Her ne kadar rapor hukuken ba\u011flay\u0131c\u0131 bir belge niteli\u011fi ta\u015f\u0131m\u0131yor olsa da, Avrupa Birli\u011fi kurumlar\u0131n\u0131n ve bir\u00e7ok \u00fcye devletin T\u00fcrkiye&#8217;ye ili\u015fkin yakla\u015f\u0131m\u0131n\u0131 yans\u0131tmas\u0131 bak\u0131m\u0131ndan \u00f6nemli bir referans metni olarak kabul edilmektedir.\u00a0Raporun genel \u00e7er\u00e7evesi incelendi\u011finde dikkat \u00e7ekici bir ikili yakla\u015f\u0131m g\u00f6r\u00fclmektedir. Bir yandan Avrupa Parlamentosu, T\u00fcrkiye&#8217;nin demokrasi, hukukun \u00fcst\u00fcnl\u00fc\u011f\u00fc, temel haklar ve yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131 alanlar\u0131nda ciddi gerileme ya\u015fad\u0131\u011f\u0131n\u0131 savunmaktad\u0131r. Di\u011fer yandan ise T\u00fcrkiye&#8217;nin Avrupa g\u00fcvenli\u011fi, NATO, enerji arz g\u00fcvenli\u011fi, g\u00f6\u00e7 y\u00f6netimi, ticaret ve b\u00f6lgesel istikrar bak\u0131m\u0131ndan vazge\u00e7ilmez bir ortak oldu\u011funu kabul etmektedir.\u00a0Bu durum, son y\u0131llarda Avrupa Birli\u011fi i\u00e7erisinde giderek g\u00fc\u00e7lenen yeni bir yakla\u015f\u0131m\u0131n yans\u0131mas\u0131d\u0131r. Buna g\u00f6re T\u00fcrkiye art\u0131k yaln\u0131zca bir aday \u00fclke olarak de\u011fil; ayn\u0131 zamanda Avrupa&#8217;n\u0131n g\u00fcvenlik, ekonomi ve d\u0131\u015f politika mimarisinin ayr\u0131lmaz bir par\u00e7as\u0131 olarak de\u011ferlendirilmektedir.\u00a0Bu nedenle rapor yaln\u0131zca \u00fcyelik s\u00fcrecine ili\u015fkin bir de\u011ferlendirme olarak okunmamal\u0131d\u0131r. Metin ayn\u0131 zamanda Avrupa Birli\u011fi&#8217;nin T\u00fcrkiye ile ili\u015fkilerinde hangi alanlarda i\u015f birli\u011fini s\u00fcrd\u00fcrmek istedi\u011fini ve hangi alanlarda ciddi endi\u015feler ta\u015f\u0131d\u0131\u011f\u0131n\u0131 ortaya koymaktad\u0131r.<!--more--><\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u00d6zellikle uluslararas\u0131 yat\u0131r\u0131mc\u0131lar, finans kurulu\u015flar\u0131, ihracat\u00e7\u0131lar, savunma sanayii \u015firketleri ve \u00e7ok uluslu \u015firketler a\u00e7\u0131s\u0131ndan raporun i\u00e7eri\u011fi yaln\u0131zca siyasi bir tart\u0131\u015fma de\u011fildir. Hukuki \u00f6ng\u00f6r\u00fclebilirlik, yat\u0131r\u0131m g\u00fcvenli\u011fi, yapt\u0131r\u0131m riskleri, AML\/CFT y\u00fck\u00fcml\u00fcl\u00fckleri, kurumsal uyum sistemleri ve uluslararas\u0131 uyu\u015fmazl\u0131k \u00e7\u00f6z\u00fcm\u00fc bak\u0131m\u0131ndan da \u00f6nemli mesajlar i\u00e7ermektedir. Bu \u00e7al\u0131\u015fmada Avrupa Parlamentosu&#8217;nun 2025 T\u00fcrkiye Raporu; hukuk devleti, demokratik y\u00f6neti\u015fim, yapt\u0131r\u0131mlar, uyum sistemleri (compliance), kara para aklamayla m\u00fccadele (AML), yabanc\u0131 yat\u0131r\u0131mlar ve uluslararas\u0131 tahkim perspektiflerinden de\u011ferlendirilecektir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yeni Denge: \u00dcyelik S\u00fcrecinden Stratejik Ortakl\u0131\u011fa<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Avrupa Parlamentosu raporunun en \u00f6nemli sonu\u00e7lar\u0131ndan biri, T\u00fcrkiye&#8217;nin Avrupa Birli\u011fi ile ili\u015fkilerinde yeni bir d\u00f6nemin fiilen ba\u015flam\u0131\u015f oldu\u011funu ortaya koymas\u0131d\u0131r. T\u00fcrkiye&#8217;nin Avrupa Birli\u011fi&#8217;ne adayl\u0131k s\u00fcreci 1999 y\u0131l\u0131nda Helsinki Zirvesi&#8217;nde resmen ba\u015flam\u0131\u015f, 2005 y\u0131l\u0131nda ise kat\u0131l\u0131m m\u00fczakereleri a\u00e7\u0131lm\u0131\u015ft\u0131r. Ancak son y\u0131llarda ya\u015fanan siyasi geli\u015fmeler nedeniyle \u00fcyelik s\u00fcreci b\u00fcy\u00fck \u00f6l\u00e7\u00fcde durmu\u015f durumdad\u0131r.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Rapora g\u00f6re bu durgunlu\u011fun temel nedeni ekonomik g\u00f6stergeler de\u011fil; demokrasi, temel haklar ve hukuk devleti alanlar\u0131nda ya\u015fanan geli\u015fmelerdir. Avrupa Parlamentosu, bu alanlarda kayda de\u011fer ilerleme sa\u011flanmad\u0131\u011f\u0131 s\u00fcrece \u00fcyelik perspektifinin yeniden canland\u0131r\u0131lmas\u0131n\u0131n m\u00fcmk\u00fcn g\u00f6r\u00fcnmedi\u011fi g\u00f6r\u00fc\u015f\u00fcndedir.\u00a0Bununla birlikte raporun dikkat \u00e7ekici y\u00f6n\u00fc, T\u00fcrkiye ile ili\u015fkilerin tamamen kopar\u0131lmas\u0131n\u0131 \u00f6nermemesidir. Aksine Parlamento;<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00fcmr\u00fck Birli\u011fi&#8217;nin g\u00fcncellenmesini,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">ticari ili\u015fkilerin geli\u015ftirilmesini,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">enerji i\u015f birli\u011finin g\u00fc\u00e7lendirilmesini,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">g\u00f6\u00e7 y\u00f6netiminde koordinasyonun s\u00fcrd\u00fcr\u00fclmesini,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">savunma ve g\u00fcvenlik alanlar\u0131nda i\u015f birli\u011finin devam ettirilmesini,<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">desteklemektedir.\u00a0Bu yakla\u015f\u0131m, Avrupa Birli\u011fi&#8217;nin T\u00fcrkiye&#8217;yi art\u0131k yaln\u0131zca bir aday \u00fclke olarak de\u011fil, ayn\u0131 zamanda vazge\u00e7ilmez bir stratejik ortak olarak de\u011ferlendirdi\u011fini g\u00f6stermektedir. Dolay\u0131s\u0131yla raporun temel mesaj\u0131 \u015fu \u015fekilde \u00f6zetlenebilir: T\u00fcrkiye&#8217;nin Avrupa Birli\u011fi \u00fcyelik perspektifi zay\u0131flam\u0131\u015f olsa da, Avrupa&#8217;n\u0131n g\u00fcvenli\u011fi ve ekonomik istikrar\u0131 a\u00e7\u0131s\u0131ndan ta\u015f\u0131d\u0131\u011f\u0131 stratejik \u00f6nem devam etmektedir.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Hukukun \u00dcst\u00fcnl\u00fc\u011f\u00fc ve Yarg\u0131 Ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Avrupa Parlamentosu raporunun tamam\u0131 incelendi\u011finde, metnin merkezinde yer alan temel konunun hukuk devleti oldu\u011fu g\u00f6r\u00fclmektedir. Asl\u0131nda raporda yer alan bir\u00e7ok ele\u015ftiri, do\u011frudan veya dolayl\u0131 olarak yarg\u0131n\u0131n i\u015fleyi\u015fi, kuvvetler ayr\u0131l\u0131\u011f\u0131 ve temel haklar\u0131n korunmas\u0131 ile ili\u015fkilendirilmektedir.\u00a0Parlamentonun de\u011ferlendirmesine g\u00f6re son y\u0131llarda ya\u015fanan geli\u015fmeler, T\u00fcrkiye&#8217;nin Avrupa Birli\u011fi \u00fcyelik s\u00fcrecinde en kritik fas\u0131llar olarak kabul edilen yarg\u0131 ve temel haklar alanlar\u0131nda ilerleme kaydedemedi\u011fini g\u00f6stermektedir. Rapor, \u00f6zellikle yarg\u0131 ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131, h\u00e2kim ve savc\u0131lar\u0131n kurumsal g\u00fcvenceleri, y\u00fcksek mahkeme kararlar\u0131n\u0131n uygulanmas\u0131 ve siyasi nitelikli davalara ili\u015fkin endi\u015feleri \u00f6n plana \u00e7\u0131karmaktad\u0131r.<\/span><\/p>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Bu noktada dikkat \u00e7ekici husus, raporun yaln\u0131zca belirli davalara veya belirli siyasi akt\u00f6rlere odaklanmamas\u0131d\u0131r. Avrupa Parlamentosu, sorunun m\u00fcnferit olaylardan ziyade yap\u0131sal bir niteli\u011fe sahip oldu\u011fu g\u00f6r\u00fc\u015f\u00fcn\u00fc ortaya koymaktad\u0131r.\u00a0\u00d6zellikle \u015fu ba\u015fl\u0131klar \u00f6ne \u00e7\u0131kmaktad\u0131r:<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">H\u00e2kimler ve Savc\u0131lar Kurulu&#8217;nun yap\u0131s\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Yarg\u0131 organlar\u0131n\u0131n kurumsal ba\u011f\u0131ms\u0131zl\u0131\u011f\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Anayasa Mahkemesi kararlar\u0131n\u0131n uygulanmas\u0131na ili\u015fkin tart\u0131\u015fmalar,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Avrupa \u0130nsan Haklar\u0131 Mahkemesi kararlar\u0131n\u0131n infaz\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Uzun tutukluluk uygulamalar\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Gizli tan\u0131k kullan\u0131m\u0131na ili\u015fkin ele\u015ftiriler,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">\u0130fade \u00f6zg\u00fcrl\u00fc\u011f\u00fc davalar\u0131.<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Raporun en \u00f6nemli y\u00f6nlerinden biri ise hukuk devleti konusunu yaln\u0131zca insan haklar\u0131 meselesi olarak ele almamas\u0131d\u0131r. Avrupa Parlamentosu, hukuk devleti ile ekonomik g\u00fcven aras\u0131nda do\u011frudan ba\u011flant\u0131 kurmaktad\u0131r.\u00a0Ger\u00e7ekten de modern yat\u0131r\u0131m ortamlar\u0131nda hukuki g\u00fcvenlik yaln\u0131zca bireysel haklar\u0131n korunmas\u0131 a\u00e7\u0131s\u0131ndan de\u011fil, ekonomik \u00f6ng\u00f6r\u00fclebilirlik bak\u0131m\u0131ndan da kritik \u00f6neme sahiptir. Bir yat\u0131r\u0131mc\u0131n\u0131n s\u00f6zle\u015fmesinin uygulanaca\u011f\u0131na, m\u00fclkiyet hakk\u0131n\u0131n korunaca\u011f\u0131na ve uyu\u015fmazl\u0131klar\u0131n tarafs\u0131z \u015fekilde \u00e7\u00f6z\u00fcmlenece\u011fine dair g\u00fcven duymas\u0131, yat\u0131r\u0131m kararlar\u0131n\u0131n temel unsurlar\u0131ndan biridir.\u00a0Bu nedenle Avrupa Parlamentosu&#8217;nun hukuk devleti ele\u015ftirileri yaln\u0131zca siyasi bir tart\u0131\u015fma olarak de\u011ferlendirilmemelidir. Raporun bu b\u00f6l\u00fcm\u00fc ayn\u0131 zamanda yat\u0131r\u0131m ortam\u0131na ili\u015fkin de\u011ferlendirmelerin de temelini olu\u015fturmaktad\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">T\u00fcrkiye&#8217;nin Bak\u0131\u015f A\u00e7\u0131s\u0131 ve Kar\u015f\u0131 Arg\u00fcmanlar<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Raporda yer alan de\u011ferlendirmelerin tamam\u0131n\u0131n T\u00fcrkiye taraf\u0131ndan kabul edildi\u011fini s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir.\u00a0T\u00fcrk makamlar\u0131 uzun s\u00fcredir;<\/span><\/p>\n<ul data-spread=\"false\">\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ter\u00f6rle m\u00fccadele ko\u015fullar\u0131n\u0131n dikkate al\u0131nmad\u0131\u011f\u0131n\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">G\u00fcvenlik tehditlerinin yeterince anla\u015f\u0131lmad\u0131\u011f\u0131n\u0131,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Avrupa Parlamentosu&#8217;nun siyasi saiklerle hareket etti\u011fini,<\/span><\/li>\n<li><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Baz\u0131 de\u011ferlendirmelerin objektiflikten uzak oldu\u011funu,<\/span><\/li>\n<\/ul>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">savunmaktad\u0131r.\u00a0\u00d6zellikle 15 Temmuz darbe giri\u015fimi sonras\u0131nda ortaya \u00e7\u0131kan g\u00fcvenlik ortam\u0131, s\u0131n\u0131r \u00f6tesi ter\u00f6r tehditleri, d\u00fczensiz g\u00f6\u00e7 bask\u0131s\u0131 ve b\u00f6lgesel \u00e7at\u0131\u015fmalar T\u00fcrkiye taraf\u0131ndan s\u0131kl\u0131kla vurgulanmaktad\u0131r.\u00a0Bu nedenle raporun daha sa\u011fl\u0131kl\u0131 de\u011ferlendirilmesi i\u00e7in hem Avrupa Parlamentosu&#8217;nun ele\u015ftirilerinin hem de T\u00fcrkiye&#8217;nin g\u00fcvenlik ve egemenlik temelli arg\u00fcmanlar\u0131n\u0131n birlikte dikkate al\u0131nmas\u0131 gerekir.\u00a0Ancak buna ra\u011fmen Avrupa Birli\u011fi kurumlar\u0131n\u0131n uzun y\u0131llard\u0131r benzer konularda ele\u015ftiri y\u00f6neltti\u011fi de g\u00f6z ard\u0131 edilmemelidir. Dolay\u0131s\u0131yla raporda dile getirilen hususlar yaln\u0131zca ge\u00e7ici siyasi tart\u0131\u015fmalar olarak de\u011ferlendirilmemeli, ayn\u0131 zamanda Avrupa Birli\u011fi&#8217;nin T\u00fcrkiye&#8217;ye ili\u015fkin uzun vadeli beklentilerinin bir yans\u0131mas\u0131 olarak okunmal\u0131d\u0131r.<\/span><\/p>\n<h3><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">Ak\u0131n G\u00fcrlek ve AB \u0130nsan Haklar\u0131 Yapt\u0131r\u0131mlar\u0131 Tart\u0131\u015fmas\u0131<\/span><\/h3>\n<p class=\"isSelectedEnd\"><span style=\"font-family: 'times new roman', times, serif; font-size: 14pt;\">2025 Avrupa Parlamentosu T\u00fcrkiye Raporu&#8217;nun uluslararas\u0131 bas\u0131nda en fazla yank\u0131 uyand\u0131ran b\u00f6l\u00fcm\u00fc, d\u00f6nemin \u0130stanbul Cumhuriyet Ba\u015fsavc\u0131s\u0131 ve mevcut Adalet Bakan\u0131 Ak\u0131n G\u00fcrlek hakk\u0131nda yap\u0131lan de\u011ferlendirmeler olmu\u015ftur.\u00a0Avrupa Parlamentosu ilk kez bir T\u00fcrk Adalet Bakan\u0131n\u0131 a\u00e7\u0131k \u015fekilde ismen anmakta ve insan haklar\u0131 ihlallerinden sorumlu oldu\u011fu d\u00fc\u015f\u00fcn\u00fclen ki\u015filer hakk\u0131nda yapt\u0131r\u0131m de\u011ferlendirmesi yap\u0131lmas\u0131 \u00e7a\u011fr\u0131s\u0131nda bulunmaktad\u0131r.\u00a0Bu geli\u015fme birka\u00e7 nedenle \u00f6nem ta\u015f\u0131maktad\u0131r.\u00a0Birincisi, Avrupa Birli\u011fi kurumlar\u0131n\u0131n T\u00fcrkiye&#8217;deki hukuk devleti tart\u0131\u015fmas\u0131n\u0131 kurumsal d\u00fczeyden bireysel sorumluluk d\u00fczeyine ta\u015f\u0131maya ba\u015flamas\u0131d\u0131r. \u0130kincisi ise Avrupa Birli\u011fi&#8217;nin son y\u0131llarda geli\u015ftirdi\u011fi insan haklar\u0131 yapt\u0131r\u0131mlar\u0131 sisteminin T\u00fcrkiye ba\u011flam\u0131nda ilk kez bu kadar a\u00e7\u0131k \u015fekilde g\u00fcndeme getirilmesidir.\u00a0Ancak burada hukuki a\u00e7\u0131dan \u00f6nemli bir ayr\u0131m yap\u0131lmal\u0131d\u0131r.\u00a0Avrupa Parlamentosu yapt\u0131r\u0131m uygulama yetkisine sahip de\u011fildir. Parlamento yaln\u0131zca tavsiyede bulunabilir.\u00a0Yapt\u0131r\u0131m uygulanabilmesi i\u00e7in Avrupa Birli\u011fi Konseyi&#8217;nin karar almas\u0131 gerekir.\u00a0Dolay\u0131s\u0131yla raporda yer alan ifadeler do\u011frudan yapt\u0131r\u0131m anlam\u0131na gelmemektedir.
