{"id":20389,"date":"2020-05-21T02:04:30","date_gmt":"2020-05-20T23:04:30","guid":{"rendered":"https:\/\/www.bicakhukuk.com\/?p=20389"},"modified":"2021-05-16T21:09:29","modified_gmt":"2021-05-16T18:09:29","slug":"large-fine-for-breach-of-the-turkish-personal-data-protection-law","status":"publish","type":"post","link":"https:\/\/www.bicakhukuk.com\/en\/large-fine-for-breach-of-the-turkish-personal-data-protection-law\/","title":{"rendered":"Large Fine for Breach of Personal Data Protection"},"content":{"rendered":"<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">In a recent decision published\u00a0on the 7<sup>th<\/sup>\u00a0of May 2020,\u00a0<a href=\"https:\/\/www.kvkk.gov.tr\/Icerik\/6739\/2020-173\">the Turkish Data Protection Board imposed two\u00a0administrative fines on Amazon Turkey Perakende Hizmetleri Limited \u015eirketi\u00a0:<\/a><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00b7\u00a0 1,100,000 TL for not taking adequate technical and administrative measures to ensure the appropriate level of data security,<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00b7\u00a0 100,000 TL for not fulfilling the requirements for informing the data subjects.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">There are three important outcomes from this decision:\u00a0\u00a0<\/span><\/p>\n<ul style=\"list-style-type: square;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The confusion on whether the Turkish Data Protection Board has the authority to impose fines for transferring data abroad, has been resolved. With this decision, it is clarified that fines can be imposed on companies when transferring data abroad without due respect for the provisions of the law.<\/span><\/li>\n<\/ul>\n<ul style=\"list-style-type: square;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt; text-align: justify;\">The importance of receiving explicit consent from the personal data subjects\u00a0 for processing, storing, and transferring personal data is once again highlighted:<\/span><\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Consent should be obtained for all data\u00a0processing activities<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Approval by the data subject of a company\u2019s privacy policy does not release the company from the requirement for obtaining an explicit consent<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"list-style-type: none;\">\n<ul style=\"text-align: justify;\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Explicit consent should always be obtained in order to transfer data out of Turkey\u00a0<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">The significance for companies of abiding with the general data protection principles, which are imposed by the Turkish Personal Data Protection Law, is emphasized with this decision, as the basis for imposing the fines is related to the general principles for data protection, rather than particular breaches of the law.<\/span><\/li>\n<\/ul>\n","protected":false},"excerpt":{"rendered":"<p>In a recent decision published\u00a0on the 7th\u00a0of May 2020,\u00a0the Turkish Data Protection Board imposed two\u00a0administrative fines on Amazon Turkey Perakende Hizmetleri Limited \u015eirketi\u00a0: \u00b7\u00a0 1,100,000 TL for not taking adequate technical and administrative measures to ensure the appropriate level of data security, \u00b7\u00a0 100,000 TL for not fulfilling the requirements for informing the data subjects.
