilmektedir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>ABD Finansal Kurumlar\u0131ndan Al\u0131nan Kredilerin Engellenmesi<\/strong>: \u0130nsani yard\u0131m faaliyetleriyle i\u015ftigal eden ki\u015filer ve bu faaliyetler i\u00e7in sa\u011flanan kredi ve bor\u00e7lar hari\u00e7 olmak \u00fczere, ABD finansal kurumlar\u0131n\u0131n yapt\u0131r\u0131m uygulanan ki\u015filere 12 ayl\u0131k periyotlar i\u00e7in toplam 10.000.000 ABD Dolar\u0131ndan fazla kredi veya bor\u00e7 vermesi engellenebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Uluslararas\u0131 Finans Kurulu\u015flar\u0131ndan Al\u0131nan Kredilerin Engellenmesi<\/strong>: ABD Ba\u015fkan\u0131, uluslararas\u0131 finans kurulu\u015flar\u0131nda s\u00f6z ve oy hakk\u0131na sahip ABD temsilcilerinin (veya y\u00f6neticilerinin) yapt\u0131r\u0131m kapsam\u0131ndaki ki\u015filer taraf\u0131ndan bu kurulu\u015flardan talep edilen finansal imkanlara ili\u015fkin olumsuz oy vermesi y\u00f6n\u00fcnde talimat verebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Finans Kurulu\u015flar\u0131na Y\u00f6nelik Yasaklar\u0131n \u00d6ng\u00f6r\u00fclmesi<\/strong>: Yapt\u0131r\u0131m uygulanan ki\u015finin bir finans kurulu\u015fu olmas\u0131 durumunda, bu kurulu\u015fun ABD piyasalar\u0131ndaki i\u015flemlerine \u00e7e\u015fitli k\u0131s\u0131tlamalar getirilebilir veya bu kurulu\u015flar\u0131n ABD\u2019nin devlet tahvilleri \u00fczerinden i\u015flem yapmas\u0131 engellenebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>\u0130hale Yapt\u0131r\u0131m\u0131<\/strong>: ABD H\u00fck\u00fcmeti\u2019nin yapt\u0131r\u0131m uygulanan ki\u015fi ile bu ki\u015finin sa\u011flad\u0131\u011f\u0131 mal ve hizmetlere ili\u015fkin herhangi bir s\u00f6zle\u015fmesel ili\u015fki i\u00e7erisine girmesi ve bu ki\u015filerden kamu al\u0131m\u0131 yapmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Yabanc\u0131 Para Birimine \u0130li\u015fkin Yapt\u0131r\u0131mlar<\/strong>: ABD yarg\u0131 yetkisine tabi olan i\u015flemler bak\u0131m\u0131ndan, yapt\u0131r\u0131m uygulanan ki\u015finin menfaati dahilinde bulunan yabanc\u0131 para birimi ile i\u015flem yap\u0131lmas\u0131 engellenebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Bankac\u0131l\u0131k \u0130\u015flemlerine \u0130li\u015fkin K\u0131s\u0131tlamalar<\/strong>: ABD yarg\u0131 yetkisine tabi olmak ko\u015fuluyla, yapt\u0131r\u0131ma konu ki\u015finin yarar\u0131na olan finansal kurulu\u015flar aras\u0131nda veya bu kurulu\u015flar arac\u0131l\u0131\u011f\u0131yla ya da bu kurulu\u015flara ger\u00e7ekle\u015ftirilecek \u00f6deme veya kredi aktar\u0131m\u0131 i\u015flemleri yasaklanabilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>M\u00fclkiyete \u0130li\u015fkin K\u0131s\u0131tlamalar<\/strong>: ABD yarg\u0131 yetkisine tabi olmas\u0131 \u015fart\u0131 ile yapt\u0131r\u0131m uygulanan ki\u015finin m\u00fclke ili\u015fkin t\u00fcm i\u015flemleri k\u0131s\u0131tlanabilir. Bu ki\u015finin halihaz\u0131rda elinde bulunan m\u00fclkleri \u00fczerindeki m\u00fclkiyet haklar\u0131n\u0131n kullan\u0131m\u0131 engellenebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Yapt\u0131r\u0131ma Konu Ki\u015filere Y\u00f6nelik Yat\u0131r\u0131mlar\u0131n ve Di\u011fer Bor\u00e7lanma Ara\u00e7lar\u0131n\u0131n Engellenmesi<\/strong>: ABD\u2019li ger\u00e7ek veya t\u00fczel ki\u015filerin yapt\u0131r\u0131ma tabi ki\u015filere yat\u0131r\u0131m yapmalar\u0131, bu ki\u015filerden kayda de\u011fer miktarda hisse veya herhangi bir bor\u00e7lanma arac\u0131 sat\u0131n almalar\u0131 yasaklanabilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Yapt\u0131r\u0131ma Konu T\u00fczel Ki\u015filerde G\u00f6rev Yapan \u00c7al\u0131\u015fanlara Y\u00f6nelik K\u0131s\u0131tlamalar<\/strong>: Yapt\u0131r\u0131ma konu t\u00fczel ki\u015filerin \u00e7al\u0131\u015fanlar\u0131n\u0131n veya y\u00f6neticilerinin yahut kontrol sahibi hissedarlar\u0131n\u0131n ABD vize ba\u015fvurular\u0131n\u0131n reddedilmesi sa\u011flanabilir ve bu ki\u015filere ABD\u2019ye giri\u015f yasa\u011f\u0131 getirilebilir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\"><strong>Yapt\u0131r\u0131ma Konu T\u00fczel Ki\u015filerin Y\u00f6neticilerine Kar\u015f\u0131 K\u0131s\u0131tlamalar<\/strong>: Yapt\u0131r\u0131ma konu t\u00fczel ki\u015filerin y\u00f6neticilerine ya da \u00e7al\u0131\u015fanlar\u0131na veyahut sahip olduklar\u0131 benzer yetkilerle bu ki\u015filere benzer g\u00f6rev ifa eden ki\u015filere de CAATSA\u2019n\u0131n 235. maddesinde \u00f6ng\u00f6r\u00fclen yapt\u0131r\u0131mlardan herhangi birinin veya birka\u00e7\u0131n\u0131n uygulanmas\u0131na karar verilebilir.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA uyar\u0131nca, ABD Ba\u015fkan\u0131\u2019n\u0131n 12 yapt\u0131r\u0131m kaleminden en az be\u015fini se\u00e7mesi gerekiyor. ABD Ba\u015fkan\u0131, milli g\u00fcvenlik gerek\u00e7esiyle &#8220;<em>yapt\u0131r\u0131m uygulamaktan feragat etme<\/em>&#8221; yetkisine sahiptir.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA yasas\u0131n\u0131n 231. maddesinin uygulanma ko\u015fullar\u0131;<\/span><\/h3>\n<ul>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA, Rusya Federasyonu H\u00fck\u00fcmeti ile do\u011frudan veya H\u00fck\u00fcmet ad\u0131na hareket eden ger\u00e7ek ve\/veya t\u00fczel ki\u015filerle \u00f6nemli nitelikte i\u015flem yapan ger\u00e7ek ve\/veya t\u00fczel ki\u015filere uygulanabilmektedir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">S\u00f6z konusu ki\u015filerin, bahse konu i\u015flem, durum veya i\u015flemden kaynaklanan sonu\u00e7lar hakk\u0131nda bilgi sahibi olmas\u0131 ve\/veya bilgi sahibi olabilecek durumda olmas\u0131 (knowingly) gerekmektedir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130\u015flem yap\u0131lan Rusya Federasyonu H\u00fck\u00fcmeti kavram\u0131, Rusya Federasyonu G\u00fcvenlik G\u00fc\u00e7leri\u2019nin istihbarat \u00f6rg\u00fctleri ile Rusya Federasyonu\u2019nun ulusal g\u00fcvenlikten sorumlu organlar\u0131n\u0131 da i\u00e7ermektedir.<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yapt\u0131r\u0131m uygulanmas\u0131na sebep olan i\u015flemin \u00f6nemli nitelikte i\u015flem olmas\u0131 gerekmektedir. \u00d6nemli nitelikte i\u015flem de\u011ferlendirmesi yap\u0131l\u0131rken;<\/span>\n<ul>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ABD ulusal g\u00fcvenli\u011fi ve d\u0131\u015f politika \u00e7\u0131karlar\u0131 bak\u0131m\u0131ndan i\u015flemin menfi sonu\u00e7 do\u011furabilecek nitelikte olup olmamas\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">i\u015flemin Rusya Federasyonu H\u00fck\u00fcmeti\u2019nin istihbarat ve savunma sekt\u00f6rleriyle olan ili\u015fkisinin g\u00fcc\u00fc ve d\u00fczeyi, i\u015flemin yap\u0131s\u0131 ve b\u00fcy\u00fckl\u00fc\u011f\u00fc,<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">gibi unsurlar dikkate al\u0131nmaktad\u0131r.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu kapsamda, tamamen ve niha\u00ee olarak sivil ama\u00e7lara ve\/veya kullan\u0131c\u0131lara hizmet eden ve istihbarat sekt\u00f6r\u00fc ile ili\u015fkisi olmayan bir i\u015flemin genel olarak \u00f6nemli i\u015flem olmad\u0131\u011f\u0131 savunulabilecektir. Bununla birlikte, ilgili kriterler t\u00fcketici nitelikte olmay\u0131p, somut olay bazl\u0131 de\u011ferlendirmelerde \u00f6nemli i\u015flemin tespiti bak\u0131m\u0131ndan farkl\u0131 kriterler ortaya konabilecektir.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Rostec Firmas\u0131 taraf\u0131ndan S-400 Hava Savunma Sistemlerinin T\u00fcrkiye\u2019ye Sat\u0131\u015f\u0131<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye Cumhuriyeti H\u00fck\u00fcmeti\u2019nin Rusya Federasyonu\u2019nun savunma sanayi ve teknoloji \u015firketi Rostec ile S-400 hava savunma sistemlerinin T\u00fcrkiye\u2019ye sat\u0131\u015f\u0131na ili\u015fkin yapm\u0131\u015f oldu\u011fu i\u015flemin, CAATSA yapt\u0131r\u0131mlar\u0131n\u0131 tetikleyebilecek \u201c<em>\u00f6nemli bir i\u015flem<\/em>\u201d potansiyeline sahiptir. Zira, s\u00f6z konusu i\u015flem, Rusya Federasyonu H\u00fck\u00fcmeti\u2019nin savunma sekt\u00f6r\u00fcne ili\u015fkin olup, T\u00fcrkiye\u2019ye S-400 sat\u0131\u015f\u0131n\u0131 ger\u00e7ekle\u015ftiren Rostec, CAATSA\u2019n\u0131n Rusya Federasyonu H\u00fck\u00fcmeti\u2019nin istihbarat ve savunma sekt\u00f6rleriyle ba\u011flant\u0131l\u0131 bir \u015fekilde Rus H\u00fck\u00fcmeti ile do\u011frudan veya Rus H\u00fck\u00fcmeti ad\u0131na veya temsilen hareket eden bir ki\u015fi ile i\u015flem yapan ki\u015filere yapt\u0131r\u0131m uygulanmas\u0131n\u0131 \u00f6ng\u00f6ren 231(e). maddesi kapsam\u0131nda say\u0131lan \u015firketlerden birisi olarak de\u011ferlendirilmektedir.<\/span><\/p>\n<h3 style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yapt\u0131r\u0131mlara kar\u015f\u0131 \u0130dari ve Adli \u0130tiraz Yollar\u0131<\/span><\/h3>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">CAATSA yapt\u0131r\u0131mlar\u0131na kar\u015f\u0131 <a href=\"https:\/\/www.bicakhukuk.com\/en\/sirketlere-abd-yaptirimlari-hukuki-analizi\/\" target=\"_blank\" rel=\"noopener\">ABD i\u00e7 hukukunda adli ve idari itiraz yollar\u0131<\/a> mevcuttur. Yapt\u0131r\u0131mlar, belirlenen kurulu\u015flar ve bireylerin d\u0131\u015f\u0131nda zorluklar ortaya \u00e7\u0131karabilir.
