With a strong belief that sustainable growth and overall success can be achieved integrating applicable knowledge and experience with local conditions, B\u0131\u00e7ak Law is committed to acting with social responsibility awareness in addition to its reliable, transparent and honest attitude in all activities.<\/span><\/p>\n

Acting in accordance with universal values and ethical principles, while being sensitive to local cultures and traditions are the basic principles of our quality policy. With this in mind, we are constantly striving to improve our service quality processes.<\/span><\/p>\n

Needs and expectations<\/strong><\/span><\/h3>\n

Our quality policy is to achieve success by providing a standard of service that consistently meets the needs and expectations<\/strong> of our clients. We are committed to providing a good standard of service to all clients and all staff share responsibility for ensuring that we achieve this.<\/span><\/p>\n

We treat our clients fairly and with respect<\/strong>. In all cases, we will<\/span><\/p>\n

    \n
  • Explain to the client, record in the file, and confirm in writing any limitations or conditions on what we can do for them, e.g. because of the way their matter is funded,<\/span><\/li>\n
  • Have due regard to their mental capacity or other vulnerability (e.g. incapacity, duress or disability) when taking instructions and during the matter,<\/span><\/li>\n
  • Consider whether a conflict of interest exists or has arisen.<\/span><\/li>\n<\/ul>\n

    We tailor our client care arrangements to the needs of each client<\/strong> to ensure that the information we provide is appropriate. For every client we consider:<\/span><\/p>\n

      \n
    • Whether they are used to dealing with law firms,<\/span><\/li>\n
    • To what extent our standard engagement letter is appropriate or whether further steps need to be taken to make sure they understand it,<\/span><\/li>\n
    • Whether they are in a position to make informed decisions,<\/span><\/li>\n
    • Whether they are vulnerable.<\/span><\/li>\n<\/ul>\n

      Enquiries from potential clients<\/strong> will be dealt with in accordance with our New Enquiry Procedures policy. We will treat prospective clients with the same level as\u00a0 existing clients.<\/span><\/p>\n

      Protecting client interests<\/strong><\/span><\/h3>\n

      We will provide services to clients in a manner that protects their interests<\/strong>. This includes ensuring clients are to make informed decisions about:<\/span><\/p>\n

        \n
      • The services they need<\/span><\/li>\n
      • How their matter will be handle<\/span><\/li>\n
      • The options available to them.<\/span><\/li>\n<\/ul>\n

        Each head of department must ensure that we have the adequate resources, skills<\/strong> and procedures to carry out a client’s instructions in a competent and timely manner, taking into account the client’s best interests. \u00a0Heads of department will review all new matters each week to ensure compliance with these requirements.<\/span><\/p>\n

        Lawyers must provide clients with their details such as name and status (i.e. attorney, trainee attorney, etc) and the name and status of the person with overall responsibility for their matter.<\/span><\/p>\n

        Level of service<\/strong><\/span><\/h3>\n

        Lawyers will agree an appropriate level of service<\/strong> with clients, e.g. how they will keep the client informed of progress (i.e. by letter, email or telephone) and how often. We will explain our responsibilities and those of the client. This will be recorded in the matter file and confirmed to the client in writing.<\/span><\/p>\n

        Lawyers will ensure that telephone calls and correspondence from the client and others are responded to in a timely manner.<\/span><\/p>\n

        Lawyers will ensure that the case strategy<\/strong> for a matter is always evident in the matter file.\u00a0 In complex matters, a project plan should also be developed.<\/span><\/p>\n

        File maintenance<\/strong><\/span><\/h3>\n

        Lawyers will ensure that the status of the matter and the action taken can be easily checked by other members of staff. Lawyers will maintain all key information in the file. File maintenance<\/strong> includes;<\/span><\/p>\n

          \n
        • Letters, emails and other communications to and from the client<\/span><\/li>\n
        • Attendance notes or other records of information<\/span><\/li>\n
        • A record of any statements given to the client<\/span><\/li>\n
        • A record of any steps taken to protect the client’s interests<\/span><\/li>\n
        • All costs and funding information and updates<\/span><\/li>\n
        • Any other documents relevant to the matter.<\/span><\/li>\n<\/ul>\n

          Engagement letter<\/span><\/h3>\n

          We will discuss our fees<\/strong> and funding at the initial client meeting, over the phone or by email\/letter and then confirm our discussion in writing (unless already covered in the email\/letter exchange). Our engagement letter\u00a0 covers the key costs and funding information that we are required to give to clients.<\/span><\/p>\n

          We will provide the best possible information about the likely total cost of the client’s matter at the outset and where appropriate as the matter progresses. General cost information<\/strong> should include:<\/span><\/p>\n

            \n
          • Our antipated fees<\/span><\/li>\n
          • Expected disbursements (including whether disbursements are subject to VAT)<\/span><\/li>\n
          • Whether rates are likely increase during the period we are instructed<\/span><\/li>\n
          • Whether we will charge if the matter does not proceed, e.g. where the sale of a property falls through<\/span><\/li>\n
          • Whether the client has any potential liability for another party’s costs<\/span><\/li>\n
          • How often we will provide cost updates<\/span><\/li>\n
          • Whether the client has set an upper limit on costs.<\/li>\n<\/ul>\n

            We will agree and record payment<\/strong> terms with each client, in particular how and when costs are to be paid, unless these covered by our standard terms of business in the engagement letter.<\/span><\/p>\n

            Informed decisions<\/span><\/h3>\n

            Clients must be able to make informed decisions and cost-benefit risk analyses<\/strong> about:<\/span><\/p>\n

              \n
            • The services they need<\/span><\/li>\n
            • How their matter will be handled<\/span><\/li>\n
            • The options available to them.<\/span><\/li>\n<\/ul>\n

              To make such decisions, the client will need to know how much our services are likely to cost. We will discuss whether the potential outcomes of the client’s matter are likely to justify the expense or risk involved.<\/span><\/p>\n

              Confidentiality<\/strong><\/span><\/p>\n

              We have a legal and regulatory duty to protect our clients’ confidential information. The protection of confidentiality<\/strong> is a fundamental feature of our relationship with clients. This duty continues after the end of the angagement and even after the death of a client. All employees, including support staff and consultants, owe a duty of confidentiality to clients. Everyone must keep\u00a0 client matters confidential (including invoices) unless:<\/span><\/p>\n

                \n
              • Disclosure is required or permitted by law,<\/span><\/li>\n
              • The client consents.<\/span><\/li>\n<\/ul>\n

                We will ensure that we are satisfied that any external provider has taken all reasonable\u00a0 steps to protect clients’ confidential information.<\/span><\/p>\n

                Equality & diversity<\/strong><\/span><\/h3>\n

We will not unlawfully discriminate or victimise or harass anyone, including clients, and must provide services to clients in a way that respects diversity.
