Divorce Suit: Those lawsuit cases are regulated under the Turkish Civil Code Article 161-166. Main purpose of the divorce suits are concluding marriage.
Divorce suits can be taken action when there is adultery, attempt on life, treatment against human dignity, abandonment, irreconcilable differences. Any of those reason is sufficient to take divorce suit under the Turkish Civil Code.
Marriages that lasted more than 1 year can be concluded via divorce suit. Besides that those marriages can be concluded with consensus.
Divorce Suits can be filed in the Domestic Relations Court if there is none civil courts of general jurisdiction have authority to see those cases.
Divorce suits can only be filed by the side of faultless side of the marriage. If defective side files a suit against faultless side, judge rejects the lawcase.
In divorce cases it is not obligatory to hire a lawyer. However, it is important for parties to have a lawyer for not to expose a loss of a right.
It is common in Turkish law and divorce cases to demand alimony during and after the lawcase.
In divorce cases, judge decides on the custody of the children, how their care will be satisfied, quantity of the alimony and quantity of the indemnity that parties shall give depending on the reasoning of the case.
